Probable cause affidavit: | SUBMITTED BY: SLINGERLAND, DANIEL 0443 (AR13-4260) THE DEFENDANT DID UNLAWFULLY AND KNOWINGLY OBTAIN, USE OR ENDEAVOR TO OBTAIN OR USE THE PROPERTY OF THE VICTIM, TO-WIT: A GO DEVIL BOAT MOTOR, OF THE VALUE OF THREE HUNDRED DOLLARS ($300.00) OR MORE OR MORE BUT LESS THAN FIVE THOUSAND DOLLARS ($5,000.00,) WITH THE INTENT TO EITHER TEMPORARILY OR PERMANENTLY DEPRIVE THE VICTIM OF A RIGHT TO THE PROPERTY OR A BENEFIT THEREOF, OR DID APPROPRIATE THE SAID PROPERTY TO HIS OWN USE OR THE USE OF ANY PERSON NOT ENTITLED THERETO, IN VIOLATION OF FLORIDA STATUTE 812.014(2)(C)(1) ON 012613, THE VICTIM CONTACTED THIS AGENCY TO REPORT THAT HIS GO DEVIL BOAT MOTOR HAD BEEN STOLEN OFF HIS BOAT. DURING THE INVESTIGATION, THE DEFENDANT, MR KRISTOPHER THOMAS LOVAR, WAS IDENTIFIED AS A POTENTIAL SUSPECT. DEPUTY POLLARD RESPONDED TO MR LOVARâS RESIDENCE WHERE HE OBTAINED PERMISSION TO SEARCH THE PROPERTY FROM THE PROPERTY OWNER. AT THAT TIME, DEPUTY POLLARD LOCATED THE DISMANTLED BOAT MOTOR IN SEVERAL LOCATIONS AROUND THE DEFENDANTâS PROPERTY. DEPUTY POLLARD SPOKE WITH AN ANONYMOUS WITNESS WHO STATED THEY HAD OBSERVED THE DEFENDANT ON THE VICTIMâS PROPERTY, WORKING ON THE BOAT MOTOR THAT WAS LATER DISCOVERED STOLEN. THE VICTIM NEVER GAVE THE DEFENDANT PERMISSION TO HAVE THE BOAT MOTOR IN HIS POSSESSION. I WAS ADVISED BY DEPUTY POLLARD THAT HE HAD PROBABLE CAUSE FOR THE ARREST OF THE DEFENDANT. SEE DEPUTY POLLARDâS NARRATIVE FORM FURTHER INFORMATION. ON 012613 AT APPROXIMATELY 1930 HOURS, I MADE CONTACT WITH THE DEFENDANT AT THE CITRUS COUNTY SHERIFFâS OFFICE OPERATIONâS CENTER. THE DEFENDANT ADVISED THAT HE WAS TURNING HIMSELF IN, IN REFERENCE TO THIS CASE. THE DEFENDANT WAS READ HIS MIRANDA WARNINGS FROM A PREPRINTED AGENCY CARD, TO WHICH HE STATED HE UNDERSTOOD HIS RIGHTS AND AGREED TO ANSWER MY QUESTIONS. THE DEFENDANT CONFESSED THAT HE ENTERED THE VICTIMâS PROPERTY ON THURSDAY, 012413, WITHOUT PERMISSION AND THAT HE STOLE THE MOTOR FROM THE VICTIMâS BOAT. THE DEFENDANT STATED HE TOOK THE BOAT MOTOR APART BECAUSE HE WANTED TO USE THE ENGINE ON HIS GO-CART. THE DEFENDANT STATED HE KNEW WHAT HE HAD DONE WAS WRONG AND WAS SORRY FOR HIS ACTIONS. AT THAT TIME, THE DEFENDANT WAS PLACED UNDER ARREST FOR ONE COUNT OF GRAND THEFT. HE WAS HANDCUFFED (DOUBLE LOCKED) BEHIND HIS BACK, SECURED IN THE REAR SEAT OF MY PATROL VEHICLE AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. UPON ARRIVAL, THE DEFENDANT WAS BOOKED AND HELD ON A BOND OF $2,000.00, IN ACCORDANCE WITH THE BOND SCHEDULE. |
