SUBMITTED BY: REEVES, CHRISTOPHER 0663 (AR10113712) UNLAWFULLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: valium a schedule iv drug, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(A) and UNLAWFULLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION WITH THE INTENT TO USE, OR DID UNLAWFULLY USE, AN OBJECT INTENDED OR DESIGNED FOR USE IN STORING, CONCEALING OR INJECTING, INGESTING, INHALING OR OTHERWISE INTRODUCING INTO THE HUMAN BODY, A CONTROLLED SUBSTANCE, TO WIT: VALIUM SAID OBJECT BEING A PILL CRUSHER WITH A RED CAP AND RESIDUE, IN VIOLATION OF FLORIDA STATE STATUTE 893.147(1) ON 030910 AT APPROXimately 2045 HOURS WHILE ON PATROL IN HOMOSASSA, I OBSERVED A BLUE CHEVROLET PICKUP TRUCK RUN THE STOP SIGN AT SOUTH SUFFOLK TERRACE AND WEST VILLAGE DRIVE. I PERFORMED A TRAFFIC STOP ON THE VEHICLE, AT WHICH TIME I APPROACHED THE PASSENGER SIDE WINDOW. THE PASSENGER ROLLED HIS WINDOW dOWN AND I DETECTED THE ODOR OF MARIJUANA TO BE EMANATING FROM THE INTERIOR OF THE VEHICLE. THE PASSENGER STATED HE HAD JUST "SMOKED A JOINT" APPROXIMaTELY ONE HOUR BEFORE my TRAFFIC STOP. AT THAT TIME, I ASKED THE PASSENGER AND THE DEFENDANT/DRIVER, MR JUSTIN LOPEZ, IF THERE WAS ANYTHING IN the VEHICLE, TO WHICH BOTH REPLIED NO, THERE WAS NOT. A search of the vehicle was performed and i found a white pill crusher with a red cap, in the glove box, with a white residue on it. a search of the defendant's person was then performed, at which time i discovered a small plastic bag containing four white pills which were later identified THROUGH POISON CONTROL aS BEING valium, A SCHEDULE FOUR NARCOTIC. I READ THE DEFENDANT HIS MIRANDA WARNINGS VIA MY PRE-PRINTED AGENCY CARD. I ASKED THE DEFENDANT IF HE UNDERSTOOD HIS RIGHTS, TO WHICH HE STATED HE DID. I ASKED THE DEFENdANT IF HE WISHED TO SPEAK WITH ME, TO WHICH HE STATED HE DID. THE DEFENDANT ADVISED THAT THE PILLS WERE HIS AND THAT HE HAD GOTTEN THEM FROM A FRIEND APPROXIMaTELY ONE HOUR BEFORE MY TRAffIC STOP. the defendant also said tHAT HIS FINGERPRINTS WOULD BE ON THE PILL CRUSHER. THE DEFENDANT WAS PLACED under arrest, handcuffed (double locked) behind his back, secured in the rear seat of my patrol vehicle and transported to the citrus county detention facility without INCIDENT. upon arrival, the defendant's bond was set at a total of $2,500.00, in accordance with the bond schedule. THE DEFENDANT WAS ISSUED A uniform traffic citation, citation number 0938-ESH6, FOR VIOLATION OF TRAFFIC CONTROL DEVICE, RUNNING A STOP SIGN, WITH A FINE OF $166.00 PAYABLE IN THIRTY DAYS AT THE CITRUS COUNTY COURTHOUSE. ALL CONTRABAND WAS PAckaged and later turned in to evidence. *NOT-EXEMPT* |
