submitted by: SUDLOW, JAMES 0759 (AR16-20862) DID UNLAWFULLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: ONE GRAM OF METHAMPHETAMINE, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(A). DID UNLAWFULLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION WITH THE INTENT TO USE, OR DID UNLAWFULLY USE, AN OBJECT INTENDED OR DESIGNED FOR USE IN STORING, CONCEALING OR INJECTING, INGESTING, INHALING OR OTHERWISE INTRODUCING INTO THE HUMAN BODY, A CONTROLLED SUBSTANCE, TO WIT: A GLASS PIPE COMMONLY USED TO SMOKE METHAMPHETAMINE, IN VIOLATION OF FLORIDA STATE STATUTE 893.147(1). ON 090616, WHILE TRAVELING EAST ON WEST MEADOW STREET, I WAS BEHIND A WHITE IN COLOR TWO DOOR SCION VEHICLE, BEARING FLORIDA LICENSE PLATE GNUW79. AS WE APPROACHED THE INTERSECTION OF WEST MEADOW STREET AND SOUTH OLDFIELD AVENUE, THE DRIVER, LATER IDENTIFIED AS THE DEFENDANT, MR KEVIN WINCH, FAILED TO STOP AT THE STOP SIGN AND TURNED SOUTH ON SOUTH OLDFIELD AVENUE. AT THAT TIME, I INITIATED A TRAFFIC STOP UTILIZING ALL OF MY EMERGENCY EQUIPMENT, WHERE THE FINAL STOP WAS AT SOUTH OLDFIELD AVENUE AND WEST HARLOW COURT, IN HOMOSASSA. UPON MAKING CONTACT WITH THE DEFENDANT I ASKED HIM FOR HIS DRIVER'S LICENSE, VEHICLE REGISTRATION, AND PROOF OF INSURANCE AND EXPLAINED THE REASON FOR THE TRAFFIC STOP. THE DEFENDANT PROVIDED ME WITH HIS VEHICLE REGISTRATION AND PROOF OF INSURANCE, BUT STATED HE LOST HIS DRIVER'S LICENSE. THE DEFENDANT THEN PROVIDED ME WITH HIS FLORIDA DRIVER'S LICENSE NUMBER. AT THAT TIME, I ASKED THE DEFENDANT IF HE HAD ANYTHING ILLEGAL IN HIS VEHICLE, TO WHICH HE STATED NO. I ALSO ASKED HIM IF HE WOULD LET ME SEARCH HIS VEHICLE, TO WHICH HE ADVISED I COULD SEARCH HIS VEHICLE. I THEN ASKED THE DEFENDANT TO STEP OUT OF THE VEHICLE. I THEN ASKED THE FRONT SEAT PASSENGER TO STEP OUT OF THE VEHICLE. WHILE SEARCHING THE VEHICLE, I LOCATED A SMALL CLEAR ZIPLOC BAGGIE, WHICH CONTAINED A CRYSTAL LIKE SUBSTANCE, NEXT TO THE DRIVERâS SEAT. THE SUBSTANCE WAS TESTED UTILIZING AN AGENCY ISSUED METHAMPHETAMINE TEST KIT, WHICH YIELDED A POSITIVE RESULT. I ALSO LOCATED A GLASS PIPE IN THE GLOVE BOX. I THEN SWABBED THE INSIDE OF THE GLASS PIPE, WHICH ALSO TESTED POSITIVE FOR METHAMPHETAMINE. I THEN MADE CONTACT WITH THE DEFENDANT. DURING A POST MIRANDA DIGITALLY RECORDED INTERVIEW, THE DEFENDANT ADMITTED THAT THE BAG OF METHAMPHETAMINE AND THE METHAMPHETAMINE PIPE BELONGED TO HIM. AT THAT TIME, I ADVISED THE DEFENDANT THAT HE WAS BEING PLACED UNDER ARREST. THE DEFENDANT WAS PLACED IN HANDCUFFS (DOUBLE LOCKED) BEHIND HIS BACK AND PLACED IN THE REAR SEAT OF MY PATROL VEHICLE. THE DEFENDANT WAS THEN TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY, WHERE HE WAS CHARGED WITH ONE COUNT OF POSSESSION OF A CONTROLLED SUBSTANCE ($2,000.00 BOND) AND ONE COUNT OF POSSESSION OF DRUG PARAPHERNALIA ($1,000.00 BOND). THE DEFENDANTâS TOTAL BOND WAS SET AT $3,000.00 PER THE BOND SCHEDULE. THE DEFENDANTâS VEHICLE WAS LEFT ON SCENE. THE DEFENDANT WAS ISSUED WRITTEN WARNING 401408B FOR RUNNING THE STOP SIGN. |
