SUBMITTED BY: CONLEY, STEPHEN 0290 (AR11121627) DID UNLAWFULLY ENTER OR REMAIN IN A CERTAIN STRUCTURE OR CURTILAGE THEREOF, TO-WIT: WASABI SMOKE SHOP, LOCATED AT 6185 SOUTH FLORIDA AVENUE IN FLORAL CITY, IN THE COUNTY AND STATE AFORESAID, THE PROPERTY OF THE VICTIM, WITHOUT SAID PERSON'S CONSENT, WITH THE INTENT TO COMMIT AN OFFENSE THEREIN, TO-WIT: GRAND THEFT, IN VIOLATION OF FLORIDA STATUTE 810.02(4)(A) AND DID UNLAWFULLY AND KNOWINGLY OBTAIN, USE OR ENDEAVOR TO OBTAIN OR USE THE PROPERTY OF THE VICTIM, TO-WIT: WASABI SMOKE SHOP, OF THE VALUE OF THREE HUNDRED DOLLARS ($300.00) OR MORE, BUT LESS THAN FIVE THOUSAND DOLLARS ($5,000.00), TO WIT: CONSUMABLE GOODS, SMOKING DEVICES AND SYNTHETIC MARIJUANA, WITH THE INTENT TO EITHER TEMPORARILY OR PERMANENTLY DEPRIVE THE VICTIM OF A RIGHT TO THE PROPERTY OR A BENEFIT THEREOF, OR DID APPROPRIATE THE SAID PROPERTY TO HIS OWN USE OR THE USE OF ANY PERSON NOT ENTITLED THERETO, IN VIOLATION OF FLORIDA STATUTES 812.014(2)C(1). ON 06092011, IT WAS REPORTED TO THE CITRUS COUNTY SHERIFF'S OFFICE THAT A BURGLARY AND GRAND THEFT OCCURRED AT WASABI SMOKE SHOP, LOCATED AT 6185 SOUTH FLORIDA AVENUE IN FLORAL CITY, FLORIDA. DURING THE BURGLARY, SEVERAL SURVEILLANCE VIDEOS CAPTURED THE DEFENDANTS WALKING AROUND THE EXTERIOR OF THE BUILDING AS WELL AS THE INTERIOR. DURING THE INVESTIGATION IT WAS LEARNED THAT A WHITE MALE SUBJECT, IDENTIFIED AS DEFENDANT HERMANSON, WAS POSSIBLY INVOLVED. THIS INFORMATION WAS DERIVED AFTER LEARNING THAT DEFENDANT HERMANSON HAD A MEDICAL ISSUE AFTER CONSUMING SOME OF THE PRODUCTS THAT WERE STOLEN. AFTER REVIEWING PICTURES OF THE DEFENDANT ON VIDEO, DEFENDANT HERMANSON DID RESEMBLE ONE OF THE SUBJECTS CAPTURED. 07062011, THIS AFFIANT RESPONDED TO 6343 EAST LOWDEN STREET IN INVERNESS, MAKING CONTACT WITH DEFENDANT HERMANSON AND ANOTHER JUVENILE DEFENDANT. DEPUTY HOLLOWAY WAS ON SCENE AND ADVISED THAT BOTH DEFENDANTS ACKNOWLEDGED INVOLVEMENT IN THE BURGLARY INCIDENT. THEY ALSO ADVISED THAT A THIRD SUBJECT WAS ALSO INVOLVED AND COULD BE FOUND AT THE PAPA JOHNS RESTAURANT IN INVERNESS. BOTH SUBJECTS WERE TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR INTERVIEW. UPON ARRIVAL AT THE DETENTION FACILITY, I CONDUCTED A DIGITALLY RECORDED INTERVIEW WITH DEFENDANT HERMANSON. PRIOR TO ANY QUESTIONING, DEFENDANT HERMANSON WAS READ MIRANDA FROM A PREPRINTED TEXT. DEFENDANT HERMANSON UNDERSTOOD HIS RIGHTS AND AGREED TO SPEAK WITH ME. DURING THE INTERVIEW, DEFENDANT HERMANSON STATED THAT ON THE NIGHT OF THE BURGLARY, HE AND OTHER CO-DEFENDANTS WENT TO THE WASABI SMOKE SHOP AND BROKE IN AT THE BACK DOOR. HE ADVISED THAT HE WENT INSIDE WITH A CO-DEFENDANT AND THEY STOLE CIGARETTES, SEVERAL BONGS AND SPICE (SYNTHETIC MARIJUANA.) HE STATED THAT THEY DROVE TO THE BUSINESS AND PARKED BY THE RAILS TO TRAILS LOCATED BEHIND THE STORE. HE STATED THAT THEY WERE INSIDE UNTIL THE ALARM WENT OFF, THEN THEY LEFT. DEFENDANT HERMANSON WAS VERY COOPERATIVE DURING THE INTERVIEW AND AGREED THAT HE MADE A MISTAKE AND FELT GUILTY ABOUT DOING IT. DEFENDANT HERMANSON WAS ARRESTED AND TURNED OVER TO CITRUS COUNTY DETENTION FACILITY STAFF FOR BOOKING AND PROCESSING. DEFENDANT HERMANSON WAS RELEASED ON HIS OWN RECOGNIZANCE. ALL AUDIO RECORDINGS WERE LATER DOWNLOADED TO THE SHERIFF'S OFFICE SERVER.
