SUBMITTED BY: mclaughlin-perry, allison 0507 (AR11123559) (0650) ANY PERSON WHO KNOWINGLY SELLS PURCHASES MANUFACTURES DELIVERS, OR BRINGS INTO THIS STATE, OR WHO IS KNOWINGLY IN ACTUAL OR CONSTRUCTIVE POSSESSION IN EXCESS OF 25 POUNDS OF CANNABIS or 300 cannabis plants; TO WIT: APPROXIMATELY 402 POUNDS OF CANNABIS, and 736 cannabis plants; COMMITS A FELONY OF THE FIRST DEGREE KNOWN AS TRAFFICKING IN CANNABIS IN VIOLATION OF THE FLORIDA STATE STATUTE 893.135(1)(A). did unlawfully and knowingly agree, conspire, combine, or confederate with another person to traffic in cannabis in violation of THE FLORIDA STATE STATUTE 893.135(5). DID UNLAWFULLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION WITH THE INTENT TO USE, OR DID UNLAWFULLY USE, AN OBJECT INTENDED OR DESIGNED FOR USE IN STORING, CONCEALING OR INJECTING, INGESTING, INHALING OR OTHERWISE INTRODUCING INTO THE HUMAN BODY, A CONTROLLED SUBSTANCE, TO WIT: cannabis grinder, rolling papers, store and seal baggies, sodium light bulbs, and fertilizer in violation of THE florida state statutes 893.147(1)(A). DID UNLAWFULLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO-WIT: CANNABIS, WITH THE INTENT TO SELL THE SAID SUBSTANCE TO ANOTHER PERSON, IN VIOLATION OF THE FLORIDA STATUTE 893.13(1)(A)(2). DID, KNOWING HIS DRIVER'S LICENSE OR DRIVING PRIVILEGE HAD BEEN CANCELLED, SUSPENDED OR REVOKED, DRIVE A MOTOR VEHICLE UPON THE HIGHWAYS OF THIS STATE WHILE SUCH LICENSE OR PRIVILEGE WAS CANCELLED, IN VIOLATION OF THE FLORIDA STATE STATUTE 322.34(2)(A). on 110411, the citrus county sheriff's office (ccsO) tactical impact/vice and narcotics unit conducted multiple search warrant investigations at multiple residence(s) in the area of beverly hills, to include, 4537 west tomahawk drive, 3355 west birds nest drive, 5135 west hacienda drive, and 4647 west bonanza drive. the purpose of these investigations was to execute multiple search warrants at multiple suspected marijuana grow and "stash" houses. prior to the execution of the search warrants, the investigation revealed that a white male subject identified as MR kevin shaw (defendant) was growing marijuana at multiple residences in the area of beverly hills. during the course of the investigation, surveillance revealed that the defendant, resided at the residence located 4537 west tomahawk drive. the defendant would drive to the residence(s) of 3355 west birds nest drive, 5135 west hacienda drive and 4647 west bonanza drive frequently and almost on a daily basis. upon conducting a records check of the residence located at 4647 west bonanza drive, the co-defendant, MR gordon collins, was identified as having the electricity to the home in his name. the driver and vehicle information database (DAVID) showed the address of 4537 west tomahawk drive as the co-defendants listed address. this address is the same address as the defendants home address. ON 110411, detective novy MADE CONTACT WITH JUDGE davis WHO REVIEWED AND SIGNED the AFFIDAVIT(s) FOR A SEARCH WARRANT for these residences. AT APPROXIMATELY 1108 HOURS, the citrus county SHERIFF'S OFFICE swat team arrived at 3355 west birds nest drive, beverly HILLS TO execute the search warrant and clear the residence. upon clearing the residence, it was determined that the home was unoccupied. a copy of the search warrant and INVENTORY and return was provided to the residence. further search of the home revealed that most of the residence was converted TO cultivate and grow marijuana. a total of four bedrooms were being UTILIZED to grow marijuana. 121 marijuana plants were located in various stages of growth, from clone to mature plants. the total approximate weight of the 121 marijuana plants that were found in the residence is 134 pounds 11 ounces. at approximately 1130 hours, the citrus county sheriff's office swat team arrived at the defendant's residence located at 4537 west tomahawk drive, beverly hills florida. upon clearing the house and rendering it secured the home was found to be unoccupied. upon conducting a search of the home, under the PARAMETERS of the search warrant, MULTIPLE bags of cannabis were located throughout the home, vehicle, and detached garage. the marijuana that was found appeared to be recently harvested from one of the grow houses according to your AFFIANT'S training and experience. the bags of marijuana that were located had both marijuana that was prepared and packaged for sale and marijuana that was still attached to the stem of the marijuana plant. the total approximate weight of the marijuana that was located on the property of 4537 west tomahawk drive was 14 pounds 13 ounces. A FURTHER SEARCH OF THE RESIDENCE LOCATED NUMEROUS ITEMS including MARIJUANA, food storage machine, food storage bags (including the bag that contained the prepared marijuana), sodium light bulbs, fertilizer sprayers, large commercial grade power wire and documents bearing the address the above listed addresses. ON 110311 AT APPROXIMATELY 1700 HOURS, WHILE CONDUCTING SURVEILLANCE IN THE AREA OF WEST BONANZA DRIVE AND WEST MUSTANG BOULEVARD, THIS DEPUTY OBSERVED THE DEFENDANT TO BE DRIVING A WHITE DODGE PICKUP TRUCK BEARING FLORIDA TAG 443YVS, DRIVING WEST ON WEST MUSTANG BOULEVARD. THROUGH THE COURSE OF THIS INVESTIGATION THIS DEPUTY IS FAMILIAR THAT THE DEFENDANT DID NOT HAVE A VALID DRIVER'S LICENSE AND WAS SUSPENDED AND HAD RECEIVED A CITATION ON 012309, FOR DRIVING WHILE LICENSE SUSPENDED UNKNOWINGLY. LATER THAT DATE, THIS DEPUTY CONFIRMED THROUGH THE DRIVER AND VEHICLE INFORMATION DATA BASE (DAVID), THAT THE DEFENDANT'S DRIVER LICENSE STILL IN FACT IS SUSPENDED, AND DID NOT HAVE ANY RENEWAL OR DRIVER'S LICENSE ACTIVITY SINCE RECEIPT OF THE CITATION IN 2009. at approximately 1147 hours, the citrus county sheriff's office swat team arrived at the property of 5135 west hacienda drive, beverly hills florida. upon clearing the residence, it was determined that the home was unoccupied. a copy of the search warrant and INVENTORY and return was provided to the residence. further search of the home revealed that most of the residence was converted TO cultivate and grow marijuana. a total of five bedrooms were being UTILIZED to grow marijuana. 462 marijuana plants were located in various stages of growth, from clone to mature plants. the total approximate weight of the 462 marijuana plants that were found in the residence is 135 pounds. at approximately 1203 hours, the citrus county sheriff's office swat team arrived at the property of 4647 west bonanza drive, beverly hills florida. upon clearing the home, the co-defendant was located. the co-defendant was read the search warrant and was also read miranda via agency issued pre printed card. a further search of the home revealed that most of the residence was converted TO cultivate and grow marijuana. five bedrooms were identified as being UTILIZED to grow MARIJUANA in. A total OF 153 plants were located, all in various stages of growth, from clone to mature plants. the total approximate weight of the 153 marijuana plants that were found in the residence was approximately 118 pounds. THE MARIJUANA WAS PACKAGED AND TRANSPORTED TO THE CITRUS COUNTY SHERIFF'S OFFICE (CCSO) in addition to ALL additional items of evidentiary value. on a later date an additional search warrant was conducted at the residence of 4042 west bonanza drive, beverly hills florida by the citrus county tactical impact unit. upon clearing the residence, it was determined that the home was unoccupied. a copy of the search warrant and INVENTORY and return was provided to the residence. Multiple paper documents were located throughout the home that tied the defendant, co-defendant, and other co-conspirators to the marijuana grow operation and drug trafficking organization. based upon the continuance of this investigation, additional co-conspirators are being identified and will be charged in accordance to the furtherance of evidence. THE DEFENDANT WAS ISSUED UNIFORM TRAFFIC CITATION NUMBER 5744-GJX-1, WITH MANDATORY COURT APPEARANCE ON 120111 AT 1300 HOURS THE DEFENDANT'S TOTAL BOND WAS SET AT $211,000.00, PER THE BOND SCHEDULE.
