Date of birth: Mar 17, 1978
Probable cause affidavit: SUBMITTED BY: HOLLOWAY, WILLIAM 0463 (AR14-11213) (14-97467) DID UNLAWFULLY AND KNOWINGLY TAKE, OBTAIN OR USE OR ENDEAVOR TO TAKE, OBTAIN OR USE THE PROPERTY OF WAL-MART, TO WIT: VARIOUS ELECTRONICS, BY CARRYING AWAY THE SAID MERCHANDISE, WITH INTENT TO TEMPORARILY OR PERMANENTLY DEPRIVE, A MERCHANT, OF THE POSSESSION, USE, BENEFIT, OR FULL RETAIL VALUE OF SAID PROPERTY, SAID PROPERTY BEING OF A VALUE OF MORE THAN $300.00, IN VIOLATION OF FLORIDA STATE STATUTES 812.015(A). ON 071514, I WAS CONTACTED BY MR BRIAN ELAM, ASSET PROTECTION AGENT FOR THE LECANTO WAL-MART LOCATED AT 1936 NORTH LECANTO HIGHWAY, IN LECANTO. MR ELAM ADVISED ME THAT HE HAD A SUBJECT ENTER THE STORE LATE LAST SATURDAY NIGHT AND EARLY SUNDAY MORNING AND ALSO LATE SUNDAY NIGHT AND EARLY MONDAY MORNING AND REMOVED A LARGE AMOUNT OF VARIOUS ELECTRONICS. HE THEN SHOWED ME A VIDEO OF THE SUBJECT IN THE STORE AND ALSO PHOTOGRAPHS OF EMPTY BOXES THAT THE ITEMS TAKEN WERE REMOVED FROM. ON 071614, I AGAIN WAS CONTACTED BY MR ELAM, THIS TIME HE STATED THAT HE HAD APPREHENDED THE DEFENDANT TODAY. HE STATED THAT THE DEFENDANT ENTERED THE STORE AND OPENED A PINK IPHONE CASE AND CONCEALED THE CASE. HE STATED THAT THE DEFENDANT THEN EXITED THE STORE WHERE HE WAS STOPPED AND BROUGHT BACK TO THE LOSS PREVENTION OFFICE. ONCE THERE MR ELAM CONFRONTED THE DEFENDANT WITH THE OTHER THEFTS. THE DEFENDANT ADMITTED TO STEALING OTHER ITEMS AND OFFERED TO RETURN THE ITEMS TO MR ELAM. . ONCE I ARRIVED AT WAL-MART, MR ELAM EXPLAINED TO WHAT HAD HAPPEN AND THE STATEMENT THAT THE DEFENDANT HAD MADE ABOUT RETURNING THE ITEMS. I THEN READ THE DEFENDANT HIS MIRANDA RIGHTS OFF AN AGENCY MIRANDA CARD. THE DEFENDANT STATED THAT HE HAD SOME OTHER THINGS AT HOME AND THAT HE WAS WILLING TO TURN THOSE ITEMS OVER TO ME. THE DEFENDANT WAS THEN ADVISED THAT HE WAS BEING PLACED UNDER ARREST. HE WAS HANDCUFFED AND DOUBLED LOCKED AND TRANSPORTED TO HIS HOME BY DEPUTY CIRONE. ONCE THERE, THE DEFENDANT'S GIRLFRIEND HAD ALREADY GATHERED SEVERAL ITEMS UP. THE DEFENDANT ADMITTED THE ITEMS WERE THINGS HE HAD STOLEN. THE ITEMS WERE COLLECTED AND LATER RETURNED TO WAL-MART. THE DEFENDANT WAS TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. THE DEFENDANT'S GIRLFRIEND LATER CALLED ME AND STATED SHE FOUND OTHER ITEMS THAT SHE BELIEVED WERE STOLEN. I AGAIN RETURNED TO HER HOME WHERE SHE TURNED OVER SEVERAL OTHER ITEMS. AGAIN I RETURNED THESE ITEMS OVER TO WAL-MART. THE DEFENDANT'S GIRLFRIEND LATER RESPONDED TO WAL-MART TO RETRIEVE THEIR VEHICLE. I ASKED IF SHE WOULD LOOK IN THE VEHICLE FOR ANY OTHER POSSIBLE STOLEN ITEMS. IN THE TRUNK OF THE VEHICLE THERE WAS A BATTERY JUMP BOX, ALONG WITH A SMALL COMPRESSOR. HIS GIRLFRIEND STATED SHE DID NOT KNOW WHERE THEY HAD COME FROM. AT THAT TIME I DID NOT KNOW IF THESE ITEMS WERE STOLEN. I THEN RESPONDED TO THE DETENTION FACILITY. ONCE THERE, I CONDUCTED A POST MIRANDA DIGITALLY RECORDED INTERVIEW. DURING THE INTERVIEW THE DEFENDANT ADMITTED TO GOING TO WAL-MART SEVERAL TIMES. I SHOWED THE DEFENDANT A LIST OF SEVERAL ITEMS THAT TOTALED $1,105.38. I ASKED THE DEFENDANT IF THAT LIST APPEARED TO BE CORRECT, FOR WHICH HE STATED IT DID. THE DEFENDANT ALSO STATED WHICH DAYS HE STOLE WHICH ITEMS. HE ALSO ADMITTED THAT THE ITEMS IN THE TRUNK OF THE VEHICLE WERE ALSO STOLEN. ARRANGEMENTS WERE MADE TO RECOVER THE OTHER ITEMS AT A LATER DATE. DUE TO THE DEFENDANT'S COOPERATION AND WAL-MART BEING ABLE TO GET MOST OF THEIR ITEMS BACK, THE DEFENDANT WAS ONLY CHARGED WITH ONE COUNT OF GRAND THEFT (RETAIL). THE DEFENDANT WAS HELD ON A $2,000.00 BOND PER THE BOND SCHEDULE.
