SUBMITTED BY: RODRIGUEZ, RONALD FHP 1817 (AR14-13330) DID UNLAWFULLY AND KNOWINGLY HAVE IN HIS/HER ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: CANNABIS, COMMONLY REFERRED TO AS MARIJUANA, IN AN AMOUNT OF 20 GRAMS OR LESS, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(B). DID UNLAWFULLY HAVE IN HIS/HER ACTUAL OR CONSTRUCTIVE POSSESSION WITH THE INTENT TO USE, OR DID UNLAWFULLY USE, AN OBJECT INTENDED OR DESIGNED FOR USE IN STORING, CONCEALING OR INJECTING, INGESTING, INHALING OR OTHERWISE INTRODUCING INTO THE HUMAN BODY, A CONTROLLED SUBSTANCE, TO WIT: CLEAR AND BLACK PIPE, PURPLE AND CLEAR BOWL, PACKAGE OF WHITE ROLLING PAPERS, PLASTIC 2LITER BOTTLE MODIFIED FOR SMOKING CANNABIS AND MULTIPLE ROACH ENDS, IN VIOLATION OF FLORIDA STATE STATUTE 893.147(1). ON 123114, AT APPROXIMATELY 1845 HOURS, I, TROOPER RONALD RODRIGUEZ, OBSERVED A SILVER CHEVROLET PULLING A TRAILER AT NIGHT WITH NO WORKING TAIL LIGHTS ON THE TRAILER. THE VEHICLE WAS TRAVELING SOUTHBOUND ON US HIGHWAY 19 APPROXIMATELY .5 MILES NORTH OF COUNTY ROAD 488 IN CITRUS COUNTY, FLORIDA. I PROCEEDED TO CONDUCT A TRAFFIC STOP ON THE CHEVROLET FOR THE FAULTY EQUIPMENT VIOLATION. I WALKED UP TO THE DRIVER'S SIDE WINDOW TO ASK FOR THE DRIVER'S LICENSE, REGISTRATION, AND INSURANCE. AS THE DRIVER WAS GETTING THE REQUESTED DOCUMENTS, I SMELLED THE ODOR OF MARIJUANA EMITTING FROM THE VEHICLE. I THEN ASKED THE DRIVER TO STEP OUT OF THE VEHICLE. I ASKED THE DRIVER, IDENTIFIED AS MR KYLE JOSHUA TURNER BY HIS FLORIDA DRIVER'S LICENSE, IF THERE WAS "ANYTHING ILLEGAL IN THE VEHICLE THAT I NEEDED TO KNOW ABOUT?â TO WHICH HE REPLIED "NO.â I TOLD HIM I SMELLED THE ODOR OF MARIJUANA COMING FROM THE VEHICLE. I THEN TOLD HIM THAT I WOULD BE SEARCHING THE VEHICLE AND ASKED HIM AGAIN IF THERE WAS "ANYTHING HE WANTED TO TELL ME ABOUT BEFORE I SEARCHED THE VEHICLE.â HE SAID HE HAD SOME ROACHES IN HIS POCKET AND PULLED OUT A PLASTIC BAG WITH ROACHES AND A PACK OF WHITE ROLLING PAPERS. I ASKED HIM ONCE MORE IF THERE WAS ANYTHING ELSE HE WANTED TO TELL ME ABOUT AND HE REPLIED "NO." AT APPROXIMATELY 1847 HOURS, DEPUTY ROSS WITH THE CITRUS COUNTY SHERIFF'S OFFICE ARRIVED ON SCENE TO PROVIDE BACK-UP. MR TURNER STOOD WITH DEPUTY ROSS AS I SEARCHED THE VEHICLE. I FOUND A PURPLE AND CLEAR "BOWL" ON THE DRIVERSâ SEAT WITH WHAT APPEARED TO BE A BURNT STICKY RESIDUE COMMONLY ASSOCIATED WITH BURNT MARIJUANA. AS I WAS SEARCHING THE VEHICLE THE SMELL OF MARIJUANA GOT STRONGER TOWARDS THE BACK SEAT NEAR THE CENTER. THERE WAS A BROWN JACKET AND A BLACK BOOK BAG IN THE CENTER OF THE SEAT. I SEARCHED THE BLACK BOOK BAG AND FOUND A "BONG" MADE OUT OF A PLASTIC BOTTLE WITH A BURNT STICKY RESIDUE ASSOCIATED WITH MARIJUANA AND ANOTHER BLACK AND CLEAR PIPE. THERE WAS ALSO A VITAMIN BOTTLE WITH APPROXIMATELY 10 ROACHES IN THE BOTTLE. I SEARCHED THE JACKET AND FOUND APPROXIMATELY 5 GRAMS OF WHAT I BELIEVED TO BE MARIJUANA. I TESTED THE LEAFY GREEN SUBSTANCE IN A MARIJUANA TEST KIT AND THE TEST KIT CONFIRMED THAT THE SUBSTANCE WAS MARIJUANA. MR TURNER STATED THAT THE BOOK BAG AND JACKET WERE BOTH HIS. MR TURNER WAS ARRESTED AT APPROXIMATELY 1859 HOURS. HE IS BEING BOOKED INTO THE CITRUS COUNTY DETENTION FACILITY ON THE LISTED CHARGES. THE DEFENDANTâS BOND WAS SET AT A TOTAL OF $ 6,000.00, PER THE BOND SCHEDULE. |
