Probable cause affidavit: SUBMITTED BY: WILLIAMS, JUSTIN 0730 (AR14-8879) DID UNLAWFULLY AND KNOWINGLY TAKE, OBTAIN OR USE OR ENDEAVOR TO TAKE, OBTAIN OR USE THE PROPERTY OF THE INVERNESS WALMART, TO WIT: THREE PAIR OF LEVI MEN’S JEANS AND TWO PAIR OF MEN’S SHORTS, CARRYING AWAY THE SAID MERCHANDISE, WITH INTENT TO TEMPORARILY OR PERMANENTLY DEPRIVE, A MERCHANT, OF THE POSSESSION, USE, BENEFIT, OR FULL RETAIL VALUE OF SAID PROPERTY, SAID PROPERTY BEING OF A VALUE OF LESS THAN $100.00, IN VIOLATION OF FLORIDA STATE STATUTE, 812.014(3)(A) RETAIL. ON 012814, AT APPROXIMATELY 1534 HOURS, I RESPONDED TO THE WALMART STORE LOCATED AT 2461 EAST GULF TO LAKE HIGHWAY IN INVERNESS, IN REFERENCE TO A SHOPLIFTER IN CUSTODY. UPON ARRIVAL, I MADE CONTACT WITH THE WALMART LOSS PREVENTION OFFICER/ WITNESS, MR JOSEPH COMPOSTELLA. HE ADVISED THAT HE OBSERVED A BLACK FEMALE, LATER IDENTIFIED AS THE DEFENDANT, MS JUDY FRANKLIN, DISPLAYING SUSPICIOUS BEHAVIOR IN THE MEN’S CLOTHING DEPARTMENT. THE WITNESS ADVISED THAT HE CONTINUED TO OBSERVE THE DEFENDANT, AT WHICH TIME HE OBSERVED THE DEFENDANT CONCEAL SEVERAL PIECES OF MEN’S CLOTHING INSIDE HER PURSE. THE WITNESS THEN OBSERVED THE DEFENDANT PROCEED TO AN EXIT OF THE STORE, AND PASS ALL POINTS OF SALE WITHOUT PAYING FOR THE ITEMS SHE HAD CONCEALED. THE WITNESS THEN IDENTIFIED HIMSELF TO THE DEFENDANT AND ESCORTED HER TO THE LOSS PREVENTION OFFICE WHERE HE CONTACTED THIS AGENCY. THE DEFENDANT STOLE CLOTHING ITEMS TO INCLUDE THREE PAIRS OF MEN’S LEVI JEANS AND TWO PAIRS OF MEN’S SHORTS, FOR A TOTAL VALUE OF $97.70. I MADE CONTACT WITH THE DEFENDANT AND READ HER MIRANDA RIGHTS FROM A PRE-PRINTED AGENCY CARD. THE DEFENDANT ADVISED THAT SHE UNDERSTOOD HER RIGHTS AND AGREED TO WAIVE THEM AND SPEAK WITH ME. SHE ADVISED THAT SHE CAME TO THE STORE WITH THE INTENTION OF STEALING THE ITEMS. SHE STATED SHE DID SO BY ENTERING THE GENERAL MERCHANDISE ENTRANCE AND PROCEEDING TO THE MEN’S CLOTHING DEPARTMENT. SHE STATED SHE THEN GRABBED THREE PAIRS OF MEN’S LEVI JEANS AND THREE PAIRS OF MEN’S SHORTS AND PLACED THEM INSIDE HER PURSE. THE DEFENDANT STATED SHE THEN ATTEMPTED TO CONCEAL THE ITEMS WITH A TEE SHIRT SHE HAD, AND EXITED THE STORE PASSING ALL POINTS OF SALE WITH NO ATTEMPT OR INTENTION TO PAY FOR THE ITEMS. PHOTOGRAPHS WERE TAKEN OF THE STOLEN MERCHANDISE. THE WITNESS PROVIDED ME WITH A COPY OF THE RECEIPT AND A SWORN WRITTEN STATEMENT. THE ITEMS WERE LATER SUBMITTED TO RECORDS. I ADVISED THE DEFENDANT THAT I WAS PLACING HER UNDER ARREST FOR RETAIL PETIT THEFT, WHERE SHE WAS HANDCUFFED (DOUBLE LOCKED), BEHIND HER BACK AND SECURED IN THE REAR OF MY PATROL VEHICLE. I TRANSPORTED THE DEFENDANT TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. UPON ARRIVAL AT THE DETENTION FACILITY, THE DEFENDANT WAS TURNED OVER TO DETENTION STAFF FOR PROCESSING, WHERE HER BOND WAS SET AT $250.00 PER THE BOND SCHEDULE.
