SUBMITTED BY: LAKATIS, KENNETH 0585 (AR10114075) did knowingly, willfully and feloniously be in the actual or constructive possession of a controlled substance, to-wit: METH, METHADONE, ROXIES, AND HYDROCODONE, in violation of Florida Statutes 893.13(6)(B) DID UNLAWFULLY HAVE IN HER ACTUAL OR CONSTRUCTIVE POSSESSION WITH THE INTENT TO USE, OR DID UNLAWFULLY USE, AN OBJECT INTENDED OR DESIGNED FOR USE IN STORING, CONCEALING OR INJECTING, INGESTING, INHALING OR OTHERWISE INTRODUCING INTO THE HUMAN BODY, A CONTROLLED SUBSTANCE, TO WIT: A GLASS PIPE USED TO SMOKE METH, IN VIOLATION OF FLORIDA STATE STATUTES 893.145 AND 893.147(1)(B) ON 033110, AT APPROXIMATELY 0030 HOURS, DEPUTY BERGEN AND I WERE TRAVELING WEST ON ROSEDALE WHEN WE OBSERVED A VEHICLE PARKED AT THE INTERSECTION OF ROSEDALE AND GRANT STREET. AS WE PASSED BY THE VEHICLE WE OBSERVED A WHITE FEMALE WALKING AROUND the VEHICLE. WE THEN TURNED AROUND AND PERFORMED A TRAFFIC STOP ON SAID VEHICLE AS IT APPEARED THE VEHICLE WAS PARKED WITHIN THE INTERSECTION AND/OR THE FEMALE NEEDED SOME TYPE OF ASSISTANCE. UPON MAKING CONTACT, WE INTRODUCED OURSELVES AS DEPUTY SHERIFFS AND ASKED IF SHE NEEDED ASSISTANCE. THE DEFENDANT LATER IDENTIFIED AS, MS KAREN FUGATE, ADVISED THAT SHE WAS HAVING VEHICLE TROUBLE EVEN THOUGH the VEHICLE WAS RUNNING. AS I BEGAN TO CONVERSE WITH her, I NOTICED THAT HER MOVEMENT WAS VERY ANIMATED AND SHE WAS FIDGETING AS IF SHE WAS UNDER THE INFLUENCE OF METHAMPHETAMINES. WE THEN ASKED IF SHE HAD ANY IDENTIFICATION AND/OR INFORMATION ABOUT THE VEHICLE. the DEFENDANT STATED THAT THE VEHICLE BELONGED TO A FRIEND OF HERS THAT WE ARE FAMILIAR WITH, AND THAT THAT FRIEND HAD BEEN INCARCERATED FOR POSSESSION OF METHAMPHETAMINE. DUE TO the DEFENDANT'S BEHAVIOR AND the BELIEF THAT SHE WAS UNDER THE INFLUENCE OF METHAMPHETAMINES OR OTHER ILLEGAL NARCOTICS, DEPUTY BERGEN ASKED FOR A CANINE DEPUTY TO RESPOND TO OUR LOCATION. DEPUTY DAVIS THEN ARRIVED AND DEPLOYED HIS CANINE AROUND the VEHICLE. HE DID ADVISE that THE CANINE DID MAKE A POSITIVE ALERT FOR THE PRESENCE OF NARCOTICS. I BEGAN A SEARCH OF THE VEHICLE, AND IN the FRONT SEAT IN the DEFENDANT'S PURSE I LOCATED A PINK PLASTIC CYLINDER CONTAINING ONE AND A HALF ROXIES AS WELL AS A GRAM AND A HALF OF CRYSTAL METH, AND A PLASTIC BAG CONTAINING TWO AND A HALF PILLS WHICH WERE LATER IDENTIFIED AS METHADONE. THE DEFENDANT DID NOT HAVE A PRESCRIPTION FOR THE ROXIES OR THE METHADONE. I ALSO LOCATED IN the PURSE A CONTAINER OF LORATABS PRESCRIBED TO A GARY STEIN, AND A GLASS PIPE USED TO SMOKE METHAMPHETAMINE ON the PASSENGER FLOORBOARD. AT THAT TIME THE DEFENDANT WAS PLACED UNDER ARREST FOR POSSESSION OF NARCOTICS. SHE WAS HANDCUFFED (DOUBLE-LOCKED) BEHIND HER BACK AND SECURED IN THE REAR SEAT OF DEPUTY RICCI'S PATROL VEHICLE. ALL OF THE CONTRABAND WAS PACKAGED AND TURNED IN TO EVIDENCE. the VEHICLE THAT THE DEFENDANT WAS DRIVING WAS TOWED BY ADAM'S TOWING. THE DEFENDANT WAS THEN TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY BY DEPUTY RICCI FOR BOOKING and PROCESSING. DEPUTY BERGEN ADVISED ME THAT HE READ THE DEFENDANT MIRANDA VIA CARD and SHE DID ADVISE THAT SHE WAS AN ADDICT. THE DEFENDANT'S TOTAL BOND WAS SET AT $20,500.00, PER THE BOND SCHEDULE. *NOT-EXEMPT* |
