According to official documents Vilay pled guilty in King County Superior Court on 10/17/2006 to one count of Attempted Child Molestation in the First Degree. He was sentenced to 38.25 months in prison with a maximum term of life in prison. This conviction was the result of Vilay sexually assaulting the known nine year old female victim. Vilay provided transportation of the victim and her brother from school to their babysitter's residence on a regular basis. He was known to provide them with candy and other gifts. One day Vilay took the victim and her brother to their home rather than the babysitter's residence. Once there he forced the victim to call the babysitter to tell her that Vilay was babysitting the children at their home. Vilay then sexually assaulted the victim by fondling her vagina and kissing her. Vilay started the process of participating in sex offender treatement while in prison but was found to be nonamenable due to his denial of the offense. Vilay is on active supervision with the Washington State Department of Corrections, Everett Field Office (425) 290-3200, for life and has the following conditions:
Do not date women nor form relationships with families who have minor children, as directed by CCO
Do not enter bars, taverns, casinos, or lounges or any location where alcohol is the primary item for sale
Do not have direct or indirect contact with any victim
Do not loiter or frequent parks, playgrounds, schoolyards, beaches, malls, or other areas where minor children are known to congregate, as defined by CCO
Do not participate in youth programs, including, but not limited to scouting, athletic, and school programs
Do not possess or access sexually explicit materials unless approved by CCS-SOTP and or CCO. Sexually explicit materials are any pictorial representations of adults or minors that are intended for sexual gratification. This includes, but is not limited to, material involving males, females, and or minors which show genitalia, bodily excretory behvior that appears to be sexual in nature, physical stimulation of unclothed genitals, masturbation, sodomy (I.E. bestiality or oral or anal intercourse), flagellation or torture in the context of a sexual relationship, or emphasizing the depiction of human genitals. Works of are or of anthropological significance are not considered sexually explicit materials
Do not possess or peruse pornographic materials unless authorized
Do not purchase, own or have in your possession or under your control any firearm or deadly weapon
Do not remain overnight in a residence where minor children live or are spending the night
Do not reside with anyone who is a parent/legal guardian of minor children
Do not use, possess or consume controlled substances unless you have a legally issued prescription
Do not work at or be in places frequented by minors
Enter into and successfully complete a sex offender treatment program with a certified sex offender treatment provider
Have no contact with adjudicated victims or their families for life
Have no contact with minors unless accompanied by a responsible adult who is capable of protecting the child, who knows of the conviction and has been approved of in advance by your CCO and sexualy deviancy treatment provider, if you are in treatment. The responsible adult must be someone other than your wife
Maintain lawful employment and provide proof of employment to DOC staff as directed
Must consent to DOC home visits to monitor compliance with supervision. Home visits include access for the purposes of visual inspection of all areas of residence in which the offender lives or has exclusive/joint control/access
Obtain permission before traveling outside of county in which you reside
Remain within or outside geographic boundaries as directed
Report to and be available for contact with assigned community corrections officer as directed
Shall reside at a location and under living arrangements as approved by CCO
Submit to search of your person, residence, vehicle and possessions whenever requested by
You may not leave the State of Washington without prior written permission from the ISRB and your CCO |
