| Probable cause affidavit: | SUBMITTED BY: HOLLOWAY, WILLIAM 0463 (AR12-3646) DID UNLAWFULLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: CANNABIS, COMMONLY REFERRED TO AS MARIJUANA, IN AN AMOUNT OVER 20 GRAMS, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(A). On 112912, I was contacted on my agency cellULAR TELEPHONE by the manager, MS JENNY DAVIS, of the Value Inn in Hernando. The manager advised me that she had smelled burnt cannabis coming from room NUMBER TWO. She stated that she confronted the defendant, MR JOSHUA RAYNOR, and advised him that she does not allow any illegal activity at the Inn. She stated that at that time, the defendant offered to pay her to keep the cannabis. She again stated THAT she does not allow it. She then advised THAT she observed the DEFENDANT take the cannabis and place it in a paint bucket in A STORAGE shed on the property. I then responded to the Value Inn. Once there, she then showed me the paint bucket. She sTATED THAT the defendant had no right to even enter the shed. I openED the FIVE gallon paint bucket she HAD pointed out, Inside was a large piece of plastic and rolled up inside the plastic was a smaller bag with a large amount of cannabis approximately 43 grams. I noticed it was actually triple wrapped with the first large plastic. Then a bread wrapper from Winn-Dixie and then the actual plastic holding the cannabis. I then secured the cannabis in my vehicle. I then made contact with the defendant. I identified myself and asked HIM about the Cannabis. He initially denied any knowledge of the cannabis. As I was SPEAKING WITH him the odor of cannabis emitted from him. Do to the defendantâS actions I advised the defendant that I was going to temporally detain him. AT THAT TIME, I placed him in handcuffs (DOUBLE LOCKED) HE WAS advised THAT I was still investigating and THAT at this time he was not under arrest. I then read him his Miranda warnings. The defendant then invoked his right to remain silent. The defendant then started to ask me questions. I reminded him that he invoked his right to remain silent. At that point, he stated he wanted to speak to me but he may want to invoke it again. I asked him about the Cannabis belonging to him, WHICH He stated THAT it was not HIS. I then asked him, If I had the bag AND it was fingerprinted would his fingerprints be on it. He did NOT answer me. I then stated to him that I believed they would. At that point, he looked down and shook his head yes. I then asked him why he smokes cannabis and he stated that he has a lot of mental problems and he also takes other medications for it. I stopped talking to the defendant and went to the witness and made sure that she actually observed the defendant placing the cannabis inside the bucket, which she stated she did. I then advised the defendant THAT he would be placed under arrest for the cannabis. The defendant asked if could get some money out of his room along with a touch pad. I advised him that he could but that may lead to other charges, since we would be entering the room. Once I got within a few feet of the room, I could smell a strong Odor of cannabis from the defendantâs room. Once we went inside the DEFENDANT âS ROOM HE directed me to a backpack that he wanted taken to âJAIL" with him. Inside the BACKpack was some of the defendants money along with some electronic devices. The money was placed inside the defendantâs front pants pocket in a black wallet. The defendant was THEN transported to the Citrus County CITRUS COUNTY DETENTION FACILITY and held on a $2,000.00 BOND, per THE BOND schedule . |
