Probable cause affidavit: SUBMITTED BY: DERA, MARK 0688 (AR14-9285) DID UNLAWFULLY ENTER OR REMAIN IN A CERTAIN CONVEYANCE, TO-WIT: THE VICTIM’S VEHICLE, THE PROPERTY OF THE VICTIM, WITHOUT SAID PERSON'S CONSENT, WITH THE INTENT TO COMMIT AN OFFENSE THEREIN, TO-WIT: TO STEAL THE VICTIM’S PURSE, AND THE SAID CONVEYANCE WAS NOT OPEN TO THE PUBLIC AT THE TIME, AND THE DEFENDANT WAS NOT LICENSED OR INVITED TO ENTER OR REMAIN IN SAID CONVEYANCE, IN VIOLATION OF FLORIDA STATUTE, 810.02(4)(B). DID UNLAWFULLY AND KNOWINGLY OBTAIN OR USE, OR ENDEAVOR TO OBTAIN OR USE THE PROPERTY OF THE VICTIM, TO WIT: THE VICTIM’S PURSE, WITH THE INTENT TO EITHER TEMPORARILY OR PERMANENTLY DEPRIVE THE VICTIM OF A RIGHT TO THE PROPERTY OR A BENEFIT THEREOF, OR DID APPROPRIATE THE SAID PROPERTY TO HER OWN USE OR THE USE OF ANY PERSON NOT ENTITLED THERETO, IN VIOLATION OF FLORIDA STATE STATUTE, 812.014(2)(E). ON 022714, AT APPROXIMATELY 2330 HOURS, DEPUTY SANCHEZ (1242) WAS ASSISTING DEPUTY VIGGIANO (0682), IN REFERENCE TO AN UNRELATED CASE. AT THAT TIME, DEPUTY SANCHEZ WAS FLAGGED DOWN BY THE VICTIM, MS HANNAH LONG, WHO STATED SHE WAS AT WALGREENS FOR APPROXIMATELY 20 MINUTES AND THEN LEFT TO GO TO RACE TRAC ON HIGHWAY 44 IN CRYSTAL RIVER. UPON ARRIVAL, SHE WENT TO RETRIEVE HER PURSE TO PAY FOR GAS, AND COULD NOT FIND IT. THE VICTIM THEN RESPONDED BACK TO THE WALGREENS STORE AND WENT INSIDE TO CHECK WITH THE MANAGER. THE VICTIM ADVISED THAT SHE BELIEVED HER PURSE WAS STOLEN OUT OF HER VEHICLE. THE VICTIM THEN CHECKED THE TRASH CANS IN THE PARKING LOT OF THE WALGREENS STORE, WHERE SHE DISCOVERED SOME OF HER BELONGINGS. THE VICTIM STATED THAT HER TAN IN COLOR CROCHETED PURSE CONTAINING THE ITEMS LISTED IN THIS REPORT, TO INCLUDE A BROWN CHANGE PURSE, WAS STOLEN FROM HER VEHICLE AT WALGREENS. ON 022714, DEPUTY VIGGIANO (0682) CONDUCTED A TRAFFIC STOP ON A 2002 HYUNDAI ELANTA, TAG CKSW86 IN THE BURGER KING PARKING LOT AT 125 NE HIGHWAY 19 IN CRYSTAL RIVER. DEPUTY VIGGIANO THEN MADE CONTACT WITH THE DEFENDANT/DRIVER, MR STEVEN DIGIGLIO, WHO WAS ADVISED OF THE REASON FOR THE TRAFFIC STOP. DEPUTY VIGGIANO ISSUED MR DIGIGLIO WRITTEN WARNING, 32812B, FOR INOPERABLE LICENSE PLATE LIGHT. DEPUTY VIGGIANO OBTAINED PERMISSION TO SEARCH THE VEHICLE, AT WHICH TIME HE DISCOVERED FOUR (4) WHITE OVAL PILLS BEARING THE IMPRINT OF 5113V, WHICH WERE LATER IDENTIFIED AS A SCHEDULE FOUR (4) CONTROLLED SUBSTANCE. ALSO LOCATED INSIDE THE VEHICLE WERE ARTICLES WHICH WERE NOT IN THE NAME OF THE DEFENDANTS OR THE PASSENGER. I WAS NOTIFIED BY SEARGENT CASOLA AND PROVIDED WITH A DESCRIPTION OF THE DEFENDANT AND ADVISED OF THE CIRCUMSTANCES. I WAS ALSO PROVIDED WITH A DESCRIPTION OF A METRO VISA CREDIT CARD BEARING THE NAME MR BURUELL VICK. I IMMEDIATELY IDENTIFIED THE LAST NAME AS BELONGING TO A VICTIM OF A VEHICLE BURGLARY WHICH OCCURRED TWO NIGHTS PRIOR. I NOTIFIED THAT VICTIM, MR SHANNON VICK, WHO IDENTIFIED THE ABOVE LISTED CREDIT CARD AS BELONGING TO HIS FATHER. HE FURTHER STATED THE VISA CARD WAS IN HIS WALLET, AND THAT IT WAS STOLEN FROM HIS VEHICLE. SEE CASE 2014-00027523. I ALSO PROVIDED SEARGENT CASOLA WITH A PICTURE OF A POSSIBLE SUSPECT VIA TELEPHONE TAKEN FROM A SURVEILLANCE VIDEO FROM THE PUBLIX IN CRYSTAL RIVER. AT THAT TIME, THE DEFENDANT ATTEMPTED TO MAKE TWO ATM TRANSACTIONS BY USING THE VICTIM’S CREDIT CARD (MR VICK.) I ALSO PROVIDED SEARGENT CASOLA WITH A DESCRIPTION TO INCLUDE TATTOOS ON THE DEFENDANT’S LEFT FOREARM AND THE BACK OF THE DEFENDANT’S LEFT CALF. I WAS THEN ADVISED THAT THE SUBJECT MATCHED THE DESCRIPTION THAT HAD BEEN PROVIDED, AND RESPONDED TO 125 NE HIGHWAY 19 IN CRYSTAL RIVER TO MAKE CONTACT WITH BOTH DEFENDANTS IN THIS CASE. UPON ARRIVAL, BOTH DEFENDANTS WERE READ THEIR MIRANDA RIGHTS BY DEPUTY VIGGIANO, AND BOTH STATED THEY UNDERSTOOD AND AGREED TO SPEAK WITH ME. DEFENDANT ONE, STEVEN DIGIGLIO, STATED THAT HE DID NOT BREAK IN TO ANY VEHICLES, BUT ADMITTED THAT HE FOUND DEBIT/CREDIT CARDS AND USED THEM MULTIPLE TIMES AT VARIOUS ATM MACHINES. I THEN MADE CONTACT WITH DEFENDANT TWO, MS KRISTEN DIGIGLIO. SHE INITIALLY STATED THAT SHE HAD NO KNOWLEDGE OF THE CRIME, BUT LATER STATED SHE WAS PRESENT AND OBSERVED HER HUSBAND (DEFENDANT ONE) ENTER A VEHICLE AT THE MANATEE LANES BOWLING ALLEY AND REMOVE A YELLOW AND WHITE CLOTH PURSE FROM SAID VEHICLE. SHE STATED DEFENDANT ONE THEN PLACED THE CLOTH PURSE NEXT TO HER LEGS IN THE THEIR VEHICLE. SHE STATED THAT SHE AND DEFENDANT ONE THEN LEFT THE AREA AND DROVE TO THE WALGREENS IN CRYSTAL RIVER, WHERE SHE OBSERVED HER HUSBAND ENTER ANOTHER VEHICLE IN THE PARKING LOT. SHE STATED HER HUSBAND (DEFENDANT ONE) THEN REMOVED A TAN IN COLOR CROCHETED PURSE FROM THE VEHICLE. SHE STATED DEFENDANT ONE THEN WENT THROUGH SAID PURSE, THREW SOME ITEMS THAT WERE IN THE PURSE AWAY AND PLACED A BROWN LEATHER CHANGE PURSE INSIDE THEIR VEHICLE. THE CHANGE PURSE WAS SUBSEQUENTLY RECOVERED, POSITIVELY IDENTIFIED BY THE OWNER/VICTIM AND RETURNED TO THE VICTIM. A PROPERTY RECEIPT WAS COMPLETED AND RETURNED TO RECORDS. THE VICTIM STATED THAT SHE AND DEFENDANT ONE THEN DROVE AWAY. I CHECKED THE DEFENDANT’S VEHICLE AND WAS ADVISED BY DEPUTY VIGGIANO OF A BLACK KNAPSACK CONTAINING A UNITED STATES PASSPORT. WHILE CONDUCTING THIS INVESTIGATION, OTHER VICTIMS WERE RESPONDED TO MY LOCATION. I WAS THEN ADVISED BY OTHER DEPUTIES ON SCENE THAT ADDITIONAL REPORTS WERE BEING GENERATED. ONE REPORT (2014-00028426) INVOLVED AN INCIDENT THAT OCCURRED EARLIER AT THE CRYSTAL RIVER HOME DEPOT, AND FIT THE DESCRIPTION OF THE BLACK SWISS KNAPSACK AND THE PASSPORT. THE PASSPORT NAME DID MATCH THE VICTIM’S NAME OF MR SCOTT AMSMUS. ALSO, SAID VICTIM HAD REPORTED $3,100.00 IN CASH TO HAVE BEEN TAKEN FROM THE KNAPSACK, WHICH THE VICTIM ADVISED HE HAD RECEIVED FROM THE SALE OF A VEHICLE. I WAS ADVISED BY DEPUTY VIGGIANO THAT 31 $100.00 BILLS WERE LOCATED IN DEFENDANT STEVEN DIGIGLIOS’ WALLET. THIS CURRENCY, ALONG WITH OTHER CURRENCY THAT WAS COLLECTED FROM DEFENDANT STEVEN DIGIGLIOS’ WALLET, WAS LATER SUBMITTED TO EVIDENCE. A CHECK OF THE DEFENDANTS’ VEHICLE ALSO REVEALED 103 ASSORTED COLLECTIBLE SPORTS CARDS WHICH WERE LOCATED IN THE TRUNK OF THE VEHICLE. THE SPORTS CARDS WERE POSITIVELY IDENTIFIED BY THE VICTIM, MR CHRISTOPHER WEST, (REFERENCE TO THE RESIDENTIAL BURGLARY IN THIS CASE LOCATED AT 1136 NORTH TIGER POINT, LECANTO) AS BELONGING TO HIM. SEE CASE 2014-26874. ALSO RECOVERED FROM THE VEHICLE WAS A BLACK AND GRAY WALLET WITH HEART SHAPED PENDANTS, AND A CITRUS COUNTY LIBRARY CARD BEARING THE NAME OF MS APRIL RICE. I NOTIFIED THE VICTIM VIA TELEPHONE, AT WHICH TIME SHE CONFIRMED THE PROPERTY BELONGED TO HER. THIS PROPERTY WAS LATER SUBMITTED TO EVIDENCE. THE DEFENDANT WAS PLACED UNDER ARREST, HANDCUFFED (DOUBLE LOCKED), BEHIND HER BACK, SECURED IN THE REAR OF MY PATROL VEHICLE AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. UPON ARRIVAL, THE DEFENDANT WAS CHARGED WITH THE ABOVE LISTED CHARGES AND HER BOND WAS SET AT $3,250.00.
