Probable cause affidavit: SUBMITTED BY: DEARDEN, CHRIS 0363 (AR09112241) did knowingly, willfully and feloniously be in the actual or constructive possession of a controlled substance, to-wit: COCAINE, in violation of Florida Statutes 893.13(6)(B) and 893.03(C)(D) ON 120509 AT 1858 HOURS, I CONDUCTED A TRAFFIC STOP ON A RED FORD TAURUS BEARING FLORIDA TAG 5541HF, THE REASON FOR THE STOP WAS UNLAWFUL SPEED ON HIGHWAY 491 JUST SOUTH OF TRUMAN BOULEVARD DUE TO THE VEHICLE TRAVELING 56 MILES PER HOUR (MPH) IN A 40 MPH ZONE. THE VEHICLE CAME TO STOP IN THE PARKING LOT OF THE WINN DIXIE. CONTACT WAS THEN MADE WITH THE DRIVER WHO WAS IDENTIFIED AS THE DEFENDANT BY HIS FLORIDA DRIVER'S LICENSE. THE DEFENDANT THEN PROVIDED ALL PERTINENT INFORMATION RELATED to the VEHICLE INCLUDING HIS DRIVER'S LICENSE. I THEN RETURNED TO MY VEHICLE WHERE I REQUESTED A BACK UP UNIT RESPOND. WHILE RUNNING THE DEFENDANT THROUGH FCIC/NCIC DEPUTY BEHNEN ARRIVED ON SCENE. I THEN AGAIN MADE CONTACT WITH THE DEFENDANT AND ADVISED HIM THAT I WOULD BE WALKING MY K9 AROUND THE EXTERIOR OF THE VEHICLE. AT WHICH TIME THE DEFENDANT STATED HE DID NOT WANT ME TO DO THAT. I ADVISED THE DEFENDANT THAT I WOULD BE WALKING THE K9 AROUND THE VEHICLE AND REQUESTED HIM TO ROLL UP HIS WINDOWS AND TURN THE VEHICLE OFF, WHICH THE DEFENDANT COMPLIED WITH. I THEN RETRIEVED K9 TYSON FROM MY VEHICLE AND BEGAN AN EXTERIOR SNIFF OF THE VEHICLE, BEGINNING AT THE REAR DRIVER SIDE DOOR AND PROCEEDING IN A COUNTER CLOCKWISE DIRECTION. ONCE AT THE FRONT PASSENGER DOOR K9 TYSON ALERTED TO THE VEHICLE, HE WAS THEN RE SECURED IN MY VEHICLE. I THEN AGAIN MADE CONTACT WITH THE DEFENDANT AND ADVISED HIM THAT THE K9 DID ALERT TO THE VEHICLE AND REQUESTED THE DEFENDANT STEP OUT OF THE VEHICLE. ONCE THE DEFENDANT WAS OUT OF THE VEHICLE HE GAVE CONSENT FOR ME TO SEARCH HIS PERSON. WHILE DOING SO I DISCOVERED THAT THE DEFENDANT WAS WEARING THICK SHORTS UNDERNEATH HIS CAMOUFLAGE PANTS, AS I BEGAN SEARCHING THESE SHORTS THE DEFENDANT ADVISED THAT THEY COULD BE PULLED OUT AND HIS SHORTS WERE PULLED UP SLIGHTLY REVEALING TWO POCKETS. AT THAT TIME NO CONTRABAND WAS FOUND AND I INSTRUCTED THE DEFENDANT TO GO STAND BY DEPUTY BEHNEN AT THE FRONT OF MY PATROL VEHICLE. ONCE THE DEFENDANT WAS BY MY VEHICLE I LOOKED DOWN ON THE GROUND IN THE AREA WHERE THE DEFENDANT WAS JUST SEARCHED AND I FOUND A CLEAR SMALL ZIPLOC BAGGIE WHICH CONTAINED A WHITE POWDERY SUBSTANCE which I BELIEVED TO BE COCAINE. AT THAT TIME I MADE CONTACT WITH THE DEFENDANT AGAIN AND ADVISED HIM HE WAS BEING PLACED UNDER ARREST FOR POSSESSION OF COCAINE. THE DEFENDANT WAS HANDCUFFED (DOUBLE- LOCKED), BEHIND HIS BACK, AND I AGAIN CONDUCTED A SEARCH OF THE DEFENDANT'S PERSON BUT STILL FOUND NO OTHER ITEMS OF CONTRABAND. I THEN REQUESTED A ZONE UNIT RESPOND TO MY LOCATION FOR TRANSPORT. I THEN BEGAN TO COLLECT THE DEFENDANTS PERSONAL INFORMATION WHILE DEPUTY BEHNEN CONDUCTED A SEARCH OF THE INTERIOR OF THE VEHICLE. DEPUTY BEHNEN DID FIND RESIDUAL MARIJUANA, AS WELL AS ANOTHER CLEAR SMALL ZIPLOC BAGGIE WHICH WAS EMPTY, BUT DID APPEAR TO HAVE POSSIBLE COCAINE RESIDUE. A SHORT TIME LATER DEPUTY ANDREA CANFIELD ARRIVED ON SCENE AND THE DEFENDANT WAS SECURED IN THE REAR SEAT OF HER PATROL VEHICLE. DEPUTY CANFIELD THEN TRANSPORTED THE DEFENDANT TO THE CITRUS COUNTY DETENTION FACILITY FOR PROCESSING. I THEN MADE CONTACT WITH THE REGISTERED OWNER of the VEHICLE, WHO WAS THE DEFENDANT'S WIFE. I ADVISED HER OF WHAT WAS GOING ON AND ASKED WHAT SHE WISHED TO DO WITH THE VEHICLE, PER THE OWNERS REQUEST THE KEYS TO THE VEHICLE WERE LEFT IN THE GLOVE BOX AND ALL DOORS WERE LOCKED WITH THE EXCEPTION OF THE REAR PASSENGER DOOR. I THEN RESPONDED TO THE CITRUS COUNTY DETENTION FACILITY, WHILE EN ROUTE DEPUTY CANFIELD ADVISED ME THAT IT APPEARED THE DEFENDANT TRIED TO DISPOSE OF MORE COCAINE AS SOME WAS FOUND ON HER REAR SEAT ALONG WITH PIECES OF A PLASTIC BAGGIE. ONCE AT THE DETENTION FACILITY THESE ITEMS WERE COLLECTED. CONTACT WAS THEN MADE WITH CCA BOOKING OFFICERS WHO CONDUCTED A SEARCH OF THE DEFENDANT. THEY THEN PROVIDED ME WITH ADDITIONAL PLASTIC BAGGIES AND ANOTHER SMALL AMOUNT OF SUSPECTED COCAINE WHICH WAS FOUND IN ONE OF THE DEFENDANTS POCKETS. ALL SUSPECTED COCAINE WAS THEN FIELD TESTED AND WEIGHED. ALL SUSPECTED COCAINE TESTED POSITIVE FOR COCAINE AND WEIGHED 1.3 GRAMS (THIS WEIGHT INCLUDES PLASTIC BAGGIES). ALL ITEMS WERE THEN LATER TURNED INTO EVIDENCE. THE DEFENDANT WAS ISSUED A TOTAL BOND OF $2000.00, PER THE BOND SCHEDULE. THE DEFENDANT WAS ISSUED WARNING NUMBER 271667B FOR UNLAWFUL SPEED. *NOT-EXEMPT*
