SUBMITTED BY: BEHNEN, JONATHAN 0442 (AR08106844) did, knowing HIS driver's license or driving privilege had been cancelled, suspended or revoked, drive a motor vehicle upon the highways of this state while such license or privilege was cancelled, in violation of Florida Statute 322.34(2)(a). ON 122208 AT APPROXIMATELY 1755 HOURS, WHILE TRAVELING NORTHBOUND ON US HIGHWAY 19 IN THE AREA OF NORTH LARUE-DENISE DRIVE, THIS DEPUTY OBSERVED A VEHICLE TRAVELING SOUTHBOUND IN THE SOUTHBOUND LANES OF TRAFFIC THAT APPEARED TO BE EXCEEDING the SPEED LIMIT. I VISUALLY ESTIMATED THE VEHICLE SPEED TO BE BETWEEN 75 AND 80 MILES PER HOUR (MPH). AT THAT TIME, I ACTIVATED MY RADAR AND WITH A STRONG AUDIO DOPPLER TONE MY RADAR CONFIRMED THE VEHICLE'S SPEED TO BE 77 MPH. UPON THE VEHICLE PASSING THIS DEPUTY I ACTIVATED MY REAR RADAR TO WHERE IT ALSO PROVIDED THIS DEPUTY with a 77 MPH READOUT. AT THAT TIME, I ACTIVATED MY EMERGENCY LIGHTS, SAFELY CONDUCTED A U-TURN, AND ATTEMPTED TO CATCH UP TO THE VEHICLE. IT SHOULD BE NOTED THAT THE VEHICLE WAS EASILY VISIBLE AS IT WAS A WHITE VAN WITH AN INOPERABLE RIGHT REAR TAIL LIGHT. THIS DEPUTY CAUGHT UP TO THE LISTED VEHICLE AT THE INTERSECTION OF US HIGHWAY 19 AND NORTH WEST 19TH STREET AND A TRAFFIC STOP WAS CONDUCTED. I MADE CONTACT WITH THE DRIVER OF THE VEHICLE, IDENTIFIED AS THE DEFENDANT PER HIS FLORIDA IDENTIFICATION CARD. THE DEFENDANT WAS ASKED TO PROVIDE A DRIVERS LICENSE, TO which HE STATED HE DID NOT HAVE ONE. I ASKED THE DEFENDANT WHAT HE MEANT BY NOT having A DRIVERS LICENSE, TO which HE STATED HE JUST DID NOT HAVE IT WITH HIM. THE DEFENDANT DID OPEN HIS WALLET WHERE THIS DEPUTY COULD CLEARLY SEE THE TOP PORTION OF A FLORIDA IDENTIFICATION CARD AND THE DEFENDANT WAS ASKED TO PROVIDE THAT CARD TO THIS DEPUTY, WHICH HE COMPLIED. UPON RUNNING THE DEFENDANT'S INFORMATION THROUGH NCIC/FCIC IT REVEALED THAT THE DEFENDANT LICENSE WAS NOT VALID AND HAD THE FOLLOWING INDEFINITE SUSPENSIONS ON 010906, 052907, 032607, 110807, 112107, 020708, 020708, 102008, ALL FOR FAILURE TO PAY A TRAFFIC FINE. THE DEFENDANT WAS THEN ARRESTED HANDCUFFED (DOUBLE LOCKED) BEHIND THE BACK AND SECURED IN THE REAR SEAT OF MY PATROL VEHICLE BY SAFETY HARNESS. PRIOR TO LEAVING the SCENE THE LISTED VEHICLE WAS RELEASED TO THE PASSENGER/OWNER. THE DEFENDANT WAS THEN TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY AND PROCESSED AND BOND WAS SET AT $500.00 PER THE BOND SCHEDULE. THE DEFENDANT WAS ISSUED UNIFORM TRAFFIC CITATION NUMBER 8727-FGW, FOR 77 MPH IN A POSTED 60 MPH ZONE WITH A FINE OF $206.00 PAYABLE WITHIN 30 DAYS. DEFENDANT WAS ALSO ISSUED UNIFORM TRAFFIC CITATION NUMBER 8728-FGW, FOR DRIVING WHILE LICENSE SUSPENDED WITH A MANDATORY COURT DATE OF 011209 AT 0830 HOURS. THE DEFENDANT WAS ALSO ISSUED CITRUS COUNTY SHERIFF'S OFFICE WARNING 241648B, REFERENCE FAULTY EQUIPMENT LIGHT REAR TAIL LIGHT INOPERABLE. IT SHOULD BE NOTED THAT AT ALL TIMES, THE DEFENDANT WAS RESPECTFUL AND COOPERATIVE AND DID NOT ADD ANY NEGATIVE FACTORS TO THIS INCIDENT. *NOT-EXEMPT* |
