Probable cause affidavit: SUBMITTED BY: RICCI, ANTHONY 0606 (AR11121008) UNLAWFULLY ENDANGER THE SAFETY OF ANOTHER OR THEIR PROPERTY WHILE INTOXICATED OR DID WHILE INTOXICATED OR DRINKING AN ALCOHOLIC BEVERAGE IN A PUBLIC PLACE CAUSE A PUBLIC DISTURBANCE, IN VIOLATION OF FLORIDA STATE STATUTE NUMBER 856.011. did commit certain acts which are of such a nature as to corrupt the public morals or outrage the sense of public decency or affect the peace and quiet of a person who may witness them, or did engage in brawling or fighting, or in such conduct as to constitute a breach of the peace or disorderly conduct, in that THE DEFENDANT did CAUSE A DISTURBANCE IN A COMMON AREA AND ALSO THROWING BEER BOTTLES AND ENGAGE IN FIGHTING WITH PATRONS IN A HOTEL WHICH RESULTED IN WAKING UP NUMEROUS GUESTS, in violation of Florida Statute 877.03; ON 052911 AT 0125 HOURS, I ARRIVED ON SCENE AT 4076 SOUTH SUNCOAST BOULEVARD, THE BELLA OASIS MOTEL, IN REFERENCE TO A DISTURBANCE. UPON ARRIVAL, I MADE CONTACT WITH THE COMPLAINANT, THE MOTEL MANAGER OF THE BELLA OASIS, WHO ADVISED THAT HE WAS NOTIFIED BY NUMEROUS GUESTS THAT THE GUEST IN ROOM 113 WAS DRUNK, FIGHTING AND CAUSING A DISTURBANCE. THE MANAGER ALSO ADVISED THAT HE HAD RECEIVED WORD THAT THE INDIVIDUAL IN ROOM 113 LATER IDENTIFIED AS THE DEFENDANT WAS CURRENTLY CHOKING A FEMALE. THE MANAGER THEN ESCORTED ME TO ROOM 113, WHERE I MADE CONTACT WITH THE DEFENDANT WHO WAS SEATED ON HER BED. THE DEFENDANT WAS CRYING UNCONTROLLABLY AND APPEARED VERY INTOXICATED. AT THE ENTRY OF THE DEFENDANT'S ROOM WAS BROKEN GLASS FROM A BEER BOTTLE, WHICH THE MANGER ADVISED HAD BEEN THROWN BY THE DEFENDANT AFTER HE HAD INSTRUCTED HER TO LEAVE THE MOTEL. AT THIS TIME, MULTIPLE UNITS ARRIVED ON SCENE, WHILE I CONDUCTED INTERVIEWS WITH OTHER PARTIES. I WAS THEN DIRECTED TO ROOM 109 AND MADE CONTACT WITH VICTIM CROFT, WHO ADVISED THAT HE WAS ASLEEP IN HIS ROOM WHEN HE OVERHEARD YELLING, SCREAMING AND FIGHTING COMING FROM THE AREA OF ROOM 113. UPON HEARING THIS, HE NOTIFIED MOTEL MANAGEMENT AND HAD EXITED HIS MOTEL ROOM. UPON EXITING, HE HAD WITNESSED THE DEFENDANT FIGHTING AND CHOKING A WHITE FEMALE FROM ROOM 115. UPON CONFRONTING THE DEFENDANT, HE WAS APPROACHED BY THE DEFENDANT'S HUSBAND, MR WOOD, WHO BEGAN ACTING AS IF HE WANTED TO FIGHT HIM. I WAS THEN LED TO ROOM 115 AND MADE CONTACT WITH VICTIM SMILEY, WHO ADVISED THAT SHE HAD BEEN IN HER ROOM AND OVERHEARD YELLING, SCREAMING AND THE BREAKING OF GLASS. MS SMILEY CONTACTED HOTEL MANAGEMENT AND HAD EXITED HER ROOM, WHERE SHE HAD MADE CONTACT WITH THE DEFENDANT IN THE COMMON AREA OF THE MOTEL. UPON APPROACHING THE DEFENDANT AND INSTRUCTING HER TO STOP CAUSING A DISTURBANCE, THE DEFENDANT PUSHED HER INTO A PLANTER WHICH I OBSERVED TO HAVE BEEN KNOCKED OVER. MS SMILEY ADVISED THAT WHEN SHE GOT UP, THE DEFENDANT BEGAN CHOKING HER. MS SMILEY ADVISED SHE BROKE FREE AND PROCEEDED TO HER ROOM TO CONTACT HOTEL MANAGEMENT AGAIN. I THEN MADE CONTACT WITH THE MOTEL MANAGER, WHO ADVISED THAT EARLIER IN THE EVENING HE HAD PROBLEMS WITH THE DEFENDANT IN THE COMMON AREA OF THE MOTEL. THE MANAGER ADVISED THAT HE HAD INSTRUCTED HER TO CALM DOWN THREE TIMES AND ON THE THIRD TIME HAD REQUESTED HER TO LEAVE THE MOTEL. AT THAT POINT, THE DEFENDANT REFUSED TO LEAVE AND THREW A BEER BOTTLE ON THE GROUND AND SLAMMED THE DOOR IN HIS FACE. I THEN MADE CONTACT WITH THE DEFENDANT AND ASKED HER ACCOUNT OF THIS INCIDENT. THE DEFENDANT WAS UNABLE TO PROVIDE A COHERENT ANSWER AS SHE WAS HEAVILY INTOXICATED AND CRYING UNCONTROLLABLY. THE DEFENDANT WAS ADVISED THAT SHE WAS BEING PLACED UNDER ARREST FOR DISORDERLY INTOXICATION AND BREACH OF PEACE. THE DEFENDANT WAS HANDCUFFED (DOUBLE LOCKED) AND SECURED IN THE REAR SEAT OF MY PATROL VEHICLE AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY (CCDF) FOR BOOKING AND PROCESSING. MS SMILEY STATED THAT SHE DID NOT WISH TO PURSUE CHARGES OF BATTERY AND WAS PROVIDED WITH A WAIVER OF PROSECUTION, WHICH SHE SIGNED. THE DEFENDANT'S BOND WAS SET AT $350.00 PEER THE BOND SCHEDULE.
