Probable cause affidavit: SUBMITTED BY: FULLER, DAVID 0267 (AR09112049) did unlawfully and knowingly obtain, use or endeavor to obtain or use the property of bEALLS DEPARTMENT STORE, to-wit: JUNIORS CLOTHING, of the value of three hundred dollars ($300.00) or more, but less than twenty thousand dollars ($20,000.00), with the intent to either temporarily or permanently deprive BEALLS of a right to the property or a benefit thereof, or did appropriate the said property to HER own use or the use of any person not entitled thereto, in violation of Florida Statutes 812.015(8); ON 112309, I ARRIVED AT BEALLS DEPARTMENT STORE LOCATED AT 2851 EAST GULF TO LAKE HIGHWAY IN INVERNESS, IN REFERENCE TO A RETAIL THEFT. UPON ARRIVAL, I MADE CONTACT WITH THE LOSS PREVENTION OFFICER WHO ADVISED THAT HE HAD THE DEFENDANT IN CUSTODY. HE STATED THAT HE OBSERVED THE DEFENDANT ENTER THE JUNIOR'S DEPARTMENT AND SELECT APPROXIMATELY 15 ITEMS OF JUNIOR'S CLOTHING. HE STATED HE THEN WATCHED the DEFENDANT GO TO THE JUNIOR'S FITTING ROOM WHERE SHE CONCEALED THE MERCHANDISE IN HE PURSE AND her SON'S STROLLER. she THEN WENT TO THE CHILDREN'S DEPARTMENT AND SELECTED more ITEMS, and THEN WENT TO THE MEN'S DEPARTMENT REGISTER AND PAID FOR some OF THE CHILDREN'S ITEMS. ONCE SHE PASSED THE LAST POINT OF SALE and WAS EXITING THE STORE WITH THE UNPAID ITEMS, HE MADE CONTACT WITH THE DEFENDANT. HE THEN ESCORTED THE DEFENDANT AND her SON INTO THE LOSS PREVENTION ROOM, WHERE HE THEN CALLED THE SHERIFF'S OFFICE. I MADE CONTACT WITH THE DEFENDANT AND SHE WAS READ her MIRANDA RIGHTS VIA CARD. I THEN ASKED IF SHE WOULD LIKE TO SPEAK WITH ME, AND SHE STATED, YES. I ASKED HER IF WHAT THE LOSS PREVENTION OFFICER STATED WAS TRUE, and SHE STATED YES. THE DEFENDANT WAS PLACED UNDER ARREST FOR FELONY RETAIL THEFT. ALL OF THE ITEMS WERE PHOTOGRAPHED AND RETURNED TO THE STORE BY the LOSS PREVENTION OFFICER. A COPY OF THE VIDEO SURVEILLANCE WILL BE TURNED IN TO EVIDENCE, ALONG WITH A COPY OF THE RECEIPT LISTING ALL OF THE ITEMS. THERE WERE A TOTAL OF 12 TOPS AND FOUR BOTTOMS FROM the JUNIOR'S DEPARTMENT THAT WERE TAKEN TOTALING APPROXIMATELY $389.00. the DEFENDANT WAS HANDCUFFED (DOUBLE-LOCKED) AND SECURED IN the REAR SEAT OF MY PATROL VEHICLE. SHE WAS THEN TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. THE DEFENDANT'S CHILD WAS TURNED OVER TO HER HUSBAND ON SCENE. THE DEFENDANT'S BOND WAS SET AT $2,000.00, PER THE BOND SCHEDULE. *NOT-EXEMPT*
