SUBMITTED BY: FIELD, GEOFF 0620 (AR08102293) DID UNLAWFULLY COMMIT BATTERY UPON THE VICTIM BY ACTUALLY AND INTENTIONALLY TOUCHING OR STRIKING SAID PERSON AGAINST SAID PERSON'S WILL, OR BY INTENTIONALLY CAUSING BODILY HARM, TO WIT: BY SLAPPING AND PUNCHING BOTH VICTIMS, IN VIOLATION OF FLORIDA STATE STATUTE 784.03(1)(A)(1). ON 032207, AT APPROXIMATELY 1223 HOURS, I RESPONDED TO 2747 EAST MERCURY STREET IN REFERENCE TO A DISTURBANCE. UPON ARRIVAL, I SPOKE WITH THE DEFENDANT, MS LINDA SRAMEK, WHO STATED SHE WANTED TO RETRIEVE HER PERSONAL ITEMS FROM THE RESIDENCE AND WAS IN FEAR OF THE MALE VICTIM. CORPORAL AMSLER ARRIVED ON SCENE AND ADVISED HE WOULD SPEAK WITH THE DEFENDANT WHILE I SPOKE WITH THE MALE VICTIM. THE DEFENDANT DID ADVISE ME THAT THE MALE VICTIM WOULD LIE TO ME IF I SPOKE TO HIM. THE DEFENDANT WAS VERY UNCOOPERATIVE AND APPEARED TO BE UNDER THE INFLUENCE OF ALCOHOL AND/OR DRUGS. I THEN RESPONDED INSIDE THE RESIDENCE AND SPOKE WITH THE MALE VICTIM, WHO STATED THE DEFENDANT HAD THROWN A GLASS INTO THE SINK WHICH CAUSED IT TO BREAK. HE STATED AFTER THAT, SHE WENT AROUND THE COUNTER AND INTO THE KITCHEN AND BEGAN STRIKING THE FEMALE VICTIM WITH HER HANDS. THE MALE VICTIM STATED HE TRIED TO RESTRAIN THE DEFENDANT, AT WHICH TIME, SHE BEGAN HITTING HIM WITH HER FISTS. THE MALE VICTIM STATED THE SUSPECT THEN ATTEMPTED TO LEAVE THE RESIDENCE AND WHILE DOING SO, SHE FELL ON THE FLOOR, GOT UP, AND THEN FELL OUT THE FRONT DOOR, STUMBLING DOWN THE STEPS. THE MALE VICTIM STATED HE WOULD SEEK PROSECUTION. I DID OBSERVE A SMALL CUT ACROSS THE BRIDGE OF THE MALE VICTIM'S NOSE; HOWEVER, HE REFUSED MEDICAL TREATMENT. I THEN MADE CONTACT WITH the FEMALE VICTIM WHO STATED SHE HAD BEEN WASHING DISHES IN THE KITCHEN WHEN THE DEFENDANT THREW A CUP INTO THE SINK CAUSING IT TO BREAK. THE FEMALE VICTIM STATED that THE DEFENDANT THEN GRABBED A PIECE OF THE BROKEN CUP AND SWUNG IT AT HER. THE FEMALE VICTIM STATED THE DEFENDANT THEN DROPPED THE BROKEN CUP AND SLAPPED AND PUNCHED HER. she STATED THE MALE VICTIM ATTEMPTED TO HOLD BACK THE DEFENDANT FROM HITTING HER, AT WHICH TIME, THE DEFENDANT STARTED ATTACKING THE MALE VICTIM. THE FEMALE VICTIM STATED THAT the DEFENDANT THEN STARTED SLIPPING AND FALLING AND FELL OUT THE DOOR, STUMBLING DOWN THE STEPS. THE FEMALE VICTIM STATED THAT SHE ALSO WOULD LIKE TO SEEK PROSECUTION. I DID NOT OBSERVE ANY TYPE OF INJURIES TO THE FEMALE VICTIM. APPROXIMATELY FIVE MINUTES BEFORE I WAS DISPATCHED TO THIS CALL, I WAS AT thIS RESIDENCE REGARDING A VERBAL DISTURBANCE. DURING THE PREVIOUS CALL, THE DEFENDANT HAD STATED SHE WANTED TO GET HER BELONGINGS. I ASKED THE DEFENDANT TO GO AHEAD AND GRAB HER BELONGINGS WHILE I WAS PRESENT AND THAT I WOULD STAND BY UNTIL SHE GOT EVERYTHING SHE NEEDED. THE DEFENDANT WAS VERY UNCOOPERATIVE AND FAILED TO GET HER BELONGINGS AS I HAD INSTRUCTED HER TO DO SO. SEVERAL TIMES, I REQUESTED SHE GET HER BELONGINGS; HOWEVER, SHE CONTINUED TO BE VERY UNCOOPERATIVE AND ARGUMENTATIVE. I FINALLY ADVISED the DEFENDANT THAT I COULD NO LONGER STAY AT THE RESIDENCE AND I ADVISED HER THAT IF SHE WAS AFRAID OF THE VICTIM, SHE WAS TO GET HER BELONGINGS TOGETHER WHILE I WAS PRESENT. THE DEFENDANT THEN STATED SHE DID NOT NEED ME AT THE RESIDENCE, AT WHICH TIME, I ADVISED HER I WAS GOING TO LEAVE. AS I WAS LEAVING, THE DEFENDANT WENT BACK INTO THE RESIDENCE AND I HEARD THE DEFENDANT CALL THE FEMALE VICTIM A "CUNT." SEVERAL MINUTES LATER, I WAS DISPATCHED BACK TO THIS RESIDENCE IN REFERENCE TO A DISTURBANCE, AT WHICH TIME, IT WAS DETERMINED THAT THE DEFENDANT HAD BATTERED BOTH THE FEMALE AND MALE VICTIM. THE DEFENDANT WAS THEN PLACED UNDER ARREST, HANDCUFFED BEHIND HER BACK (DOUBLE LOCKED) AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR PROCESSING, WITH TOTAL BOND SET AT $1,000.00 PER THE BOND SCHEDULE. *not-exempt* |
