Probable cause affidavit: | SUBMITTED BY: FERGUSON, ROBERT 0505 (AR12-2784 CASE: 166511) DID UNLAWFULLY AND KNOWINGLY OBTAIN OR USE, OR ENDEAVOR TO OBTAIN OR USE THE PROPERTY OF THE VICTIM, SAVE A LOT, TO WIT: VARIOUS FOOD ITEMS, SAID PROPERTY BEING OF A VALUE OF $209.00, WITH THE INTENT TO EITHER TEMPORARILY OR PERMANENTLY DEPRIVE THE VICTIM OF A RIGHT TO THE PROPERTY OR A BENEFIT THEREOF, OR DID APPROPRIATE THE SAID PROPERTY TO HER OWN USE OR THE USE OF ANY PERSON NOT ENTITLED THERETO, IN VIOLATION OF FLORIDA STATE STATUT,E 812.014(3)(C). ON 091712 I RESPONDED TO THE SAVE A LOT STORE LOCATED AT 204 SE HIGHWAY 19 IN CRYSTAL RIVER, IN REFERENCE TO A THEFT IN PROGRESS. UPON ARRIVAL I MADE CONTACT WITH THE SAVE A LOT STORE MANAGER, MR BILL KRUPIK. HE ADVISED THAT HE OBSERVED THE DEFENDANT, MS JOSEPHINE WESTON, EXIT THE STORE WITH A SHOPPING CART FULL OF MERCHANDISE WITHOUT ATTEMPTING TO PAY FOR THE ITEMS. THE DEFENDANT THEN PASSED ALL POINTS OF SALE AND EXITED THE STORE AT WHICH TIME HE CONFRONTED HER AT HER VEHICLE. THE COMPLAINANT FURTHER ADVISED THERE WAS A SECOND SUBJECT, AN UNKNOWN WHITE MALE, WHO APPEARED TO BE ASSISTING THE DEFENDANT BY PLACING ITEMS IN TO HER TRUNK. AS THE COMPLAINANT APPROACHED THE DEFENDANT, THE UNKNOWN MALE SUBJECT SHUT THE TRUNK AND FLED THE SCENE ON FOOT. THE COMPLAINANT THEN NOTIFIED THIS AGENCY. I WAS ABLE TO VIEW SURVEILLANCE VIDEO WHICH SHOWED THE DEFENDANT WALKING OUT OF THE STORE WITH A SHOPPING CART FULL OF ITEMS WITHOUT PAYING FOR THOSE ITEMS. THE DEFENDANT WAS ASKED FOR PERMISSION TO SEARCH THE VEHICLE WHICH SHE GRANTED, AND UPON OPENING THE TRUNK, I LOCATED NUMEROUS PACKAGES OF MEAT WHICH INCLUDED STEAKS, RIBS AND PORK CHOPS. THE TOTAL FOR ALL THE ITEMS TAKEN WAS $209.00. THE DEFENDANT ADVISED INITIALLY THAT SHE HAD PURCHASED THE ITEMS AND PAID FOR THEM WITH A ONE HUNDRED DOLLAR BILL. AFTER ADVISING THE DEFENDANT HOW MUCH THE ITEMS COST, SHE RECANTED HER PREVIOUS STATEMENT, SAID SHE WAS SORRY AND ADMITTED TO TAKING THE ITEMS. THE STOLEN ITEMS WERE THEN TURNED BACK OVER TO THE COMPLAINANT. AT THAT TIME THE DEFENDANT WAS PLACED UNDER ARREST AND SECURED IN THE REAR SEAT OF MY PATROL VEHICLE FOR TRANSPORT TO THE CITRUS COUNTY DETENTION FACILITY. UPON ARRIVAL AT THE DETENTION FACILITY, A CRIMINAL HISTORY CHECK REVEALED THE DEFENDANT WAS CURRENTLY ON FELONY PROBATION FOR RETAIL THEFT AND HAD AT LEAST TWO PRIOR CONVICTIONS IN MARION AND CITRUS COUNTIES. DUE TO THE PREVIOUS CONVICTIONS, THE DEFENDANT WAS CHARGED WITH FELONY RETAIL THEFT AND HER BOND SET AT $2,000.00. A COPY OF THE SURVEILLANCE VIDEO WILL BE COLLECTED AT A LATER TIME. |
