SUBMITTED BY: KNIGHT, CHRISTOPHER 1302 (AR15-16424) DID, KNOWING her DRIVERâS LICENSE OR DRIVING PRIVILEGE HAD BEEN CANCELLED, SUSPENDED OR REVOKED, DRIVE A MOTOR VEHICLE UPON THE HIGHWAYS OF THIS STATE WHILE SUCH LICENSE OR PRIVILEGE WAS CANCELLED, IN VIOLATION OF FLORIDA STATE STATUTE 322.34(2). ON 091415, AT APPROXIMATELY 1700 HOURS, I WAS DISPATCHED TO SOUTH OLD FLORAL CITY ROAD AND EAST ORANGE AVENUE IN FLORAL CITY, IN REFERENCE TO BACKING UP DEPUTY FISHER, WHO HAD CONDUCTED A TRAFFIC STOP. UPON ARRIVAL I MADE CONTACT WITH DEPUTY FISHER, WHO informed ME THAT HE CONDUCTED A TRAFFIC STOP ON A WHITE SUBURBAN BEARING FLORIDA LICENSE PLATE NUMBER 620RND, IN REFERENCE TO THE VEHICLEâS LICENSE PLATE BEING EXPIRED AND HAVING A NON-FUNCTIONAL PASSENGER SIDE BRAKE LIGHT. DEPUTY FISHER CONTINUED TO INFORM ME that HE MADE CONTACT WITH THE WHITE FEMALE DRIVER, WHO WAS LATER IDENTIFIED AS THE DEFENDANT, MS KAITLYN KANE, AND REQUESTED TO SEE HER DRIVER'S LICENSE, REGISTRATION AND PROOF OF INSURANCE. DEPUTY FISHER TOLD ME that THE DEFENDANT STATED ââI DO NOT HAVE A DRIVER'S LICENSE because IT IS SUSPENDEDââ. DEPUTY FISHER informed ME that HE TOOK THE DEFENDANTâS INFORMATION DOWN AND RAN HER VIA ââDAVIDââ (DRIVER AND VEHICLE DATABASE), WHICH INDICATED THAT THE DEFENDANTâS DRIVER'S LICENSE HAS BEEN SUSPENDED ON 072115, AND WAS STILL CURRENTLY SUSPENDED. AT THAT TIME, I TOOK CONTROL OF THE TRAFFIC STOP. I MADE CONTACT WITH THE DEFENDANT AND ASKED HER ONCE AGAIN IF SHE KNEW THAT HER DRIVER'S LICENSE WAS SUSPENDED. THE DEFENDANT informed ME THAT SHE KNEW HER DRIVER'S LICENSE HAD BEEN SUSPENDED FOR A FEW MONTHS AND SHE WAS ONLY DRIVING TO HER COUSINâS RESIDENCE. I informed THE DEFENDANT THAT SHE WAS UNDER ARREST FOR DRIVING WHILE LICENSE SUSPENDED WITH KNOWLEDGE. THE DEFENDANT WAS HANDCUFFED (DOUBLE LOCKED)BEHIND HER BACK, SEARCHED AND SECURED IN THE REAR OF MY PATROL VEHICLE, WHERE SHE WAS READ MIRANDA BY THIS DEPUTY. AT THE DEFENDANTâS REQUEST, HER HUSBAND, MR JOHN SULLIVAN, WHO WAS SITTING IN THE RIGHT FRONT PASSENGER SEAT OF THE VEHICLE, WAS LEFT WITH THE DEFENDANTâS VEHICLE FOR HER COUSIN TO COME PICK UP. MR SULLIVAN WAS informed NOT TO DRIVE THE VEHICLE AT ANYTIME because HIS DRIVER'S LICENSE WAS ALSO SUSPENDED. UPON ARRIVAL AT THE CITRUS COUNTY DETENTION FACILITY, THE DEFENDANT WAS TURNED OVER TO THE DETENTION STAFF FOR BOOKING AND PROCESSING. THE DEFENDANT WAS CHARGED WITH DRIVING WHILE LICENSE SUSPENDED KNOWINGLY, WITH A BOND SET AT $500.00, PER THE BOND SCHEDULE. THE DEFENDANT WAS ISSUED WRITTEN WARNING NUMBER 400146B, FOR having AN EXPIRED LICENSE PLATE. SHE WAS ALSO GIVEN A VERBAL WARNING FOR HAVING A FAULTY PASSENGER SIDE BRAKE LIGHT. |
