SUBMITTED BY: hilberer, BRIAN 0440 (ar07005375) did drive a motor vehicle upon a highway in the State of Florida without having a valid driver's license authorizing him to do so, in violation of Florida Statutes 322.03(a); and did drive a motor vehicle upon a highway in the State of Florida without having a motor vehicle registration, in violation of Florida Statute 322.02; and did drive a motor vehicle upon a highway in the State of Florida without having an attached tag assigned to that vehicle, in violation of Florida Statute 320.261; ON 100107, AT APPROXIMATELY 1855 HOURS I WAS CONDucting TRAFFIC ENFORCEMENT IN THE AREA OF HERNANDO. WHILE TRAVELING WESTBOUND ON CounTY ROAD 486, I OBSERVED IN FRONT OF ME ALSO TRAVELING WESTBOUND, A TAN BUICK BEARING FLorida TAG E644FT, IN THE AREA OF CANTERBURY LAKE ESTATES. THE VEHICLE MADE A QUICK RIGHT TURN WHICH APPEARED TO BE AN ATTEMPT TO LOSE ME. I QUICKLY RAN THE VEHICLE'S TAG, AND DISCovered THAT tAG CAME BACK TO A WHITE CHEVrolet STATION WAGON. I TURNED AROUND IN AN ATTEMPT TO LOCATE THAT VEHICLE. UPON TURNING INTO CAnTERBURY LAKES ESTATES, I OBSERVED THAT THE TAN BUICK WAS NOW LEAVING CanTERBURY LAKE ESTATES. I TURNED AROUND AND STARTED FOLLOWING THE VEHICLE AND VERIFied THAT I TYPED IN THE CORRECT TAG NUMBER. I then INITIATED A TRAFFic STOP ON THE VEHICLE IN THE PARKING LOT OF THE HERNANdO ELEMENTARY SCHOOL. upon MAking CONTACT WITH THE DRIVER/ defendant, JOSHUA CURRY, i ASKED FOR HIS DRIVER'S LICENSE AND REGISTRATION. TO WHICH HE STATED HE DID NOT HAVE A LICENSE. i ASKED THE defendant WHY HE DID NOT HAVE A driver's LICENSE AND HE STATED BECAuSE HE NEVER GOT ONE. I ASKED THE defendant FOR SOME TYPE OF IDENTIFICATION AND HE PRODuced A WISconsin IDentification CARD. I EXPlained THE REASON FOR THE STOP, AND HE ADVISED THAT THE VEHICLE BELONGED TO A FAMILY MEMBER AND THAT HE just WENT TO THE POST OFFICE IN HERNando TO PAY A BILL. WHEN I INQUIRED FOR SOME TYPE OF REGISTRATION, THE defendant WAS UNABLE TO PROVIDE REGISTRATION AND HANDED ME THE VEHICLE'S TITLE. THE defendant STATED THAT HIS RELATIVE HAD JUST PURCHASED THE VEHICLE. UPON INSPECTING THE TITLE, IT DID NOT SHOW ANY SIGNATURES OR DATE OF SALE ON THE BACK, And the registered owner on the title was not the defendant's relative. i asked the defendant since the VEHICLE was not registered, where the tag on the VEHICLE came from, and he advised it came off his relative's chevrolet because they have NOT had an opportunity to register it yet. at that point, i returned to my PATROL VEHICLE and ran the defendant's information THROUGH my computer and verified that the defendant did not have a valid DRIVER'S LICENSE. I ALSO VERIFIED THAT THE VEHICLE WAS UNREGISTERED AND THAT THE BUICK DID NOT HAVE A TAG ASSIGNED TO IT, PER THE "DAVID" SYSTEM. the defendant was then placed under arrest, HANDCUFFED (DOUBLE LOCKED) BEHIND THE BACK AND placed in my patrol vehicle. I ASKED THE defendant IF THERE WAS ANYTHING I NEEDED TO BE AWARE OF, AND HE ADVISED THAT THERE WAS AN OPEN CONTAINER OF ALCOHOL UNDER THE PASSENGER SEAT, WHICH WAS HIS. search incident to arrest, i discovered under the front passenger seat, two sixteen ounce cans of spark's malt beverage, which CONTAINED seven percent alcohol by volume. both cans were cool to the touch and had condensation on them. one of the cans was opened and still had alcohol in it. prior to leaving the scene, the defendant's VEHICLE was towed by holman's TOWING SERVICE. the defendant was then transported to CITRUS COUNTY DETENTION FACILITY. upon arrival, the defendant was issued uniform traffic citationS 7448-fgw for no valid DRIVER'S LICENSE, 7499-fgw for unregistered VEHICLE and 74450-fgw for attached tag not assigned. all three citations have a mandatory court date of 101807 at 1300 hours. the defendant was also issued uniform traffic citation 7401-fgw for having an open container of alcohol with a $123.50 fine payable within 30 days. the defendant's bond was set at $900.00 per the bond schedule. *NOT-EXEMPT* |
