submitted by: DOCTOR, JOSHUA 1395 (16-163401) (AR16-21780) DID UNLAWFULLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: POSSESSION OF 2.27 GRAMS OF METHAMPHETAMINE, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(A). ON 112816, AT APPROXIMATELY 2222 HOURS, I WAS CONDUCTING PATROL IN THE AREA OF GROVER CLEVELAND WHEN I WITNESSED AN OLDER MODEL WHITE TRUCK THAT APPEARED TO HAVE NO WORKING BRAKE LIGHTS WHILE MAKING TURNS. I WAS ABLE TO GET BEHIND SAID VEHICLE, WHICH WAS A WHITE GMC PICKUP BEARING FLORIDA LICENSE PLATE BY318O. I THEN CONDUCTED A TRAFFIC STOP, WHICH CAME TO REST AT WEST AQUADUCT STREET AND SOUTH PITTSBURGH AVENUE, IN HOMOSASSA. WHILE COMING TO A STOP, I COULD STILL NOT OBSERVE ILLUMINATION OF BRAKE LIGHTS. I THEN MADE A DRIVERâS SIDE APPROACH TO THE VEHICLE AND WAS MET BY THE DRIVER, LATER IDENTIFIED AS THE DEFENDANT, MR JOSEPH KORDECKI, IN THE DRIVERâS SEAT OF THE VEHICLE AND IN THE PASSENGERâS SEAT, MS COURTNEY SELKE. I ADVISED THE DRIVER THAT I HAD STOPPED HIM FOR NON-WORKING BRAKE LIGHTS. I THEN ASKED THE DRIVER FOR HIS IDENTIFICATION, PROOF OF INSURANCE AND REGISTRATION FOR THE VEHICLE. I ALSO ASKED MS SELKE IF SHE COULD PROVIDE IDENTIFICATION AS WELL. BOTH OCCUPANTS PROVIDED FLORIDA DRIVER'S LICENSES. UPON DOING CHECKS THROUGH THE DRIVER AND VEHICLE INFORMATION DATABASE OF THE DEFENDANTâS DRIVER'S LICENSE STATUS, IT WAS FOUND THAT HE HAD A SUSPENDED DRIVER'S LICENSE AS OF 060616 FOR FINANCIAL RESPONSIBILITIES AND HE WAS GIVEN NOTICE ON 052116. I THEN APPROACHED THE DRIVERâS SIDE AGAIN AND ASKED MR KORDECKI TO STEP OUT OF THE VEHICLE, AT WHICH TIME HE EXITED FROM HIS DRIVERâS SIDE POSITION. I THEN CONDUCTED A PAT DOWN FOR WEAPONS, AND ASKED MR KORDECKI IF HE HAD ANYTHING ILLEGAL. AT THAT TIME, HE STATED, NO. I THEN DETAINED MR KORDECKI TO CONDUCT MY INVESTIGATION OF HIS DRIVERâS LICENSE. HE WAS PLACED IN HANDCUFFS, DOUBLE-LOCKED, BEHIND HIS BACK. I READ THE DEFENDANT HIS MIRANDA RIGHTS, VIA PRE-PRINTED AGENCY ISSUED CARD, AT WHICH TIME I ASKED HIM IF HE UNDERSTOOD HIS RIGHTS AND WISHED TO SPEAK WITH ME, AND HE RESPONDED THAT HE UNDERSTOOD AND WOULD LIKE TO SPEAK AT THAT TIME. I ASKED THE DEFENDANT IF WHILE HE WAS TURNING THE VEHICLE AND SLOWING DOWN IF HE PRESSED ON THE BRAKES WHICH WOULD CAUSE THE BRAKES TO ILLUMINATE, AND HE ADVISED THAT HE HAD APPLIED PRESSURE TO THE BRAKE PEDAL, AND I THEN AGAIN EXPLAINED TO HIM THAT HIS LIGHTS WERE NOT WORKING. I ASKED THE DEFENDANT IF HE WAS AWARE OF HIS DRIVER'S LICENSE BEING SUSPENDED, TO WHICH HE STATED NO, AND STATED THAT HE HAD PAID ALL OF HIS FINES. DEPUTY LABORDA (0735) AND DEPUTY COGAR (1306) ARRIVED ON SCENE. I THEN ASKED THE DEFENDANT IF HE HAD ANYTHING IN HIS POCKETS, AT THAT TIME HE ADVISED THAT HE HAD METHAMPHETAMINE. DEPUTY LABORDA THEN EMPTIED THE DEFENDANTâS POCKETS AND FOUND A CLEAR PLASTIC BAGGIE IN HIS RIGHT FRONT POCKET CONTAINING A CRYSTAL-LIKE SUBSTANCE THAT WAS IDENTIFIED AS METHAMPHETAMINE. THE BAGGIE AND THE CRYSTAL-LIKE SUBSTANCE WERE WEIGHED ON SCENE, WEIGHING IN AT 2.27 GRAMS AND FIELD TESTED POSITIVE FOR CRYSTAL METHAMPHETAMINE. THE DEFENDANT WAS PLACED UNDER ARREST FOR POSSESSION OF METHAMPHETAMINE, PLACED IN THE REAR OF MY AGENCY ISSUED PATROL VEHICLE AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. THE DEFENDANT WAS CHARGED WITH ONE COUNT OF POSSESSION OF A CONTROLLED SUBSTANCE WITH A BOND OF $2,000.00 PER THE BOND SCHEDULE. THE DEFENDANT WAS ISSUED A UNIFORM TRAFFIC CITATION NUMBER A21CW4P FOR DRIVING ON A SUSPENDED LICENSE WITH A MANDATORY COURT APPEARANCE OF 121516 AT 1300 HOURS AT THE CITRUS COUNTY COURTHOUSE. THE DEFENDANT WAS ALSO GIVEN A WRITTEN TRAFFIC WARNING NUMBER 407399B FOR THE NON-WORKING BRAKE LIGHTS. A COPY OF THE CITATION AND THE WARNING TICKETS WERE PROVIDED FOR THE DEFENDANT AT THE CITRUS COUNTY DETENTION FACILITY. NO FURTHER ACTION TAKEN AT THIS TIME. |
