Probable cause affidavit: SUBMITTED BY: RUBY, SAMUEL 0562 (AR11118733) DID UNLAWFULLY HAVE IN HER ACTUAL OR CONSTRUCTIVE POSSESSION WITH THE INTENT TO USE, OR DID UNLAWFULLY USE, AN OBJECT INTENDED OR DESIGNED FOR USE IN STORING, CONCEALING OR INJECTING, INGESTING, INHALING OR OTHERWISE INTRODUCING INTO THE HUMAN BODY, A CONTROLLED SUBSTANCE, TO WIT: SMALL GLASS TUBE WITH BRILL-O INSIDE USED TO SMOKE CRACK COCAINE, IN VIOLATION OF FLORIDA STATE STATUTES 893.145 AND 893.147(1)(B) ON 010811, I RESPONDED TO THE AREA OF HIGHWAY 19 AND WEST VENABLE STREET IN CRYSTAL RIVER, IN REFERENCE TO A DISTURBANCE. UPON ARRIVAL, I OBSERVED A GREEN FORD PICKUP PARKED ON THE WEST SIDE OF HIGHWAY 19 JUST SOUTH OF WEST VENABLE. THERE WAS A WHITE FEMALE STANDING OUTSIDE THE VEHICLE and NO OTHER OCCUPANTS. I MADE CONTACT WITH THE DEFENDANT, MS KAREN NUNNERY. SHE ADVISED that A FRIEND BY the NAME OF JOE WAS DRIVING HER TO KISSIMMEE FROM TALLAHASSEE AND THAT THEY BEGAN TO ARGUE WHEN THE DRIVER, JOE, BECAME IRATE AND STOPPED THE VEHICLE AT THAT LOCATION. JOE GOT OUT AND WALKED THROUGH THE PARKING LOT OF the HOME DEPOT. I ASKED THE DEFENDANT what THEY WERE ARGUING ABOUT AND she ADVISED SHE DID NOT KNOW. I ASKED THE DEFENDANT IF THERE WAS ANYTHING INSIDE the VEHICLE I SHOULD BE AWARE OF AND SHE ADVISED NO. I ASKED THE DEFENDANT IF I COULD CHECK THE VEHICLE FOR ANY WEAPONS OR DRUGS AND SHE ADVISED THAT IT WAS NOT HER VEHICLE AND SHE COULD NOT GIVE ME PERMISSION TO SEARCH IT. I ASKED THE DEFENDANT IF SHE HAD ANYTHING ON HER PERSON AND she ADVISED NO. I OBSERVED SCARS ON BOTH ARMS OF THE DEFENDANT. I ASKED the DEFENDANT WHAT IT WAS FROM and she ADVISED FROM SHOOTING COCAINE APPROXIMATELY 20 YEARS AGO. LT VITT HAD MADE CONTACT WITH THE DRIVER OF THE VEHICLE IN FRONT OF the HOME DEPOT STORE AND BROUGHT HIM BACK TO MY LOCATION OF THE TRUCK. THE DRIVER WAS ADVISED HE WAS NOT TAKING THE DEFENDANT ANY FURTHER. I ASKED THE DRIVER IF THERE WAS ANYTHING IN the VEHICLE AND HE ADVISED NO. I ASKED THE DRIVER IF I COULD SEARCH THE VEHICLE FOR DRUGS OR WEAPONS, AT WHICH TIME, HE GAVE ME HIS CONSENT TO SEARCH. UPON SEARCHING THE CAB OF VEHICLE I LOCATED A COCA COLA BOTTLE WHICH CONTAINED BEER which BELONGED TO THE DEFENDANT. THE CONTENTS WAS POURED OUT IN the MEDIAN AT THE REQUEST OF the DEFENDANT. THE DEFENDANT ADVISED THAT IF WE WOULD TRANSPORT HER TO A NEARBY HOTEL THAT HER UNCLE FROM KISSIMMEE WOULD PAY FOR HER TO STAY THERE. JOE LEFT THE SCENE IN the VEHICLE RETURNING TO HIS RESIDENCE. I ADVISED THE DEFENDANT THAT I WOULD TRANSPORT HER TO A HOTEL. BEFORE BEING PLACED IN THE REAR OF MY PATROL VEHICLE DEPUTY SARAH LOVULLO (0723) PATTED DOWN the DEFENDANT. SHE ASKED THE DEFENDANT TO REMOVE HER SHOES. AT THAT TIME, SHE LOCATED A SMALL GLASS TUBE WHICH CONTAINED BRILL-O. THE TUBE ALSO HAD RESIDUE AND HAD BEEN USED TO SMOKE CRACK COCAINE. THE DEFENDANT ADVISED THAT, THAT WAS NOT HERS AND THAT she HAD GOTTEN THOSE SHOES FROM the BACK OF JOE'S TRUCK AND PUT THEM ON. I ASKED THE DEFENDANT IF SHE DID NOT FEEL THE GLASS TUBE INSIDE THE SHOE WHEN SHE PUT IT ON AND SHE ADVISED NO, SHE HAS NOT USED DRUGS IN A LONG TIME. THE DEFENDANT WAS ADVISED THAT SHE WAS BEING PLACED UNDER ARREST FOR POSSESSION OF DRUG PARAPHERNALIA. SHE WAS HANDCUFFED (DOUBLE-LOCKED) BEHIND the BACK AND PLACED IN THE REAR OF MY PATROL VEHICLE WITH HER BELONGINGS AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY. THE DEFENDANT DID HAVE IN HER POSSESSION ONE PURSE and A BLUE CLOTH SUITCASE CONTAINING HER CLOTHES, WHICH WAS TURNED IN AT THE JAIL. THE GLASS PIPE will BE TURNED INTO EVIDENCE and A PROPERTY RECEIPT WILL BE COMPLETED. THE DEFENDANT'S BOND WAS SET AT $500.00, PER THE BOND SCHEDULE.
