Probable cause affidavit: SUBMITTED BY: AGUILERA, EMANUEL 1238 (AR16-19259) (16-57491) DID UNLAWFULLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION WITH THE INTENT TO USE, OR DID UNLAWFULLY USE, AN OBJECT INTENDED OR DESIGNED FOR USE IN STORING, CONCEALING OR INJECTING, INGESTING, INHAULING OR OTHERWISE INTRODUCING INTO THE HUMAN BODY, A CONTROLLED SUBSTANCE, TO WIT: A CLEAR GLASS PIPE, IN VIOLATION OF FLORIDA STATE STATUTES 893.145 AND 893.147(1)(B). ON 4/28/16 AT APPROXIMATLY 1010 HOURS, I RESPONDED TO THE AREA OF NORTH SUNCOAST BLVD AND WEST RIVER RD, JUST NORTH OF COUNTY LINE, IN REFERENCE TO BAKING UP DEPUTY HRYC (0701) ON A TRAFFIC STOP. UPON ARRIVAL, I MADE CONTACT WITH K-9 DEPUTY HRYC, WHO ADVISED THIS DEPUTY THAT HE HAD STOPPED SAID VEHICLE FOR A STOP SIGN VIOLATION AS WELL AS AN EXPIRED TAG ON AN RV CAMPER HE WAS PULLING. K-9 DEPUTY HRYC ASKED THIS DEPUTY TO COMPLETE A WRITTEN WARNING FOR THE DEFENDANT FOR AN EXPIRED TAG. AS I WAS COMPLETING A WRITTEN WARNING, K-9 DEPUTY HRYC DEPLOYED HIS K-9 PARTNER FOR AN EXTERIOR SNIFF OF THE VEHICLE. K-9 DEPUTY HRYC THEN MADE CONTACT WITH THIS DEPUTY AN ADVISED THAT HIS K-9 PARTNER HAD ALERTED TO THE VEHICLE AND ASKED FOR MY ASSISTANCE IN STANDING WITH THE OCCUPANTS. AS I WAS STANDING WITH THE (5) OCCUPANTS OF THE VEHICLE, THE DEFENDANT, LATER IDENTIFIED AS JUSTIN BACK, HAD BEEN SITTING IN THE BACKSEAT OF THE VEHICLE. DEPUTY CRUZ (0517), WHO WAS ALSO ON SCENE, ADVISED THAT HE HAD LOCATED A CLEAR GLASS PIPE ON MR. BACK WHILE HE WAS CONDUCTING A PAT DOWN. I THEN READ THE DEFENDANT HIS MIRADA RIGHTS VIA PREPRINTED CARD, WHERE HE AGREED TO SPEAK WITH THIS DEPUTY. WHEN ASKED ABOUT THE PIPE, HE ADVISED THAT IT WAS HIS AND HE USES IT TO SMOKE METH. DEPUTY HRYC FIELD TESTED THE PIPE, WHICH TESTED POSITIVE FOR METHAMPHETAMINE. I ASKED HIM IF HE WOULD BE WILLING TO COME BACK TO CITRUS COUNTY WITH THIS DEPUTY AND HE ADVISED THAT HE WOULD. I PLACED HIM IN MY PATROL VEHICLE AND TRANSPORTED HIM BACK TO CITRUS COUNTY. WHILE LOCATED IN CITRUS COUNTY IN THE AREA OF N SUNCOAST BOULEVARD & W RIVER RD, I THEN ADVISED THE DEFENDANT THAT I WOULD BE PLACING HIM UNDER ARREST FOR POSSESSION OF DRUG PARAPHERNALIA WITH HIS BOND SET AT $1,000.00 PER THE BOND SCHEDULE. THE DEFENDANT WAS TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY AND TURNED OVER TO STAFF FOR BOOKING AND PROCESSING. DEPUTY HRYC TURNED THE PIPE TO EVIDENCE. THE DRIVER WAS ISSUED A WARNING. NO FURTHER ACTION BY THIS DEPUTY. DUE TO COMPUTER ISSUES UNABLE TO PULL CASE NUMBER AT THIS TIME.
