SUBMITTED BY: HOLLOWAY, CHRISTOPHER 0696 (AR15-14739) DID UNLAWFULLY COMMIT BATTERY UPON THE VICTIM BY ACTUALLY AND INTENTIONALLY TOUCHING OR STRIKING SAID PERSON AGAINST SAID PERSON'S WILL, OR BY INTENTIONALLY CAUSING BODILY HARM, TO WIT: THE DEFENDANT STRUCK AND SHOVED MR GARAFOLA (VICTIM) INTO MS BEEDE (VICTIM), WHO WAS SITTING AT A TABLE, WHICH CAUSED HER CHAIR TO FLIP; KNOCKING HER TO THE GROUND AND STRIKING HER HEAD, IN VIOLATION OF FLORIDA STATE STATUTE 784.03(1)(A)(1). ON 042515, I WAS DISPATCHED TO 5330 SOUTH STONERIDGE DRIVE, IN INVERNESS, IN REFERENCE TO A PHYSICAL DISPUTE. UPON ARRIVAL, I MADE CONTACT WITH SEVERAL WITNESSES AND MS KATHLEEN BEEDE (VICTIM), WHO ADVISED THAT HER HEAD WAS HURTING, ALONG WITH HER BACK AND LEG, DUE TO A FALL. EMERGENCY MEDICAL SERVICES, MEDIC 126, RESPONDED AND TRANSPORTED MS BEEDE TO CITRUS MEMORIAL HEALTH SYSTEM. DEPUTY CUTLIP (0721) RESPONDED AND ASSISTED THIS DEPUTY. I MADE CONTACT WITH VICTIM, MR FRANK GARAFOLA, AND QUESTIONED HIM IN REGARDS TO WHAT HAD OCCURRED, TO WHICH HE ADVISED THEY WERE HAVING A HOME OWNERâS ASSOCIATION MEETING AND AT THE CONCLUSION OF THE MEETING HIS WIFE, MS EVELYN GARAFOLA, GOT INTO A VERBAL ARGUMENT WITH THE DEFENDANT, MR LARRY MOSELY. AT THAT TIME, THE DEFENDANT APPROACHED THEIR TABLE IN AN AGGRESSIVE AND THREATENING MANNER. AS MR GARAFOLA WENT TO STAND UP, THE DEFENDANT STRUCK HIM IN THE FACE AND SHOVED HIM; CAUSING HIM TO LAND ON MS BEEDE, WHO WAS SITTING AT AN ADJACENT TABLE. THIS IN TURN CAUSED MS BEEDEâS CHAIR TO ROLL BACKWARDS; CAUSING HER TO FLIP OUT OF HER CHAIR, LAND ON THE FLOOR, AND STRIKE HER HEAD; POSSIBLY INJURING HER BACK AND LEG. MR GARAFOLA ADVISED THAT AT NO POINT DID HE STRIKE THE DEFENDANT AND HE WAS ONLY STANDING UP IN ORDER TO STOP THE DEFENDANT FROM APPROACHING HIS WIFE. I SPOKE WITH SEVERAL OF THE WITNESSES, WHOSE STORY CORROBORATED THAT OF MR GARAFOLAâS STATEMENT. THE WITNESSES PROVIDED WRITTEN STATEMENTS. I SPOKE WITH VICTIM, MS BEEDE, VIA TELEPHONE, DUE TO HER BEING TRANSPORTED TO CITRUS MEMORIAL HEALTH SYSTEM DURING MY INVESTIGATION. MS BEEDEâS STORY ALSO CORROBORATED WITH MR GARAFOLAâS STATEMENT. I THEN SPOKE TO THE DEFENDANT, WHO ALSO PROVIDED A WRITTEN STATEMENT. HE ADVISED THAT HE WAS IN A VERBAL ARGUMENT WITH MS GARAFOLA AND AS HE WENT TO HER TABLE TO SPEAK WITH HER HE WAS ATTACKED. DUE TO NO OTHER STATEMENTS CORROBORATING HIS STORY, OTHER THAN HIS WIFE, HE WAS SUBSEQUENTLY ARRESTED FOR BATTERY. THE DEFENDANT WAS THEN HANDCUFFED, (DOUBLE LOCKED) IN FRONT, SECURED IN THE REAR OF MY PATROL VEHICLE, AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY. THE DEFENDANTâS BOND WAS SET AT $1,000.00, PER THE BOND SCHEDULE. DEPUTY CUTLIP TOOK PHOTOGRAPHS OF THE DEFENDANT AND MR GARAFOLA, WHO DENIED EMERGENCY MEDICAL SERVICES TREATMENT. SEE DEPUTY CUTLIPâS CRIME SCENE TECHNICIANâS REPORT FOR FURTHER. MR GARAFOLA WAS PROVIDED WITH AN AGENCY CASE CARD BEARING MY NAME AND THE CASE NUMBER AND ADVISED TO CONTACT THIS AGENCY WITH ANY ADDITIONAL INFORMATION OR QUESTIONS REGARDING THIS CASE. ALL WRITTEN STATEMENTS WERE SUBMITTED TO RECORDS. |
