Probable cause affidavit: SUBMITTED BY: MORAN, GREGORY 1246 (AR14-8813) DID UNLAWFULLY, WILLFULLY AND MALICIOUSLY INJURE OR DAMAGE CERTAIN PROPERTY OF THE VICTIM, TO-WIT: A BLACK IN COLOR DELL COMPUTER MONITOR, VALUED AT $300.00, SAID DAMAGE BEING OF A VALUE OF MORE THAN TWO HUNDRED DOLLARS ($200.00), BUT LESS THAN ONE THOUSAND DOLLARS ($1,000.00), IN VIOLATION OF FLORIDA STATE STATUTE 806.13(1)(B)(2); ON 012214 I WAS DISPATCHED TO 2850 NORTH CREDE AVENUE, LOT 38, IN CRYSTAL RIVER IN REFERENCE TO A VERBAL DISTURBANCE. UPON ARRIVAL I MADE CONTACT WITH THE VICTIM, MR ALONZO CICCONE. THE VICTIM ADVISED THAT HE AND HIS FRIEND, DEFENDANT MS KRISTAL ROSE NESS, HAD BEEN IN A VERBAL ARGUMENT. THE VICTIM STATED THAT THE DEFENDANT PICKED UP HIS BLACK IN COLOR, DELL DESKTOP COMPUTER MONITOR AND SMASHED IT ON THE LIVING ROOM FLOOR. THE VICTIM ADVISED THAT HE HAS BEEN OCCASIONALLY ALLOWING THE DEFENDANT TO STAY AT HIS RESIDENCE ON AND OFF, BECAUSE SHE HAD NOWHERE ELSE TO GO. HE ADVISED THAT HE WAS TRYING TO HELP HER OUT AND GIVE HER A PLACE TO STAY TEMPORARILY. THE VICTIM ADVISED THAT THEY GOT IN THE ARGUMENT OVER THE FACT THAT THE DEFENDANT WAS VERY INTOXICATED. THE VICTIM STATED THAT HE HAD DUMPED OUT THE DEFENDANT’S ALCOHOLIC BEVERAGE, WHICH ANGERED THE DEFENDANT. THE VICTIM ADVISED THAT THE DEFENDANT WENT INSIDE OF THE RESIDENCE WHILE CONTINUING TO YELL AT HIM. HE STATED THAT SHE THEN PICKED UP THE COMPUTER SCREEN AND SMASHED IT ON TO THE LIVING ROOM FLOOR, BREAKING IT IN TO APPROXIMATELY FOUR PIECES. THE VICTIM ADVISED THAT THEY HAD BEEN ARGUING ON AND OFF ALL NIGHT. HE STATED THAT HE TRIED TO LEAVE THE RESIDENCE TO SEPARATE HIMSELF FROM THE DEFENDANT, BUT THE DEFENDANT TOOK HIS VEHICLE KEYS AND HID THEM AND WOULD NOT TELL HIM WHERE THEY WERE. THE VICTIM ADVISED THAT THE DEFENDANT LATER TOLD HIM THAT SHE HAD THROWN HIS VEHICLE KEYS IN TO THE YARD, BUT HE HAD BEEN UNABLE TO LOCATE THEM. I DID OBSERVE A BLACK IN COLOR DELL COMPUTER MONITOR ON THE GROUND, WHICH WAS BROKEN IN TO FOUR OR FIVE PIECES. I TOOK PHOTOGRAPHS OF THE DAMAGE; SEE MY CRIME SCENE TECHNICIAN (CST) REPORT FOR FURTHER DETAILS. I THEN MADE CONTACT WITH THE DEFENDANT. SHE APPEARED TO BE HIGHLY INTOXICATED, AND I COULD SMELL THE STRONG ODOR OF AN ALCOHOLIC BEVERAGE EMANATING FROM HER PERSON. THE DEFENDANT ADVISED THAT SHE AND THE VICTIM HAD BEEN ARGUING OVER THE VICTIM’S KEYS. SHE ADVISED THAT SHE HAD NOT WANTED THE DEFENDANT TO LEAVE, AND SO SHE HAD THROWN HIS KEY IN TO HIS YARD. THE DEFENDANT STATED THAT SHE HAD NOT SMASHED THE VICTIM’S COMPUTER SCREEN, AND THAT THE VICTIM HAD DONE SO HIMSELF. THE VICTIM ADVISED THAT THE DEFENDANT’S SON HAD BEEN INSIDE OF THE RESIDENCE DURING THE INCIDENT AND WITNESSED THE ALTERCATION. I THEN MADE CONTACT WITH THE DEFENDANT’S FOUR YEAR OLD SON. THE JUVENILE ADVISED THIS DEPUTY THAT HE HAD BEEN IN THE HOUSE DURING THE ARGUMENT. HE STATED THAT HIS MOTHER AND MR CICCONE HAD BEEN ARGUING AND HIS MOTHER HAD PICKED UP MR CICCONE’S COMPUTER AND THREW IT TO THE GROUND, SMASHING IT. THE DEFENDANT WAS THEN ADVISED THAT SHE WAS BEING PLACED UNDER ARREST FOR CRIMINAL MISCHIEF. SHE WAS HANDCUFFED, DOUBLE LOCKED BEHIND HER BACK, AND SEARCHED FOR WEAPONS OR CONTRABAND, WHICH WAS MET WITH NEGATIVE RESULTS. THE DEFENDANT WAS READ HER MIRANDA RIGHTS, VIA A PREPRINTED AGENCY ISSUED CARD, AND ADVISED THAT SHE UNDERSTOOD HER RIGHTS AND DID NOT WISH TO SPEAK WITH ME. PRIOR TO LEAVING THE SCENE, THE DEFENDANT ADVISED THAT SHE WISHED FOR HER CHILD TO BE LEFT IN THE CUSTODY OF HER MOTHER. CUSTODY WAS THEN HANDED OVER TO MS JACKIE FOSTER, GRANDMOTHER OF THE CHILD. THE VICTIM WAS PROVIDED WITH AN AGENCY CASE CARD, BEARING MY NAME, IDENTIFICATION NUMBER AND THIS CASE NUMBER, AND WAS ADVISED TO CONTACT THIS AGENCY WITH ANY FURTHER QUESTIONS OR INFORMATION. THE DEFENDANT WAS THEN SECURED IN THE REAR OF MY PATROL VEHICLE AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY. UPON ARRIVAL, SHE WAS RELEASED TO DETENTION FACILITY STAFF FOR BOOKING AND PROCESSING. THE DEFENDANT WAS CHARGED WITH ONE COUNT OF CRIMINAL MISCHIEF, WITH DAMAGE MORE THAN $200.00 BUT LESS THAN $1,000.00, WITH HER BOND SET AT $500.00, PER THE BOND SCHEDULE. I CONTACTED THE DEPARTMENT OF CHILDREN AND FAMILIES (DCF) HOTLINE, WHERE I SPOKE WITH OPERATOR DREW, IDENTIFICATION NUMBER 375, WHO ADVISED THAT A REPORT WOULD BE TAKEN.
