Probable cause affidavit: | SUBMITTED BY: GILMAN, MICHAEL 0604 (09061167) DID UNLAWFULLY COMMIT BATTERY UPON THE VICTIM BY ACTUALLY AND INTENTIONALLY TOUCHING OR STRIKING SAID PERSON AGAINST SAID PERSON'S WILL, OR BY INTENTIONALLY CAUSING BODILY HARM, TO WIT: THE DEFENDANT DID STRIKE THE VICTIM WITH HER HANDS AND A PURSE IN VIOLATION OF FLORIDA STATE STATUTE 784.03(1)(A)(1). ON 063009, AT APPROXIMATELY 2022 HOURS, I RESPONDED TO 43 SOUTH LEE STREET IN BEVERLY HILLS IN REFERENCE TO A BATTERY THAT ALREADY OCCURRED. UPON MY ARRIVAL, I MADE CONTACT WITH THE VICTIM WHO ADVISED THAT WHEN SHE RETURNED TO HER RESIDENCE LOCATED AT 43 SOUTH LEE STREET AT APPROXIMATELY 2015 HOURS ON 063009, THE DEFENDANT, MS LISA ANN BAUER, WHO IS THE VICTIM'S BOSS AND NEIGHBOR, APPROACHED THE VICTIM IN THE FRONT YARD OF HER RESIDENCE AND INITIATED A VERBAL ALTERCATION WITH THE VICTIM REGARDING WORK ISSUES. THE VICTIM STATED THAT THE DEFENDANT BEGAN YELLING AND CURSING AT HER AND THEN BEGAN TO STRIKE THE VICTIM IN THE FACE WITH HER HANDS, SCRATCHING THE VICTIM'S CHEEK. THE VICTIM STATED THAT DURING THE ALTERCATION, SHE DROPPED HER PURSE ON THE GROUND, AT WHICH TIME THE DEFENDANT PICKED UP THE PURSE AND STRUCK THE VICTIM IN THE HEAD WITH IT. THE VICTIM STATED THAT SHE ATTEMPTED SEVERAL TIMES TO ORDER THE DEFENDANT TO LEAVE HER PROPERTY, WHICH MET WITH NEGATIVE RESULTS. THE VICTIM STATED THAT SHE ATTEMPTED TO CONTACT 9-1-1 FOR ASSISTANCE AND AT THAT TIME, THE DEFENDANT STRUCK HER AGAIN. THE VICTIM STATED THAT WITNESS ONE THEN INTERVENED AND SEPARATED THE VICTIM AND THE DEFENDANT. I THEN VISUALLY EXAMINED THE VICTIM'S FACIAL AREA AND OBSERVED SEVERAL SUPERFICIAL SCRATCHES AS WELL AS A SMALL RED AREA ON THE VICTIM'S RIGHT CHEEK. NO OTHER SIGNS OF PHYSICAL INJURY WERE OBSERVED AT THAT TIME. MEDICAL TREATMENT WAS REFUSED BY THE VICTIM ON SCENE. I THEN MADE CONTACT WITH WITNESS ONE, WHO ADVISED THAT SHE HAD BEEN AT THE DEFENDANT'S RESIDENCE LOCATED ACROSS THE STREET FROM THE VICTIM AT 44 SOUTH LEE STREET DISCUSSING WORK ISSUES. WITNESS ONE STATED THAT UPON THE VICTIM'S ARRIVAL AT HER RESIDENCE, SHE OBSERVED THE DEFENDANT WALK TO THE VICTIM'S RESIDENCE AND THE DEFENDANT AND VICTIM BEGAN TO ARGUE. WITNESS ONE STATED A PHYSICAL ALTERCATION OCCURRED BETWEEN THE VICTIM AND DEFENDANT IN WHICH THE DEFENDANT WAS THE AGGRESSOR AND STRUCK THE VICTIM FIRST. WITNESS ONE STATED SHE THEN SEPARATED THE TWO PARTIES AND THAT THE DEFENDANT RETURNED TO HER RESIDENCE AT THAT TIME. I THEN MADE CONTACT WITH WITNESS TWO WHO IS THE DEFENDANT'S BROTHER. WITNESS TWO STATED THAT THE VICTIM ARRIVED AT THE DEFENDANT'S RESIDENCE AND BEGAN ARGUING WITH THE DEFENDANT. WITNESS TWO STATED THAT THE VICTIM THEN PUSHED HER WAY INTO THE DEFENDANT'S RESIDENCE AND STRUCK THE DEFENDANT. WITNESS TWO STATED THAT THE VICTIM DROPPED HER PURSE ON THE FLOOR AND THAT THE DEFENDANT ATTEMPTED TO PICK IT UP AT WHICH TIME, THE VICTIM STRUCK THE DEFENDANT ON THE HEAD WITH HER HAND AND THAT THE DEFENDANT THEN STRUCK THE VICTIM WITH THE PURSE. I THEN MADE CONTACT WITH THE DEFENDANT WHO STATED THAT THE VICTIM CAME TO HER RESIDENCE TO CONFRONT HER ABOUT THE DEFENDANT FIRING HER. THE DEFENDANT STATED THAT SHE AND THE VICTIM BEGAN TO ARGUE AND THAT THE VICTIM THEN OPENED HER FRONT DOOR, PUSHED THE DEFENDANT, AND PUNCHED HER IN THE HEAD AND ARM. THE DEFENDANT STATED SHE THEN MADE THE VICTIM LEAVE HER RESIDENCE BECAUSE SHE WAS AFRAID THAT HER DOG WOULD BITE THE VICTIM. THE DEFENDANT STATED SHE THEN WALKED WITH THE VICTIM TO HER RESIDENCE, WHERE THEY ARGUED AGAIN. THE DEFENDANT STATED SHE THEN RETURNED TO HER RESIDENCE WITH NO FURTHER PHYSICAL ALTERCATIONS TAKING PLACE. I VISUALLY EXAMINED THE DEFENDANT AND OBSERVED NO PHYSICAL INJURY AT THAT TIME. EMERGENCY MEDICAL SERVICES WAS REFUSED BY THE DEFENDANT ON SCENE. DEPUTY THEN WHO ARRIVED ON SCENE AS A BACK UP UNIT, CONDUCTED SCENE PROCESSING (SEE CST REPORT). BASTED ON THE TOTALITY OF CIRCUMSTANCES, I THEN PLACED THE DEFENDANT UNDER ARREST FOR BATTERY. THE DEFENDANT WAS HANDCUFFED (DOUBLE LOCKED) BEHIND HER PERSON AND SECURED IN THE REAR SEAT OF MY PATROL VEHICLE. I THEN TRANSPORTED THE DEFENDANT TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. THE DEFENDANT'S BOND WAS SET AT $500.00 PER THE BOND SCHEDULE. *NOT-EXEMPT* |
