SUBMITTED BY: EICHHORN, CAROLINE 1365 (17-40825) (AR17-23092) DID UNLAWFULLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION WITH THE INTENT TO USE, OR DID UNLAWFULLY USE, AN OBJECT INTENDED OR DESIGNED FOR USE IN STORING, CONCEALING OR INJECTING, INGESTING, INHALING OR OTHERWISE INTRODUCING INTO THE HUMAN BODY, A CONTROLLED SUBSTANCE, TO WIT: THREE GLASS PIPES CONTAINING RESIDUE USED TO SMOKE MARIJUANA, THREE HYPODERMIC NEEDLES USED TO INJECT METHAMPHETAMINE AND TWO SPOONS WITH WHITE RESIDUE, IN VIOLATION OF FLORIDA STATE STATUTE 893.147(1). ON 032117 AT 2312 HOURS, I WAS DISPATCHED TO THE MCDONALD'S, IN INVERNESS, LOCATED AT 240 U S HIGHWAY 41 SOUTH, IN REFERENCE TO A SUSPICIOUS PERSON. THE COMPLAINANT, MS CAROL BUSHELL WAS IN THE PARKING LOT OF MCDONALD'S AND OBSERVED A WHITE MALE SITTING AT A PICNIC TABLE, 'PLAYING WITH A SWORD AND TALKING TO HIMSELF'. WHEN I ARRIVED ON SCENE, I MADE CONTACT WITH THE DEFENDANT, LATER IDENTIFIED AS MR KEVIN HEALEY. AS I BEGAN TO SPEAK WITH THE DEFENDANT, IT WAS EXTREMELY EVIDENT THAT HE WAS UNDER THE INFLUENCE OF NARCOTICS. THE DEFENDANT IMMEDIATELY STATED THAT HE WAS COVERED IN FLEAS, WAS EXTREMELY FIDGETY AND WAS SCRATCHING HIS BODY EXCESSIVELY. I ASKED THE DEFENDANT IF HE WAS UNDER THE INFLUENCE OF NARCOTICS AND HE STATED, THAT HE HAD 'SHOT UP' METHAMPHETAMINE THREE TIMES IN THE PAST WEEK. I DID OBSERVE A SHOPPING CART FULL OF ITEMS INCLUDING A LARGE MACHETE. I ASKED THE DEFENDANT IF HE HAD ANY OTHER WEAPONS ON HIS PERSON AND HE STATED THAT HE DID NOT. I THEN ASKED PERMISSION TO SEARCH THE DEFENDANT FOR ANY OTHER WEAPONS AND HE STATED, THAT I COULD SEARCH HIM AND HE HAD A 'WEED PIPE IN HIS POCKET'. I THEN CONDUCTED A PAT DOWN OF THE EXTERIOR OF THE SUBJECTS CLOTHING AND I FELT A LARGE OBJECT IN THE DEFENDANT'S RIGHT FRONT POCKET. I ASKED THE DEFENDANT IF I COULD REMOVE THE OBJECT AND HE STATED THAT I COULD. I THEN REMOVED A MULTI-COLORED GLASS PIPE, WITH RESIDUE, THAT THE DEFENDANT STATED HE USED TO SMOKE MARIJUANA. I THEN FELT THE EXTERIOR LEFT SIDE POCKET OF THE DEFENDANT'S SHORTS AND FELT A LONG CYLINDRICAL OBJECT. I ASKED THE DEFENDANT WHAT WAS IN HIS LEFT FRONT POCKET AND HE STATED, THAT HE HAD A HYPODERMIC NEEDLE AND CAPS. I THEN REMOVED THOSE ITEMS FROM HIS LEFT FRONT POCKET. THE DEFENDANT WAS THEN PLACED UNDER ARREST FOR ONE COUNT OF POSSESSION OF DRUG PARAPHERNALIA, HANDCUFFED, DOUBLE-LOCKED, BEHIND HIS BACK AND ESCORTED TO MY PATROL VEHICLE. I THEN REMOVED A LARGE BACKPACK FROM THE DEFENDANT'S SHOPPING CART, THAT HE WAS IN POSSESSION OF. THE LARGE ZIPPER SECTION OF THE BACKPACK WAS OPEN AND I COULD OBSERVE, IN PLAIN VIEW, TWO HYPODERMIC NEEDLES, TWO MULTI-COLORED GLASS PIPES USED TO SMOKE MARIJUANA AND TWO METAL SPOONS CONTAINING A WHITE RESIDUE. THAT DRUG PARAPHERNALIA WAS COLLECTED FOR EVIDENCE. I THEN CONTACTED THE DEFENDANT'S MOTHER, MS GLENDA GERARD, WHO RESPONDED TO MY LOCATION AND TOOK POSSESSION OF THE REST OF THE DEFENDANT'S BELONGINGS. THE DEFENDANT WAS THEN TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING WHERE HIS BOND WAS SET AT $1,000.00 PER THE BOND SCHEDULE. NO FURTHER ACTION TAKEN BY THIS DEPUTY. |
