DID UNLAWFULLY AND KNOWINGLY OBTAIN, USE OR ENDEAVOR TO OBTAIN OR USE THE PROPERTY OF THE VICTIM, TO WIT: ONE GOLD NECKLACE WITH A CUSTOM MADE PENDANT CONSISTING OF 16 SMALLER DIAMONDS AND ONE 1½ KARAT MARQUIS DIAMOND, OF THE VALUE OF FIVE THOUSAND DOLLARS ($5,000) OR MORE ($7,000) BUT LESS THAN TEN THOUSAND DOLLARS ($10,000), WITH THE INTENT TO EITHER TEMPORARILY OR PERMANENTLY DEPRIVE THE VICTIM OF A RIGHT TO THE PROPERTY OR A BENEFIT THEREOF, OR DID APPROPRIATE THE SAID PROPERTY TO HER OWN USE OR THE USE OF ANY PERSON NOT ENTITLED THERETO, IN VIOLATION OF FLORIDA STATE STATUTE 812.014(2)(C)(2). ON 072809, THE VICTIM REPORTED A BURGLARY TO THEIR RESIDENCE AND A GRAND THEFT. THEY ADVISED THE RESPONDING DEPUTY THAT THEY KNEW THE IDENTIFICATION OF THE RESPONSIBLE PERSON. THEY FURTHER STATED THAT AN EYE WITNESS WAS PRESENT AT THE RESIDENCE DURING THE TIME OF THE BURGLARY AND THAT THE DEFENDANT HAD KNOCKED ON THE DOOR AND WHEN OPENED BY THE WITNESS (WHO HAD PERSONAL KNOWLEDGE OF THE DEFENDANT'S IDENTITY) HAD PUSHED BY THE WITNESS, RETRIEVED A BUTTER KNIFE FROM THE KITCHEN, WALKED UPSTAIRS TO THE VICTIM'S BEDROOM WHERE THE DOORS WERE LOCKED, AND FORCED THE DOOR OPEN UTILIZING THE BUTTER KNIFE. THE VICTIM FURTHER STATED THAT THEY REQUESTED THE SUSPECT TO LEAVE THE RESIDENCE AND TO STOP WHAT SHE WAS DOING, HOWEVER, THEY WERE IGNORED. THE DEFENDANT THEN WENT DIRECTLY TO THE VICTIM'S CLOSET INTO A LARGE STANDING JEWELRY ARMOIRE AND BEGAN REMOVING JEWELRY. THE WITNESS AGAIN DIRECTED HER TO STOP WHICH SHE IGNORED. THE DEFENDANT THEN LEFT THE RESIDENCE. UPON THE VICTIM'S ARRIVAL HOME, SHE WAS INFORMED WHAT HAD OCCURRED AND FOUND THAT HER GOLD NECKLACE WITH A CUSTOM PENDANT VALUED IN EXCESS OF $7,000 HAD BEEN REMOVED FROM THE JEWELRY ARMOIRE. SHE ALSO FOUND AN ADDITIONAL NECKLACE WHICH HAD BEEN BEHIND THE ONE STOLEN ON THE FLOOR IN FRONT OF THE ARMOIRE. THE VICTIM IS THE STEP-MOTHER OF THE DEFENDANT AND THE DEFENDANT HAS BEEN OUT OF THE RESIDENCE FOR APPROXIMATELY THE LAST THREE YEARS DUE TO A PROBLEM WITH ILLEGAL DRUGS. SHE HAD BEEN TOLD IN THE PAST THAT SHE WAS NOT ALLOWED TO ENTER THE RESIDENCE. ON 073009, THIS DETECTIVE DISCOVERED THAT THE DEFENDANT HAD A TRAFFIC COURT APPOINTMENT AT THE CITRUS COUNTY COURTHOUSE . THIS DETECTIVE THEN RESPONDED TO THE COURTHOUSE WHERE THE DEFENDANT WAS PLACED INTO CUSTODY AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY. THE DEFENDANT WAS READ MIRANDA WARNINGS FROM A PREPRINTED CARD AND STATED SHE DID NOT WISH TO MAKE A STATEMENT. THE DEFENDANT WAS INFORMED SHE WOULD BE CHARGED WITH ONE COUNT OF BURGLARY TO AN OCCUPIED DWELLING AND ONE COUNT OF GRAND THEFT. THE DEFENDANT'S BOND WAS SET AT $17,000 PER THE BOND SCHEDULE. *NOT-EXEMPT*
