\tSUBMITTED By: TULLY, JAMES 1342 (AR15-16359) \tdid, knowing HIS driver's license or driving privilege had been cancelled, suspended or revoked, (KNOWINGLY 3rd offense and conviction) drive a motor vehicle upon the highways of this state while such license or privilege was cancelled, in violation of Florida Statute, 322.34(2)(C). ON 090915, AT APProximately 1315 HOURS, I WAS TURNING WEST ONTO EAST OVERDRIVE CIRCLE FROM north florida avenue. AT THAT TIME, I OBSERVED A WHITE MALE I AM FAMILIAR WITH, LATER IDENTIFIED AS THE DEFENDANT, MR JOSHUA JACQUARD, IN ACTUAL PHYSICAL CONTROL AND THE ONLY ONE ON A GRAY IN COLOR SCOOTER ON A PUBLIC ROADWAY. I OBSERVED THE SCOOTER TO BE ON A PUBLIC ROADWAY AT THE STOP SIGN WAITING TO TURN ONTO FLORIDA AVENUE. I AM FAMILIAR WITH THE DEFENDANT, DUE TO HAVING STOPPED HIM PREVIOUSLY. I HAVE TAKEN PREVIOUS REPORTS FOR THE DEFENDANT, AND KNOW HIS DRIVING PRIVILEGE IS CURRENTLY SUSPENDED. ONCE THE DEFENDANT OBSERVED MY PATROL VEHICLE STOP ON THE SIDE OF THE ROAD, HE PUSHED HIS SCOOTER TO THE SIDE OF THE ROADWAY AT THAT INTERSECTION. AT THAT TIME, I CONDUCTED A U-TURN IN ORDER TO MAKE CONTACT WITH THE DEFENDANT WHO WAS STILL SITTING ON THE SCOOTER. UPON MAKING CONTACT WITH THE DEFENDANT, I ASKED HIM IF HIS DRIVERâS LICENSE WAS STILL SUSPENDED, AT WHICH TIME HE STATED THAT IT WAS. I THEN ASKED THE DEFENDANT WHO THE SCOOTER BELONGS TO, AT WHICH TIME HE STATED HE PURCHASED IT ONE MONTH AGO TODAY. I OBSERVED THE SCOOTER HAD A FLORIDA TAG NUMBER OF, 6046NV. I REQUESTED THE DEFENDANTâS DRIVERâS LICENSE, REGISTRATION AND INSURANCE; HOWEVER, HE WAS ONLY ABLE TO PROVIDE ME WITH HIS FLORIDA IDENTIFICATION CARD AND WAS UNABLE TO PROVIDE ME with INSURANCE OR REGISTRATION INFORMATION. UPON RUNNING THE INFORMATION THROUGH THE ââDAVIDââ DATABASE, IT SHOWED THE DEFENDANTâS DRIVERâS LICENSE TO HAVE BEEN SUSPENDED AS OF 022315, AND TO CURRENTLY STILL BE SUSPENDED. THE ââDAVIDââ SYSTEM FURTHER REVEALED THAT THE DEFENDANT HAS PRIOR DRIVING CONVICTIONS FOR DRIVERâS LICENSE SUSPENSION/CANCELLATION OR REVOKED. UPON RUNNING THE TAG INFORMATION ON THE SCOOTER THROUGH THE ââDAVIDââ AND FCIC/NCIC SYSTEMS, IT REVEALED THAT THE LICENSE PLATE ON THE SCOOTER WAS INVALID and NOT REGISTERED TO ANYTHING AT THAT TIME. I AGAIN MADE CONTACT WITH THE DEFENDANT AND ADVISED HIM THAT I WOULD BE PLACING HIM UNDER ARREST FOR DRIVING WHILE LICENSE SUSPENDED (KNOWINGLY). I FURTHER ADVISED HIM THAT, DUE TO HIS PRIOR HISTORY OF TRAFFIC OFFENSES, THE CHARGE WOULD BE INCREASED TO A FELONY OFFENSE. THE DEFENDANT WAS THEN HANDCUFFED (DOUBLE LOCKED) BEHIND HIS BACK, SEARCHED AND SECURED IN THE REAR OF MY PATROL VEHICLE FOR TRANSPORT TO THE CITRUS COUNTY DETENTION FACILITY. AT THE DEFENDANTâS REQUEST, MR VITO TILLA RESPONDED TO THE SCENE WHERE HE LOADED THE SCOOTER INTO THE BED OF HIS TRUCK. UPON ARRIVAL AT THE DETENTION FACILITY, THE DEFENDANT WAS TURNED OVER TO DETENTION STAFF FOR BOOKING AND PROCESSING. THE DEFENDANTâS BOND WAS SET AT $5,000.00 PER THE BOND SCHEDULE FOR THE ABOVE LISTED CHARGE. THE DEFENDANT WAS ISSUED UNIFORM TRAFFIC CITATION, A1BTQLP, FOR DRIVING WHILE LICENSE SUSPENDED (THIRD OR MORE CONVICTION) WITH A MANDATORY COURT DATE TO BE DETERMINED. THE DEFENDANT WAS ALSO GIVEN A VERBAL WARNING FOR THE UNREGISTERED TAG ON THE SCOOTER. |
