Probable cause affidavit: SUBMITTED BY: BYRD, JEDIDIAH 0737 (AR14-8959) UNLAWFULLY ENDANGER THE SAFETY OF ANOTHER OR THEIR PROPERTY WHILE INTOXICATED OR DID WHILE INTOXICATED OR DRINKING AN ALCOHOLIC BEVERAGE IN A PUBLIC PLACE CAUSE A PUBLIC DISTURBANCE, IN VIOLATION OF FLORIDA STATE STATUTE NUMBER 856.011; DID UNLAWFULLY RESIST, OBSTRUCT OR OPPOSE DEPUTY BYRD (0737), WHO WAS THEN AND THERE IN THE LAWFUL EXECUTION OF A LEGAL DUTY, OR EXECUTION OF LEGAL PROCESS, TO WIT: THE DEFENDANT REFUSED TO PLACE HER HANDS BEHIND HER BACK TO BE HANDCUFFED, AND JERKED HER HEAD BACK SEVERAL TIMES, ATTEMPTING TO STRIKE THIS DEPUTY IN THE FACE, UNSUCCESSFULLY, WITHOUT OFFERING OR DOING VIOLENCE TO THE PERSON OF SUCH OFFICER, IN VIOLATION OF FLORIDA STATE STATUTE 843.02. ON 020414 I WAS DISPATCHED TO 8916 NORTH TRAVIS DRIVE, DUNNELLON, IN REFERENCE TO AN ASSIST FOR DUNNELLON POLICE DEPARTMENT. DUNNELLON POLICE DEPARTMENT ADVISED THAT A HIT AND RUN HAD OCCURRED, AND THE SUSPECT FROM THE CRASH WAS NOW AT THIS LOCATION, CAUSING A VERBAL DISTURBANCE. UPON ARRIVAL I MADE CONTACT WITH THE DEFENDANT, MS KARRISSA MARIE MERCADO, AND HER FRIEND, JESSICA. THE TWO FEMALES WERE ARGUING IN THE STREET APPROXIMATELY FOUR HOUSES SOUTH OF THE INCIDENT LOCATION. DEPUTY FELIX AND I APPROACHED THEM AND QUESTIONED THEM IN REFERENCE TO A HIT AND RUN THAT THEY HAD BEEN INVOLVED IN WHILE IN MARION COUNTY. INITIALLY, BOTH SUBJECTS WERE RELUCTANT TO TELL US ANY INFORMATION REGARDING THE INCIDENT. HOWEVER, UPON SPEAKING WITH JESSICA, SHE ADVISED THAT THE DEFENDANT HAD BEEN DRIVING AND HIT ANOTHER VEHICLE. JESSICA ADVISED THAT THE DEFENDANT HAD THEN DRIVEN AWAY. WHILE WE WERE SPEAKING WITH JESSICA, THE DEFENDANT THEN WALKED UP A NEIGHBOR’S RESIDENCE AND GOT IN TO A VEHICLE IN THE DRIVEWAY. DEPUTY FELIX THEN RAN UP AND CAUGHT THE DRIVER’S SIDE DOOR BEFORE THE DEFENDANT COULD CLOSE IT. WE ADVISED THE DEFENDANT TO EXIT THE VEHICLE AS IT DID NOT BELONG TO HER, AND THAT WE NEEDED TO SPEAK WITH HER FURTHER ABOUT THE INCIDENT. THE DEFENDANT WAS CLEARLY INTOXICATED AND VERY UNCOOPERATIVE. HER FRIEND EVENTUALLY PERSUADED FROM THE VEHICLE, AND WALKED HER TO MY PATROL VEHICLE. I MADE CONTACT WITH THE OWNER OF THE VEHICLE THE DEFENDANT HAD ENTERED, WHO ADVISED THAT THE DEFENDANT DID NOT HAVE PERMISSION TO BE IN HER VEHICLE BECAUSE SHE HAD NEVER MET HER BEFORE. THE DEFENDANT BECAME EVEN MORE UNCOOPERATIVE AND CONTINUED TO WALK AWAY FROM DEPUTY FELIX AND I AS WE WERE TRYING TO QUESTION HER. I ATTEMPTED TO PLACE THE DEFENDANT IN HANDCUFFS TO DETAIN HER FOR QUESTIONING, AT WHICH POINT SHE PULLED HER ARMS AWAY FROM ME. I WAS ABLE TO PLACE ONE OF THE DEFENDANT’S ARMS BEHIND HER BACK, HOWEVER SHE THEN BEGAN JERKING HER HEAD BACKWARDS TOWARDS MY HEAD THREE OR FOUR DIFFERENT TIMES AS SHE WAS TRYING TO STRIKE THIS DEPUTY IN THE FACE, UNSUCCESSFULLY. I WAS EVENTUALLY ABLE TO SECURE THE DEFENDANT’S SECOND ARM BEHIND HER BACK, AND SECURED HER IN HANDCUFFS, DOUBLE LOCKING HER BEHIND THE BACK. THE DEFENDANT THEN FELL TO THE GROUND. I THEN PULLED THE DEFENDANT TO HER FEET, AND SECURED HER IN THE REAR OF MY PATROL VEHICLE. THE DEFENDANT BEGAN KICKING HER FEET AND WOULD NOT ALLOW ME TO SHUT THE DOOR TO MY PATROL VEHICLE. SHE FINALLY COMPLIED AND PUT HER FEET INSIDE OF THE VEHICLE. THROUGHOUT OUR ENCOUNTER, THE DEFENDANT CONTINUED TO BE UNCOOPERATIVE AND DISORDERLY, SLAMMING HER HANDCUFFS AGAINST THE SEAT AND KICKING THE BACK OF THE CAGE IN THE REAR OF MY PATROL VEHICLE. DUNNELLON POLICE DEPARTMENT THEN RESPONDED TO OUR LOCATION, AND QUESTIONED THE DEFENDANT ABOUT THE HIT AND RUN ACCIDENT WHICH HAD OCCURRED IN MARION COUNTY. AFTER DUNNELLON POLICE HAD COMPLETED THEIR INVESTIGATION, I ADVISED THE DEFENDANT THAT SHE WAS BEING PLACED UNDER ARREST FOR DISORDERLY INTOXICATION AND FOR RESISTING AN OFFICER WITHOUT VIOLENCE. SHE WAS THEN TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY, AND RELEASED TO DETENTION FACILITY STAFF UPON ARRIVAL. THE DEFENDANT WAS CHARGED WITH ONE COUNT OF DISORDERLY INTOXICATION AND ONE COUNT OF RESISTING AN OFFICER WITHOUT VIOLENCE, WITH HER BOND AT $650.00, PER THE BOND SCHEDULE.
