SUBMITTED BY: BRUNK, KEVIN 0344 (AR13-4204) DID UNLAWFULLY AND INTENTIONALLY THREATEN BY WORD OR ACT TO DO VIOLENCE TO THE PERSON OF THE VICTIM, COUPLED WITH AN APPARENT ABILITY TO CARRY OUT SAID THREAT, AND UTILIZED A DEADLY WEAPON, TO WIT: THE DEFENDANT, MS KAYLA RENEE PEARSON, RETRIEVED A BASEBALL BAT FROM INSIDE HER VEHICLE AND WHILE ENGAGED IN AN ARGUMENT WITH THE VICTIM LIFTED THE BASEBALL BAT UP IN A MANNER CAUSING THE VICTIM TO BELIEVE THAT THE DEFENDANT WAS GOING TO STRIKE HIM WITH THE BAT AND PUT HIM IN FEAR OF HIS LIFE, WITHOUT THE INTENT TO KILL, AND DID AN ACT OR ACTS WHICH CREATED A WELL-FOUNDED FEAR IN THE VICTIM THAT SUCH VIOLENCE WAS IMMINENT, IN VIOLATION OF FLORIDA STATE STATUTE 784.021(1)(A). ON 012113, I WAS DISPATCHED TO 4983 WEST COUNTRY COURT IN HOMOSASSA IN REFERENCE TO AN AGGRAVATED ASSAULT WITH A DEADLY WEAPON. UPON ARRIVAL, I SPOKE TO THE WITNESS, MS KAYCI WALLACE, WHO STATED THAT ON 012113 AT APPROXIMATELY 2215 HOURS, SHE DROPPED HER BOYFRIEND/VICTIM, MR ROBERT ENGELS III, OFF AT HIS RESIDENCE LOCATED AT 4983 WEST COUNTRY COURT. THE WITNESS STATED THAT WHEN SHE DROVE OUT OF WEST COUNTRY COURT IN HER VEHICLE A PICKUP VEHICLE ALMOST HIT HER VEHICLE. THE WITNESS STATED THAT SHE WAS TRAVELLING NORTHBOUND ON SOUTH OLDFIELD AVENUE WHILE THE DEFENDANT CONTINUED TRAVELLING SOUTHBOUND. THE WITNESS STATED THE PICKUP THEN DID A U-TURN AND TURNED ITS HIGH BEAMS ON AND SPED UP BEHIND THE WITNESS. THE WITNESS STATED THEY CONTINUED DOWN WEST OAKLAWN STREET AND THE PICKUP CONTINUED TO FOLLOW HER. THE WITNESS STATED THAT SHE TURNED DOWN SEVERAL MORE STREETS AND THE DEFENDANT CONTINUED TO FOLLOW HER. THE WITNESS STATED SHE THEN CALLED HER BOYFRIEND/VICTIM AND HE TOLD HER TO RETURN BACK TO HIS RESIDENCE. THE WITNESS STATED SHE DROVE UP WEST COUNTRY COURT AND THE DEFENDANT STILL CONTINUED TO FOLLOW HER. THE WITNESS STATED THAT SHE THEN PULLED UP INTO THE VICTIMâS DRIVEWAY AND RAN INTO THE RESIDENCE. THE WITNESS STATED THAT THE VICTIM CONFRONTED THE DEFENDANT IN THE VEHICLE, BUT SHE DID NOT KNOW WHAT HAD OCCURRED BETWEEN THEM, BECAUSE SHE STAYED INSIDE THE RESIDENCE. I THEN SPOKE TO THE VICTIM, WHO STATED THAT HE RECEIVED A TELEPHONE CALL FROM HIS GIRLFRIEND/WITNESS, WHO TOLD HIM AFTER SHE LEFT HIS RESIDENCE A VEHICLE HAD ALMOST HIT HER ON SOUTH OLDFIELD AVENUE AND WAS CHASING HER AROUND THE NEIGHBORHOOD. THE VICTIM STATED HE TOLD HER TO COME BACK TO HIS RESIDENCE. THE VICTIM STATED THAT SHE PULLED IN THE DRIVEWAY. THE VICTIM STATED HE OBSERVED A SILVER OR WHITE AVALANCHE PARK IN THE ROADWAY AND THEN PULL INTO THE NEXT DOOR NEIGHBORâS DRIVEWAY. THE VICTIM STATED THAT AS HE WAS YELLING AT THE SUBJECT IN THE VEHICLE, THE VEHICLE BACKED UP IN A HURRIED MANNER. THE VICTIM STATED AS HE CONTINUED TO APPROACH THE VEHICLE, THE DRIVER WHO HE DESCRIBED AS A WHITE FEMALE, 25-26 YEARS OF AGE, 5â 6â, APPROXIMATELY 115 POUNDS, WITH BROWN HAIR (DEFENDANT ) EXITED THE VEHICLE WITH A WOODEN BASEBALL BAT IN HER HAND. THE VICTIM STATED THAT THE DEFENDANT THEN ENGAGED IN AN ARGUMENT WITH HIM. THE VICTIM STATED THAT THE DEFENDANT THEN PULLED THE BASEBALL BAT BACK AS IF SHE WAS GOING TO SWING AND HIT HIM WITH IT, CAUSING HIM TO FEEL IN FEAR. THE VICTIM STATED HE OBSERVED THE PASSENGER, WHO HE IDENTIFIED AS A WHITE MALE SUBJECT, APPROXIMATELY 26 YEARS OF AGE, 5â 6â, 150 POUNDS UNKNOWN CLOTHING DESCRIPTION (UNIDENTIFIED SUBJECT) HAD PULLED WHAT APPEARED TO BE A GUN FROM THE GLOVE COMPARTMENT AND POINTED IT AT HIM. THE VICTIM STATED THAT THE PASSENGER NEVER EXITED THE VEHICLE. THE VICTIM STATED THAT THE MALE SUBJECT TOLD THE DEFENDANT TO GET BACK INTO THE VEHICLE AND ONCE SHE GOT IN THE VEHICLE, SHE POKED THE UNKNOWN MALE SUBJECT PASSENGER WITH THE BASEBALL BAT. THE VICTIM STATED THAT DURING THE ARGUMENT, THE DEFENDANT MADE A COMMENT THAT âHIS GIRLFRIENDâS VEHICLE HAD CHASED HER DOWN HER STREET ON WEST FOXHILL LANE. DEPUTY PERUCHE LOCATED A VEHICLE MATCHING THE DESCRIPTION THAT THE VICTIM HAD ADVISED LOCATED AT 4762 WEST FOX HILL LANE, WHICH IS AROUND THE CORNER FROM THE VICTIMâS RESIDENCE. I RESPONDED TO THE SCENE AND LOCATED A 2004 CHEVROLET AVALANCHE BEARING FLORIDA TAG âBFRW65â GRAY IN COLOR PARKED IN THE DRIVEWAY. I MADE CONTACT WITH THE DEFENDANT, WHO STATED THAT SHE HAD BEEN INVOLVED IN ALTERCATION AND THAT SOMEONE WAS FOLLOWING HER IN A VEHICLE. THE DEFENDANT STATED THAT SHE WAS AROUND THE CORNER PARKED ON A STREET, WHEN AN UNKNOWN WHITE MALE SUBJECT CAME UP AND POINTED A GUN AT HER, SO SHE POINTED A GUN BACK AT HIM. THE DEFENDANT STATED THAT THERE WAS A WHITE MALE SUBJECT SITTING IN THE PASSENGER SEAT NAMED âGUMBOâ WHICH IS THE ONLY NAME THAT SHE KNOWS HIM BY. THE DEFENDANT STATED THAT AFTER THE INCIDENT THAT SHE HAD DROPPED HIM OFF AT THE INTERSECTION OF SOUTH REDWING AVENUE AND WEST GLENN STREET. WHILE TRYING TO QUESTION THE DEFENDANT MORE ABOUT THE INCIDENT, THE DEFENDANT STATED THAT SHE HAS RIGHTS AND DOES NOT WANT TO TALK ANYMORE. I LOOKED INTO THE CHEVROLET AVALANCHE VEHICLE FROM THE CLOSED PASSENGER DOOR AND OBSERVED A ROUND WOODEN BASEBALL BAT LYING ON THE PASSENGER SEAT AS WELL AS A GRAY GUN. UPON SEARCHING THE VEHICLE, I OBSERVED THAT THE GUN WAS A CO-2 AIR PISTOL. I RESPONDED BACK TO 4983 WEST COUNTRY COURT AND MADE CONTACT WITH THE VICTIM AND TRANSPORTED HIM TO 4762 WEST FOXHILL LANE. WHILE THE VICTIM WAS SITTING IN MY PATROL VEHICLE A SHOW-UP WAS CONDUCTED OF THE DEFENDANT, WHO WAS STANDING BY DEPUTY PERUCHE AND THE VICTIM POSITIVELY IDENTIFIED THE DEFENDANT AS THE FEMALE SUBJECT THAT HAD THREATENED HIM WITH THE BASEBALL BAT. AT THIS TIME, THE SUBJECT WHO WAS SITTING IN THE PASSENGER SEAT OF THE DEFENDANTâS VEHICLE IS UNIDENTIFIED AND HIS WHEREABOUTS ARE UNKNOWN . I GAVE THE VICTIM A VICTIMâS RIGHTS PAMPHLET AND CASE NUMBER FOR FURTHER REFERENCE . I PLACED THE DEFENDANT UNDER ARREST FOR AGGRAVATED ASSAULT WITH DEADLY WEAPON. THE DEFENDANT WAS THEN HANDCUFFED (DOUBLE LOCKED) AND SECURED IN THE REAR SEAT OF MY PATROL VEHICLE AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY (CCDF) FOR BOOKING AND PROCESSING. THE DEFENDANT âS BOND SET WAS SET AT $5,000.00 PER THE BOND SCHEDULE. I PLACED INTO THE CITRUS COUNTY SHERIFF'S OFFICE (CCSO) EVIDENCE DIVISION AT THE EMERGENCY OPERATIONS CENTER (EOC) THE BASEBALL BAT AND THE CO-2 GRAY PISTOL (RUGER 6MM BB GUN P-34508C02514). I COLLECTED THE SWORN WRITTEN STATEMENTS FROM THE VICTIM AND WITNESS, WHICH WERE TURNED IN TO THE RECORDS DIVISION. |
