Probable cause affidavit: | SUBMITTED BY: FERNANDEZ, CARL 1425 (AR16-21570) DID UNLAWFULLY AND KNOWINGLY OBTAIN OR USE, OR ENDEAVOR TO OBTAIN OR USE THE PROPERTY OF THE VICTIM, BEALLS DEPARTMENT STORE, TO WIT: MISCELLANEOUS JUNIORS CLOTHING, SAID PROPERTY BEING OF A VALUE OF OVER $100.00 AND LESS THAN $300.00 WITH THE INTENT TO EITHER TEMPORARILY OR PERMANENTLY DEPRIVE THE VICTIM OF A RIGHT TO THE PROPERTY OR A BENEFIT THEREOF, OR DID APPROPRIATE THE SAID PROPERTY TO HIS OWN USE OR THE USE OF ANY PERSON NOT ENTITLED THERETO, THUS THE OFFENDER COMMITS PETIT THEFT OF THE FIRST DEGREE, PUNISHABLE AS A MISDEMEANOR OF THE FIRST DEGREE AS PROVIDED IN FLORIDA STATE STATUTE, 812.014(2)(E) Retail ON 112516, AT APPROXIMATELY1450 HOURS, I RESPONDED TO THE BEALLS DEPARTMENT STORE LOCATED AT 2851 EAST GULF TO LAKE HIGHWAY IN INVERNESS, IN REFERENCE TO A REPORTED THEFT. UPON ARRIVAL, I MADE CONTACT WITH THE BEALLSâ LOSS PREVENTION OFFICER, MR MATTHEW PIETROBURGO, (COMPLAINANT). HE INFORMED ME THAT HE HAD A MALE SUBJECT IN THE LOSS PREVENTION OFFICE IN REFERENCE TO STEALING SOME ITEMS. THE COMPLAINANT FURTHER INFORMED ME THAT UPON VIEWING THE STORE VIDEO SURVEILLANCE, HE OBSERVED A WHITE MALE SUBJECT WITH RED HAIR AND A HUSKY BUILD, LATER IDENTIFIED AS THE DEFENDANT, MR LEONARD MAYLE. THE COMPLAINANT EXPLAINED THAT AT APPROXIMATELY 1440 HOURS, HE OBSERVED THE DEFENDANT MAKE SOME SELECTIONS FROM THE JUNIOR DEPARTMENT. HE ADVISED HE OBSERVED THE DEFENDANT SELECT A PAIR OF JEANS WHICH HE THEN PLACED INSIDE A SHOPPING CART THAT ALREADY CONTAINED A BEALLS PLASTIC SHOPPING BAG. THE DEFENDANT IS THEN SEEN ENTERING THE SHOE DEPARTMENT WHERE HE CONCEALED THE MERCHANDISE HE HAD SELECTED INSIDE A BEALLS PLASTIC SHOPPING BAG. THE DEFENDANT THEN EXITED THE STORE WITH THE CONCEALED MERCHANDISE, AFTER PASSING ALL POINTS OF SALE AND MAKING NO ATTEMPT TO PAY FOR THE MERCHANDISE HE HAD CONCEALED. I COLLECTED A COPY OF THE DVD SURVEILLANCE FOOTAGE OF THIS INCIDENT WHICH I WILL SUBMIT TO EVIDENCE. I COLLECTED A RECEIPT SHOWING ALL THE MERCHANDISE SELECTED AND NOT PAID FOR BY THE DEFENDANT WHICH I WILL SUBMIT TO RECORDS. THE COMPLAINANT PROVIDED A SWORN WRITTEN STATEMENT OF THE INCIDENT FOR SUBMISSION TO RECORDS. THE COMPLAINANT WAS PROVIDED WITH THIS CASE NUMBER. THE DEFENDANT WAS SUBSEQUENTLY PLACED UNDER ARREST, HANDCUFFED (DOUBLE LOCKED) BEHIND HIS BACK AND SECURED IN THE REAR OF MY PATROL VEHICLE FOR TRANSPORT TO THE CITRUS COUNTY DETENTION FACILITY. UPON ARRIVAL, THE DEFENDANT WAS TURNED OVER TO THE DETENTION STAFF FOR BOOKING AND PROCESSING. THE DEFENDANTâS BOND WAS SET AT $500.00 FOR THE ABOVE LISTED CHARGE. |
