SUBMITTED BY: ROSS, JAMAL 1339 (AR-13194) DID, KNOWING HIS DRIVERâS LICENSE OR DRIVING PRIVILEGE HAD BEEN CANCELLED, SUSPENDED OR REVOKED, DRIVE A MOTOR VEHICLE UPON THE HIGHWAYS OF THIS STATE WHILE SUCH LICENSE OR PRIVILEGE WAS CANCELLED, IN VIOLATION OF FLORIDA STATE STATUTE 322.34(2)(B). ON 121714 AT APPROXIMATELY 1935 HOURS, DISPATCH received A TRAFFIC COMPLAINT OF A WHITE FORD F150 DRIVING RECKLESSLY IN THE AREA OF WEST GROVER CLEVELAND BOULEVARD, IN HOMOSASSA (REFERENCE INCIDENT 2014-171884). WHILE CONDUCTING TRAFFIC ENFORCEMENT ON HIGHWAY 19 AND NORTH TURKEY OAK DRIVE, I OBSERVED A WHITE FORD F350, BEARING FLORIDA LICENSE PLATE CUAF93, DRIVING SOUTHBOUND ON HIGHWAY 19, UNABLE TO MAINTAIN A SINGLE LANE. I THEN FOLLOWED THE VEHICLE TO KINGS BAY DRIVE. WHILE FOLLOWING THE VEHICLE, I OBSERVED THE VEHICLE CROSS THE WHITE FOG LINE ON THE RIGHT SIDE OF THE ROADWAY SEVEN TIMES, WHICH PROVIDED ME PROBABLE CAUSE TO INITIATE A TRAFFIC STOP. AT THAT TIME, I ACTIVATED MY EMERGENCY LIGHTS AND CONDUCTED A TRAFFIC STOP IN THE AREA OF SOUTHEAST HIGHWAY 19 AND KINGS BAY DRIVE. UPON MAKING CONTACT WITH THE DRIVER/DEFENDANT, MR KENNETH PAUL BUCHANAN, I COULD SMELL AN ODOR OF AN ALCOHOLIC BEVERAGE EMITTING FROM HIS PERSON. I ALSO OBSERVED A BUDWEISER BOTTLE LAYING ON THE PASSENGER SEAT. I THEN ASKED THE DRIVER FOR HIS DRIVER'S LICENSE AND VEHICLE REGISTRATION. THROUGHOUT MY INVESTIGATION OF THE DEFENDANTâS DRIVING HISTORY, IT WAS CONFIRMED BY TELETYPE OPERATOR 0732, THAT THE DEFENDANT WAS DRIVING ON A SUSPENDED LICENSE, WHICH WAS SUSPENDED ON 082014. I CONFIRMED THROUGH DRIVER AND VEHICLE INFORMATION DATABASE THAT THE DEFENDANT HAD ONE PRIOR GUILTY CONVICTION FOR DRIVING ON A SUSPENDED LICENSE, WHICH OCCURRED ON 022704 (CITATION NUMBER 6428DAT). IT WAS ALSO DISCOVERED THAT THE DEFENDANT HAS HAD TWO OTHER CITATIONS FOR DRIVING ON SUSPENDED LICENSE; ON 101008 (CITATION NUMBER 3967RHH), AND 123008 (CITATION NUMBER 9031GCP). THE FINAL DISPOSITION FOR THESE TWO COURT DATES WAS ADJUDICATION WITHHELD. I THEN ASKED THE DEFENDANT IF HE KNEW HIS DRIVER'S LICENSE WAS SUSPENDED, TO WHICH HE STATED YES FOR FAILURE TO PAY TRAFFIC FINES. DUE TO THE FACT THAT THE DEFENDANT WAS KNOWINGLY DRIVING A VEHICLE ON A SUSPENDED LICENSE HE WAS PLACED UNDER ARREST. THE DEFENDANT WAS HANDCUFFED, (DOUBLE LOCKED) BEHIND HIS BACK, SECURED IN THE REAR OF MY PATROL VEHICLE, AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. THE DEFENDANTâS BOND WAS SET AT $1,000.00, PER THE BOND SCHEDULE. I ISSUED THE DEFENDANT A WRITTEN WARNING, FOR FAILURE TO MAINTAIN A SINGLE LANE, CITATION NUMBER 391191B. I ISSUED THE DEFENDANT A FLORIDA UNIFORM TRAFFIC CITATION, CITATION NUMBER A1BTPIP, FOR DRIVING ON A SUSPENDED LICENSE KNOWINGLY, WITH A FINE OF $160.00, AND A TRAFFIC COURT DATE OF 010815 AT 1300 HOURS. THE DEFENDANTâS VEHICLE WAS TOWED BY KNIGHTLY TOWING TO THEIR IMPOUND LOT. THE DEFENDANTâS PROPERTY WAS TURNED OVER TO THE CITRUS COUNTY DETENTION FACILITY. THE DEFENDANTâS LICENSE PLATE AND DRIVER'S LICENSE WERE SEIZED AND TURNED IN TO RECORDS, ALONG WITH ALL OTHER DOCUMENTS. |
