Probable cause affidavit: SUBMITTED BY: RUSSO, CAROLYN N236 (AR10118222) DID DRIVE OR WAS IN ACTUAL PHYSICAL CONTROL OF A VEHICLE WHILE UNDER THE INFLUENCE OF AN ALCOHOLIC BEVERAGE, MODEL GLUE OR ANY SUBSTANCE CONTROLLED UNDER CHAPTER 893 OR CHAPTER 877.111 TO THE EXTENT HIS NORMAL FACULTIES WERE IMPAIRED, IN VIOLATION OF FLORIDA STATE STATUTE 316.193(1). did commit certain acts which are of such a nature as to corrupt the public morals or outrage the sense of public decency or affect the peace and quiet of a person who may witness them, or did engage in brawling or fighting, or in such conduct as to constitute a breach of the peace or disorderly conduct, in that the DEFENDANT WAS USING OFFENSE LANGUAGE AND ACTING BELLIGERENT, HE SCREAMED MULTIPLE TIMES HE KILLED MUSLIMS FOR A LIVING, in violation of Florida STATE Statute 877.03. I, OFFICER CAROLYN RUSSO WITH THE FLORIDA FISH AND WILDLIFE CONSERVATION COMMISSION, WAS ON PATROL ASSISTING ANOTHER OFFICER JUSTIN HENRY (FWC) ON A TRAFFIC STOP AT THE OAR HOUSE IN CRYSTAL RIVER. WHILE ASSISTING, I HEARD WHAT SOUNDED LIKE TWO VEHICLES MAKING CONTACT. THE SUBJECT OFFICER HENRY WAS DEALING WITH STATED THAT A VEHICLE HAD JUST STRUCK ANOTHER. I TURNED AROUND AND SAW A RED TRUCK PULL AWAY AND NOTICED A DENT ON ANOTHER VEHICLE. WHILE THE RED TRUCK PULLED AWAY, I WAIVED TO IT TO GET IT TO STOP. IT CONTINUED ON AS I TOOK MY FLASHLIGHT OUT TO TRY TO AFFECT THE STOP IT CONTINUED NORTH ON HIGHWAY 19. I GOT IN MY PATROL VEHICLE AND FOLLOWED IT. I HAD MY LIGHTS AND SIRENS ON. HE SWERVED TO THE RIGHT SIDE OF THE LANE GOING OVER THE WHITE LINE TWICE. I ATTEMPTED TO PULL THE VEHICLE OVER THE VEHICLE STOPPED AT WEST CEDAR LAKE DRIVE ON HIGHWAY 19. I WALKED UP TO THE VEHICLE ON THE PASSENGER SIDE. I TOLD THE SUBJECT/DRIVER TO ROLL HIS WINDOW DOWN AND PUT HIS VEHICLE IN PARK. HE STATED HIS VEHICLE WAS IN PARK. I OBSERVED THE VEHICLE WAS NOT IN PARK AND TOLD HIM TO PUT IT IN PARK AGAIN WHICH HE DID. HE BEGAN TO CRY AND STATED HE DID NOT WANT TO LOOSE HIS JOB. HE WAS IN THE ARMY AND HE FOUGHT IN THE IRAQ WAR. I TOLD HIM TO TURN OFF HIS VEHICLE AND GIVE ME THE KEYS. I ASKED FOR HIS DRIVER'S LICENSE. THE SUBJECT FUMBLED THROUGH HIS WALLET TO GET HIS DRIVER'S LICENSE. I TOOK HIS DRIVER'S LICENSE AND ASKED FOR HIS REGISTRATION. I THEN RAN HIS REGISTRATION THROUGH DISPATCH AND THE SUBJECT WAS IDENTIFIED AS MR KODY DANIEL GREER, DATE OF BIRTH 091588. OFFICER HENRY ARRIVED TO ASSIST. HE ADVISED THE SUBJECT HAD URINATED IN HIS PANTS. I TOLD THE SUBJECT TO STEP OUT OF HIS VEHICLE. I ASKED HIM IF HE WOULD PERFORM SOBRIETY TASKS AND HE STATED HE WOULD. I ASKED HIM TO MOVE TO PLACE WHERE THERE WAS BETTER LIGHTING. WHILE GETTING TO THAT LOCATION, HE STAGGERED, STUMBLED AND WAS UNSTEADY. WHILE OBSERVING THE SUBJECT, HE HAD A STRONG ODOR THAT SMELLED OF AN ALCOHOLIC BEVERAGE. HIS SPEECH WAS MUMBLED, CONFUSED, AND SOBBING. HIS FACE WAS FLUSHED, HIS EYES WERE BLOODSHOT, WATERY, GLASSY, AND HE HAD DILATED PUPILS. HIS ATTITUDE WAS DISORIENTED AND HE STATED HE DID NOT KNOW WHERE HE WAS. AT THAT TIME, I ASKED THE DEFENDANT IF HE HAD ANY MENTAL OR PHYSICAL DISABILITIES THAT WOULD NOT ALLOW HIM TO PERFORM ANY OF THE SOBRIETY TASKS, TO WHICH HE STATED THAT HE DID NOT. I READ FROM A PREPARED FIELD SOBRIETY TASK PERFORMANCE REPORT. I ASKED HIM THE PRELIMINARY SCREENING QUESTIONS AND HE ANSWERED NO TO ALL OF THE QUESTIONS. WHEN ASKED IF HE UNDERSTOOD THE TASKS, HE STATED YES HE DID. TASK ONE, HORIZONTAL GAZE NYSTAGMUS. PRIOR TO PERFORMING THIS TASK, IT WAS DETERMINED THAT THE DEFENDANT HAD NO PROBLEMS WITH HIS EYES. DURING THIS TASK, THERE WAS LACK OF SMOOTH PURSUIT IN BOTH THE LEFT AND RIGHT EYE. ALSO, THERE WAS ONSET OF NYSTAGMUS PRIOR TO 45 DEGREES IN THE LEFT AND RIGHT EYE. THERE WAS DISTINCT NYSTAGMUS AT MAXIMUM DEVIATION IN BOTH THE LEFT AND RIGHT EYE. AT FIRST HE COULD NOT KEEP HIS HEAD STILL AND I HAD TO REMIND HIM. VERTICAL NYSTAGMUS WAS PRESENT. TASK TWO, PALM PAT. THIS TASK WAS EXPLAINED AND DEMONSTRATED TO THE DEFENDANT. HE STATED HE UNDERSTOOD. DURING THIS TASK, THE DEFENDANT'S HANDS WERE SLIDING, HIT SIDES OF HAND. TASK THREE, FINGER COUNT. THIS TASK WAS EXPLAINED AND DEMONSTRATED TO THE DEFENDANT. HE STATED HE UNDERSTOOD. DURING THIS TASK, THE DEFENDANT'S FINGERS SLID AND HE DID NOT SPEED UP AS INSTRUCTED. TASK FOUR, FINGER TO NOSE. THIS TASK WAS EXPLAINED AND DEMONSTRATED TO THE DEFENDANT. HE STATED HE UNDERSTOOD. DURING THIS TASK, THE DEFENDANT USED THE WRONG HAND AND STEPPED BACKWARDS. TASK FIVE, ONE LEG STAND. THIS TASK WAS EXPLAINED AND DEMONSTRATED TO THE DEFENDANT AND DURING THE TASK HE WAS TIMED FOR 30 SECONDS. THE DEFENDANT STATED HE UNDERSTOOD. DURING THIS TASK, THE DEFENDANT SWAYED WHILE BALANCING, PUT HIS FOOT DOWN MULTIPLE TIMES, AND ALSO DID NOT CONTINUE COUNTING. TASK SIX, THE ALPHABET. THIS TASK WAS EXPLAINED TO THE DEFENDANT. THE DEFENDANT STATED HE UNDERSTOOD THE INSTRUCTIONS. DURING THIS TASK, HE MISSED LETTERS HESITATED AND SANG. TASK SEVEN, BACKWARDS COUNT. THIS TASK WAS EXPLAINED TO THE DEFENDANT. THE DEFENDANT STATED HE UNDERSTOOD THE INSTRUCTIONS. DURING THIS TASK, HE MISSED NUMBERS, NUMBERS WERE REPEATED, HE HESITATED AND ALSO CONTINUED COUNTING PAST THE NUMBER TOLD TO STOP AT. AT THAT TIME, THE DEFENDANT WAS PLACED UNDER ARREST FOR DRIVING UNDER THE INFLUENCE. PRIOR TO LEAVING THE SCENE, THE DEFENDANT'S VEHICLE WAS TURNED OVER TO THE CITRUS COUNTY SHERIFF'S OFFICE (CCSO). THE DEFENDANT WAS THEN TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY BY DEPUTY KELLIE WARD (0725). WHILE EN ROUTE TO THE DETENTION FACILITY, THE DEFENDANT HAD MEDICAL ISSUES. DEPUTY WARD CALLED EMERGENCY MEDICAL SERVICES (EMS) FOR ASSISTANCE. THE DEFENDANT WAS TRANSPORTED BY EMS TO CITRUS MEMORIAL HOSPITAL (CMH). AT THE HOSPITAL, THE DEFENDANT WAS LOUD, VERBALLY ABUSIVE AND UNCOOPERATIVE, INSULTING, VERY TALKATIVE, YELLING, SCREAMING, YELLING OBSCENITIES AT THE TOP OF HIS LUNGS AND EXPOSING HIS GENITALS ALONG WITH DISRUPTING OTHER MEDICAL STAFF AND PATIENTS. HIS BLOOD WAS TAKEN. HE WAS OBSERVED FOR ANY MEDICAL PROBLEMS. FOR HIS SAFETY DURING HIS TIME AT THE HOSPITAL HE WAS HANDCUFFED TO THE HOSPITAL CHAIR. THE DEFENDANT WAS RELEASED AND WAS TRANSPORTED BACK TO THE DETENTION FACILITY BY CCSO. THE DEFENDANT WAS CHARGED WITH DRIVING UNDER THE INFLUENCE (DUI) WITH A $500.00 BOND PER THE BOND SCHEDULE. THE DEFENDANT WAS ISSUED A FLORIDA DUI UNIFORM TRAFFIC CITATION (UTC), CITATION NUMBER 7113-XED-X. THE DEFENDANT WAS ALSO ISSUED MISDEMEANOR CITATION NUMBER 176883C, FOR DISORDERLY CONDUCT, REFERENCE CASE NUMBER SWNC-10-OFF-5976. THE DEFENDANT WAS ISSUED FLORIDA UTC NUMBER 7856-AJA-1 FOR OPEN CONTAINER IN A MOVING VEHICLE.
