Probable cause affidavit: | SUBMITTED BY: TITUS, JOSHUA 1243 (AR15-15152) DID DRIVE OR WAS IN ACTUAL PHYSICAL CONTROL OF A VEHICLE WHILE UNDER THE INFLUENCE OF AN ALCOHOLIC BEVERAGE, MODEL GLUE OR ANY SUBSTANCE CONTROLLED UNDER CHAPTER 893 OR CHAPTER 877.111 TO THE EXTENT HIS/HER NORMAL FACULTIES WERE IMPAIRED, IN VIOLATION OF FLORIDA STATE STATUTE 316.193(1). ON 052515, I RESPONDED TO TURNER CAMP ROAD AND DEER RUN IN INVERNESS, IN REFERENCE TO A TRAFFIC STOP THAT WAS CONDUCTED BY DEPUTY VENTIMIGLIA. UPON ARRIVAL, DEPUTY VENTIMIGLIA ADVISED ME THAT THE DRIVER, MS LINDA MANNING, WAS INVOLVED IN AN ACCIDENT IN THE AREA OF SHELTERING OAKS DRIVE WHERE SHE WAS RESPONDING. AT THAT TIME SHE OBSERVED MS MANNING LEAVING THE AREA WHERE SHE THEN TURNED AROUND AND FOLLOWED MS MANNING. DEPUTY VENTIMIGLIA OBSERVED MS MANNINGâS VEHICLE, WHICH WAS A MARION COUNTY VEHICLE BEARING TAG NUMBER 225413. SHE OBSERVED THE VEHICLE GO OFF THE ROADWAY TWO TIMES AND AT THAT TIME SHE CONDUCTED A TRAFFIC STOP WHERE IT TOOK MS MANNING AWHILE TO COME TO A COMPLETE STOP. AT THAT TIME, I ARRIVED ON SCENE WHERE I CONDUCTED TRAFFIC CRASH INVESTIGATION. I MADE CONTACT WITH DEPUTY BYRD, WHO WAS AT THE INCIDENT LOCATION, WHICH WAS NEAR 41 NORTH SHELTERING OAKS. HE ADVISED THAT MS MANNING STRUCK A GARBAGE CAN AND HER MIRROR WAS FOUND BY THE CAN. AT THAT TIME, THE MIRROR WAS MATCHED WITH THE VEHICLE. WHEN MS MANNING WAS ASKED IF SHE WAS INVOLVED IN AN ACCIDENT, SHE ADVISED THAT SHE WAS NOT AND SHE DOES NOT KNOW HOW THE MIRROR CAME TO BE BROKEN OFF. AT THAT TIME, I INFORMED MS MANNING THAT THE TRAFFIC CRASH INVESTIGATION WAS COMPLETE AND IT WAS NOW A DRIVING UNDER INFLUENCE (DUI) INVESTIGATION. DEPUTY HUNTER THEN CONDUCTED FIELD SOBRIETY TASKS ON MS MANNING. I OBSERVED HER COMPLETE THE TESTS POORLY. DURING THE INVESTIGATION, MS MANNING WAS COMPLAINING OF HAVING HIGH BLOOD SUGAR AND BEING INSULIN DEPENDENT AND NOT HAVING ANYTHING TO EAST. AT THAT TIME, A MEDIC UNIT RESPONDED AND CHECKED MS MANNINGâS BLOOD SUGAR, WHICH WAS 269. THEY ADVISED THAT SHE WAS ABLE TO CONTINUE. AFTER DEPUTY HUNTER COMPLETED THE FIELD SOBRIETY TASKS, MS MANNING WAS PLACED UNDER ARREST. SHE WAS HANDCUFFED (DOUBLE LOCKED) BEHIND THE BACK, PLACED IN THE REAR SEAT OF MY PATROL VEHICLE. SHE WAS THEN TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR PROCESSING. THE DEFENDANT WAS ISSUED FLORIDA UNIFORM TRAFFIC CITATION NUMBER A1E1QEP, FOR LEAVING SCENE ATTENDED PROPERTY DAMAGE, FLORIDA STATUTE NUMBER 316.061(1). THE DEFENDANT REFUSED TO SUBMIT TO THE APPROVED TEST OF HER BREATH. THE DEFENDANTâS BOND WAS SET AT $1,000.00, PER THE BOND SCHEDULE. |
