Probable cause affidavit: SUBMITTED BY : DOYLE, CHAD 0438 (AR1200541) DID UNLAWFULLY AND INTENTIONALLY THREATEN BY WORD OR ACT TO DO VIOLENCE TO THE PERSON OF THE VICTIMS, COUPLED WITH AN APPARENT ABILITY TO CARRY OUT SAID THREAT, AND UTILIZED A DEADLY WEAPON, TO-WIT: A 9 MILLIMETER SEMI AUTOMATIC TAURUS HANDGUN, WITHOUT THE INTENT TO KILL, AND DID AN ACT OR ACTS WHICH CREATED A WELL-FOUNDED FEAR IN THE VICTIMS THAT SUCH VIOLENCE WAS IMMINENT, IN VIOLATION OF FLORIDA STATUTE 784.021(1)(A) ON 040112, I WAS SITTING IN THE PARKING LOT OF THE FORD DEALERSHIP IN CRYSTAL RIVER, FLORIDA, WITH MY WINDOWS DOWN AND VEHICLE TURNED OFF. IT WAS APPROXIMATELY 0200 HOURS AND I DID HEAR EMPLOYEES FROM THE OAR HOUSE SPEAKING LOUDLY TO THE PATRONS THAT WERE STILL HANGING OUT IN THE PARKING LOT INFORMING THEM THAT THEY NEEDED TO CLEAR THE PARKING LOT AND LEAVE. A GROUP OF APPROXIMATELY FIVE TO EIGHT VEHICLES HAD LEFT THE ESTABLISHMENT. AT WHICH TIME, I COULD HEAR A MALE AND FEMALE VOICE YELLING PROFANITIES AT EACH OTHER. AT THIS TIME, I SAW BRIGHT LIGHTS FROM A VEHICLE WHICH WAS COMING FROM THE FRONT OF THE BUSINESS. I THEN HEARD A VEHICLE START UP AND THAT VEHICLE ACCELERATED VERY QUICKLY TOWARDS US HIGHWAY 19. IT TRAVELED APPROXIMATELY FIFTY TO ONE HUNDRED FEET. I THEN HEARD A SCREECHING SOUNDS AS THE BRAKES WERE APPLIED. AT THIS TIME, I HEARD APPROXIMATELY FIVE GUNSHOTS. AT WHICH TIME, I STARTED MY VEHICLE AND BEGAN DRIVING TOWARDS THE OAR HOUSE RESTAURANT. AS I WAS DOING THIS, I NOTIFIED DISPATCH THAT I WAS RESPONDING TO THE OAR HOUSE IN REFERENCE TO SHOTS BEING FIRED. AS I GOT CLOSER, THE VEHICLE IN QUESTION STARTED TO DRIVE OFF AND DID A U-TURN IN THE NEXT MEDIAN BRAKE JUST NORTH OF THE OAR HOUSE RESTAURANT. AT THIS TIME, I BRIEFLY STOPPED IN FRONT OF THE RESTAURANT WITH MY PASSENGER WINDOW OPEN; I COULD SEE THREE MALES RUNNING AROUND OUT FRONT. THEY WERE ALL YELLING AT THE VEHICLE AND POINTING AT IT. THE VEHICLE WAS NOW GOING SOUTH ON HIGHWAY 19. I ALSO INQUIRED IF ANYBODY HAD BEEN HIT TO WHICH THEY STATED NO. I THEN CUT THROUGH THE MEDIAN AND GOT BEHIND THE VEHICLE. AT WHICH TIME, I PROVIDED DISPATCH WITH THE LICENSE PLATE OF FLORIDA US RESERVE LICENSE PLATE 3449, AND ALSO ADVISED THEM THAT IT WAS ON A GRAY IN COLOR HONDA. WHILE WAITING FOR ADDITIONAL UNITS, THE VEHICLE MADE A RIGHT TURN ONTO STATE PARK STREET AND THEN MADE A LEFT TURN INTO THE REAR PARKING LOT OF THE DAYS INN HOTEL. THE VEHICLE THEN BEGAN TO PARK AT THE END OF THE PARKING LOT. AS THE VEHICLE WAS PULLING INTO THE SPACE, I ACTIVATED MY EMERGENCY RED AND BLUE LIGHTS AND CONDUCTED A FELONY TRAFFIC STOP. I THEN STARTED YELLING TOWARDS THE DRIVER AND GIVING THE DRIVER COMMANDS TO EXIT THE VEHICLE. WHILE DOING THIS, I DID HAVE MY DUTY WEAPON OUT AND POINTED TOWARDS THE VEHICLE. AS I WAS DOING THIS, DEPUTY CRIDLAND ARRIVED ON SCENE AND TOOK UP A POSITION TOWARDS MY RIGHT ON THE PASSENGER SIDE OF MY VEHICLE. AT THIS TIME, I HAD THE DRIVER, WHICH WAS A WHITE FEMALE, LATER IDENTIFIED AS THE DEFENDANT MS LEANNE ALMYDA, STEP AWAY FROM THE VEHICLE AND LAY FACE DOWN ON THE GROUND WITH HER ARMS SPREAD OUT TO THE SIDE. WHILE I HAD THE VEHICLE AND THE DEFENDANT COVERED, DEPUTY CRIDLAND BEGAN TO MOVE TOWARD THE VEHICLE. I ASKED THE DEFENDANT IF THERE WAS ANYBODY ELSE IN THE VEHICLE TO WHICH SHE RESPONDED NO. AT THIS TIME, DEPUTY CRIDLAND CLEARED THE VEHICLE AND MOVED OVER TOWARDS THE DEFENDANT. AS HE WAS PLACING HER IN HANDCUFFS, THE DEFENDANT MADE THE STATEMENT THAT SHE THREW THE GUN TOWARDS THE FRONT OF HER VEHICLE BY THE EMPTY BOAT TRAILER. SHE ALSO STATED THAT HER CONCEALED WEAPONS PERMIT WAS IN HER WALLET IN HER VEHICLE (PERMIT WAS LATER FOUND TO BE VALID OUT OF FLORIDA WITH AN EXPIRATION DATE OF 080716 PERMIT NUMBER IS WX2909426). AFTER WE SECURED THE DEFENDANT, I THEN LOCATED A BLACK TAURUS 9 MILLIMETER HANDGUN APPROXIMATELY SEVEN FEET IN FRONT OF THE DEFENDANT’S VEHICLE. THE GUN WAS LYING IN THE GRASS BESIDE THE EMPTY BOAT TRAILER. AFTER I PHOTOGRAPHED THE GUN WHERE IT WAS, I THEN CLEARED IT. THE GUN HAD ONE ROUND IN THE CHAMBER AND TWO ROUNDS IN THE MAGAZINE. THE GUN ALSO SMELLED LIKE IT HAD RECENTLY BEEN FIRED. WHILE I WAS COLLECTING THE GUN, THE DEFENDANT STARTED TALKING ABOUT HOW SHE WAS ASSISTING THE BAR IN TRYING TO GET TWO OCCUPANTS OUT OF THE FEMALE RESTROOM AND ALSO MADE A STATEMENT THAT THE BARTENDER OR BOUNCER HAD BEEN YELLING AT HER. SHE THEN QUESTIONED WHY SHE WAS BEING ARRESTED BECAUSE SHE WAS ON PUBLIC PROPERTY WHEN SHE FIRED HER GUN. AT THIS TIME, THE DEFENDANT WAS INFORMED THAT SHE WAS BEING PLACED UNDER ARREST FOR AGGRAVATED ASSAULT WITH A FIREARM AND SHE WAS PLACED IN THE REAR OF MY PATROL VEHICLE. WRITTEN STATEMENTS WERE OBTAINED FROM WITNESSES AND VICTIMS ON SCENE. MR JEREMIAH COHN STATED THAT HE ASKED THE DEFENDANT TO LEAVE THE BAR BECAUSE THEY WERE CLOSED. SHE TRIED TO TAKE HER DRINK WITH HER. HE STATED THAT SHE CONTINUED TO REFUSE AND STARTED YELLING AND CALLING THEM NAMES, AND AT ONE POINT STATED SHE HAD SOMETHING FOR THEM IN HER VEHICLE. HE SAID SHE HAD GOTTEN INTO HER VEHICLE AND STARTED TO PULL AWAY WHEN SHE STOPPED AND STARTED FIRING SHOTS. MR CLINTON HINSON STATED THAT SHE LEFT AND WAS ANGRY BECAUSE SHE WAS TOLD TO LEAVE AND NOT TO COME BACK. HE ALSO STATED THAT THE DEFENDANT MADE THE STATEMENT THAT SHE HAD SOMETHING FOR THEM IN HER VEHICLE. HE SAID SHE GOT INTO HER VEHICLE AND PULLED UP APPROXIMATELY FIFTY FEET AND SHOT AT LEAST FIVE TIMES TOWARD THE BUSINESS WHERE THEY WERE STANDING. MR JOSEPH PELHAM ALSO STATED THAT HE WAS THERE WHEN THE DEFENDANT WAS ASKED TO LEAVE AND SHE MADE THE STATEMENT THAT SHE HAD SOMETHING FOR THEM. HE SAID AT THAT TIME SHE PULLED OUT A GUN AND SHOT TOWARDS THEM AS THEY WERE STANDING AT THE SIDE DOOR OF THE BUSINESS. MR JOSHUA TAYLOR STATED THAT HE WAS OUTSIDE AT A FRIEND’S TRUCK GETTING READY TO LEAVE WHEN THE DEFENDANT AND EMPLOYEES WERE ARGUING. AS HE WAS GETTING READY TO LEAVE HE HEARD GUNSHOTS. HE ALSO STATED THAT HE WATCHED THE DEFENDANT POINT THE GUN TOWARDS THE BUILDING WHILE FIRING. SHE THEN GOT IN HER VEHICLE AND DROVE AWAY. AT THIS TIME A VEHICLE INVENTORY WAS DONE OF THE DEFENDANT’S VEHICLE, WHERE TWO MORE LONG GUNS WERE FOUND IN THE DEFENDANT’S VEHICLE. THE GUNS WERE TAKEN FOR SAFE KEEPING DUE TO THE DEFENDANT’S VEHICLE BEING TOWED. DEPUTY CRIDLAND AND DEPUTY DERA THEN RESPONDED TO THE OAR HOUSE RESTAURANT WERE THEY WERE ABLE TO RECOVER EIGHT WINCHESTER LUGER 9 MILLIMETER SPENT CASINGS FROM THE FRONT OF THE BUSINESS. AT THIS TIME, THE DEFENDANT WAS TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY WERE SHE WAS BOOKED AND PROCESSED. THE DEFENDANT’S BOND WAS SET AT $7,000.00 PER THE BOND SCHEDULE.
