CASE NUMBER 2016-00096530 \tSUBMITTED BY: SEFFERN, JONATHAN JR 0623 (AR16-20265) DID UNLAWFULLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO-WIT: HEROIN AND DIGITAL SCALE, WITH THE INTENT TO SELL THE SAID SUBSTANCE TO ANOTHER PERSON, IN VIOLATION OF FLORIDA STATUTE 893.13(1)(A)(1); DID UNLAWFULLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO-WIT: COCAINE AND DIGITAL SCALE, WITH THE INTENT TO SELL THE SAID SUBSTANCE TO ANOTHER PERSON, IN VIOLATION OF FLORIDA STATUTE 893.13(1)(A)(1); \tDID UNLAWFULLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION WITH THE INTENT TO USE, OR DID UNLAWFULLY USE, AN OBJECT INTENDED OR DESIGNED FOR USE IN STORING, CONCEALING OR INJECTING, INGESTING, INHALING OR OTHERWISE INTRODUCING INTO THE HUMAN BODY, A CONTROLLED SUBSTANCE, TO WIT: METHAMPHETAMINE PIPES, HYPODERMIC NEEDLES, METHAMPHETAMINE BONG AND METAL SPOONS, IN VIOLATION OF FLORIDA STATE STATUTE 893.147(1). \t\t ON 07152016, THE CITRUS COUNTY SHERIFF'S OFFICE (CCSO) TACTICAL IMPACT UNIT PERFORMED A SEARCH WARRANT INVESTIGATION WHICH WAS CONDUCTED IN CITRUS COUNTY LOCATED AT 1570 SOUTH IROQUOIS AVENUE, HOMOSASSA, CITRUS COUNTY, FLORIDA, 34448. YOUR AFFIANT PREVIOUSLY CONDUCTED AN INVESTIGATION AND DEVELOPED PROBABLE CAUSE FOR A SEARCH WARRANT AFFIDAVIT, WHICH WAS REVIEWED AND SIGNED BY THE HONORABLE JUDGE THOMAS R EINEMAN FOR THE AFOREMENTIONED RESIDENCE. ON 07152016 AT APPROXIMATELY 1030 HOURS, MEMBERS OF THE CITRUS COUNTY SHERIFFS OFFICE TACTICAL IMPACT UNIT RESPONDED TO THE RESIDENCE LOCATED AT 1570 SOUTH IROQUOIS AVENUE, HOMOSASSA, CITRUS COUNTY, FLORIDA, 34448. UPON OUR ARRIVAL, MEMBERS OF THE TACTICAL IMPACT UNIT APPROACHED THE RESIDENCE AND ANNOUNCED THEMSELVES. ONCE CONTACT WAS MADE WITH THE OCCUPANTS OF THE RESIDENCE, MR LEO MANNING RADFORD AND MS RACHAEL WRIGHT, ALONG WITH THE LANDLORDS MR MARK SAMUEL ALAIMO AND MR MICHAEL WAYNE DALRYMPLE. ALL SUBJECTS WERE HANDCUFFED AND RELOCATED OUTSIDE OF THE HOME AND WERE SEATED IN A CHAIR. THE REMAINDER OF THE RESIDENCE WAS RENDERED SAFE AND SECURED BY MEMBERS OF THE TACTICAL IMPACT UNIT, WITHOUT LOCATING ANY FURTHER OCCUPANTS. YOUR AFFIANT THEN BEGAN A DIGITALLY RECORDED AUDIO RECORDING AND READ THE SEARCH WARRANT IN ITS ENTIRETY TO MR LEO MANNING RADFORD, MS RACHAEL WRIGHT, MR MARK SAMUEL ALAIMO, AND MR MICHAEL WAYNE DALRYMPLE TO WHICH EACH OF THEM ADVISED THAT THEY UNDERSTOOD. YOUR AFFIANT THEN INDIVIDUALLY READ THEM THEIR MIRANDA WARNINGS VIA A PRE PRINTED AGENCY ISSUED MIRANDA CARD TO WHICH EACH ADVISED THAT THEY UNDERSTOOD THEIR RIGHTS AND WISHED TO SPEAK WITH ME. IT WAS EXPLAINED TO EACH INDIVIDUAL THAT AS PART OF THE PARAMETERS OF THE SEARCH WARRANT, MEMBERS OF THE TACTICAL IMPACT UNIT WOULD BE CONDUCTING A SEARCH OF THE RESIDENCE, TO WHICH EACH OF THEM ADVISED THAT THEY UNDERSTOOD AND REMAINED OUTSIDE SEATED IN THEIR CHAIRS, IN THE PRESENCE OF DEPUTY JAMES SUDLOW. AT THAT TIME A DIGITALLY RECORDED CUSTODIAL INTERVIEW WAS CONDUCTED WITH MR LEO MANNING RADFORD WHO ADVISED THAT MR MARK SAMUEL ALAIMO AND MR MICHAEL WAYNE DALRYMPLE WERE HIS LANDLORDS AND DID NOT RESIDE AT THE RESIDENCE. MR RADFORD ADVISED THAT HE WANTED TO BE HONEST DURING THIS INTERVIEW AND EXPLAINED THAT HE HAD A SMALL AMOUNT OF HEROIN AND COCAINE ALONG WITH A SCALE, HYPODERMIC NEEDLES AND A PIPE IN HIS BEDROOM. MR RADFORD EXPLAINED THAT HIS BEDROOM WAS THE FAR NORTH BEDROOM LOCATED WITHIN THE RESIDENCE. MR RADFORD STATED THAT HE SELLS THE HEROIN AND COCAINE WITH THE MOST RECENT TRANSACTION CONDUCTED BY HIM BEING APPROXIMATELY TWO DAYS PRIOR TO THIS DATE. HE FURTHER EXPLAINED THAT ALL OF THE NARCOTICS AND PARAPHERNALIA LOCATED IN HIS RESIDENCE BELONGED TO HIM. MR RADFORD FURTHER EXPLAINED THAT HIS WIFE MS RACHAEL WRIGHT HAD NO KNOWLEDGE OF HIS NARCOTICS ACTIVITIES. UNIT MEMBERS THEN BEGAN A SEARCH OF THE RESIDENCE, WHICH RESULTED IN LOCATING THE FOLLOWING ITEMS: DETECTIVE LUDLOW LOCATED A SMALL BAGGIE CONTAINING A WHITE POWDERY SUBSTANCE THAT HE WAS ABLE TO IDENTIFY AS COCAINE THROUGH HIS TRAINING AND EXPERIENCE IN THE TOP NIGHT STAND DRAWER WITHIN THE MASTER BEDROOM. THE SUBSTANCE WAS FIELD TESTED BY DETECTIVE PERRY UTILIZING A PRESUMPTIVE FIELD TEST KIT WHICH RESULTED IN A POSITIVE RESULT FOR THE PRESENCE OF COCAINE. DETECTIVE LUDLOW LOCATED A SMALL BAGGIE CONTAINING AN OFF WHITE POWDERY SUBSTANCE THAT HE WAS ABLE TO IDENTIFY AS HEROIN THROUGH HIS TRAINING AND EXPERIENCE IN THE TOP NIGHT STAND DRAWER WITHIN THE MASTER BEDROOM. THE SUBSTANCE WAS FIELD TESTED BY DETECTIVE PERRY UTILIZING A PRESUMPTIVE FIELD TEST KIT WHICH RESULTED IN A POSITIVE RESULT FOR THE PRESENCE OF HEROIN. DETECTIVE LUDLOW LOCATED A SILVER SPOON CONTAINING A WHITE POWDERY SUBSTANCE THAT HE WAS ABLE TO IDENTIFY AS COCAINE THROUGH HIS TRAINING AND EXPERIENCE IN THE TOP NIGHT STAND DRAWER WITHIN THE MASTER BEDROOM. THE SUBSTANCE WAS FIELD TESTED BY DETECTIVE PERRY UTILIZING A PRESUMPTIVE FIELD TEST KIT WHICH RESULTED IN A POSITIVE RESULT FOR THE PRESENCE OF COCAINE. THE SUBSTANCE WAS REMOVED FROM THE SPOON AND PACKAGED SEPARATELY FOR LATER SUBMISSION INTO EVIDENCE. DETECTIVE LUDLOW LOCATED A SILVER SPOON CONTAINING AN OFF WHITE POWDERY SUBSTANCE THAT HE WAS ABLE TO IDENTIFY AS HEROIN THROUGH HIS TRAINING AND EXPERIENCE IN THE MASTER BEDROOM CLOSET. THE SUBSTANCE WAS FIELD TESTED BY DETECTIVE PERRY UTILIZING A PRESUMPTIVE FIELD TEST KIT WHICH RESULTED IN A POSITIVE RESULT FOR THE PRESENCE OF HEROIN. THE SUBSTANCE WAS REMOVED FROM THE SPOON AND PACKAGED SEPARATELY FOR LATER SUBMISSION INTO EVIDENCE. DETECTIVE LUDLOW LOCATED GLASS METHAMPHETAMINE PIPE AND A HOMEMADE BONG IN THE MASTER BEDROOM. THE GLASS PIPE AND HOMEMADE BONG WERE FIELD TESTED BY DETECTIVE PERRY UTILIZING A PRESUMPTIVE FIELD TEST KIT WHICH RESULTED IN A POSITIVE RESULT FOR THE PRESENCE OF METHAMPHETAMINE. DETECTIVE LUDLOW LOCATED THREE HYPODERMIC NEEDLES IN THE MASTER BEDROOM. THE HYPODERMIC NEEDLES WERE FIELD TESTED BY DETECTIVE PERRY UTILIZING A PRESUMPTIVE FIELD TEST KIT WHICH RESULTED IN A POSITIVE RESULT FOR THE PRESENCE OF HEROIN. DETECTIVE LUDLOW LOCATED A SMALL DIGITAL SCALE IN THE MASTER BEDROOM. DETECTIVE RUBY LOCATED A BROKEN GLASS METHAMPHETAMINE PIPE IN THE KITCHEN VASE. THE PIPE WAS FIELD TESTED BY DETECTIVE PERRY WHICH RESULTED IN A POSITIVE RESULT FOR THE PRESENCE OF METHAMPHETAMINE. ALL ITEMS OF EVIDENTIARY VALUE WERE COLLECTED, PACKAGED IN ACCORDANCE WITH AGENCY POLICY AND TURNED INTO THE CITRUS COUNTY SHERIFFS OFFICE EVIDENCE LOCKER BY DETECTIVE PERRY. MR RADFORD WAS THEN PLACED UNDER ARREST, HANDCUFFED BEHIND HIS BACK (DOUBLE LOCKED) AND SECURED IN THE REAR SEAT OF DEPUTY JAMES SUDLOWâS PATROL VEHICLE. THE DEFENDANT WAS TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY AND WAS TURNED OVER TO DETENTION FACILITY STAFF FOR BOOKING AND PROCESSING. THE DEFENDANT WAS CHARGED WITH TWO COUNTS POSSESSION OF A CONTROLLED SUBSTANCE (HEROIN, COCAINE) WITH INTENT TO SELL / DELIVER WITH A BOND OF $5,000.00 EACH AND ONE COUNT POSSESSION OF NARCOTICS PARAPHERNALIA WITH A BOND OF $1,000.00 FOR A TOTAL BOND AMOUNT OF $11,000.00 PER THE BOND SCHEDULE. |
