Probable cause affidavit: SUBMITTED BY: FULLER, DAVID 0267 (AR09110785) DID UNLAWFULLY COMMIT BATTERY UPON THE VICTIM BY ACTUALLY AND INTENTIONALLY TOUCHING OR STRIKING SAID PERSON AGAINST SAID PERSON'S WILL, OR BY INTENTIONALLY CAUSING BODILY HARM, TO WIT: DEFENDANT PUSHED THE VICTIM CAUSING HER TO HIT A DOOR FRAME AND INJURE HER ARM, IN VIOLATION OF FLORIDA STATE STATUTE 784.03(1)(A)(1). ON 090109 I ARRIVED AT 9296 NORTH MINOLA WAY IN REFERENCE TO A DISTURBANCE. I INITIALLY MADE CONTACT WITH THE VICTIM WHO ADVISED SHE AND HER ROOMMATE HAD BEEN ARGUING AND THAT HER ROOMMATE HAD TAKEN HER BAG WHICH CONTAINED HER MONEY ORDER. SHE STATED HER ROOMMATE HAD GONE INTO HER ROOM AND TAKEN THE BAG. I THEN MADE CONTACT WITH THE DEFENDANT, MS LYDIA OLIVER, WHO ADVISED SHE HAD TAKEN THE MONEY ORDER BECAUSE THAT WAS MONEY NEEDED TO PAY BILLS. SHE ADVISED SHE HAD JUST COME HOME FROM BEING OUT OF TOWN AND THAT HER ROOMMATE WAS NOT PAYING HER SHARE OF THE BILLS AND WAS LEAVING ALL THE LIGHTS AND TELEVISIONS ON THROUGHOUT THE HOUSE. SHE STATED SHE HAD TAKEN THE MONEY ORDER BUT DID NOT TAKE THE BAG. THE MONEY ORDER WAS ON THE KITCHEN TABLE AND WAS GIVEN BACK TO THE VICTIM. AT THAT TIME I BELIEVED THE DISTURBANCE WAS OVER AND CLEARED THE RESIDENCE. APPROXIMATELY SIX MINUTES LATER I RECEIVED A CALL BACK FROM THE RESIDENCE AND WHEN I RESPONDED I WAS MET IN THE FRONT YARD BY THE VICTIM, WHO WAS BLEEDING ON HER LEFT FOREARM. SHE ADVISED THAT HER ROOMMATE, THE DEFENDANT, HAD GONE INTO HER ROOM AFTER I HAD LEFT AND HAD TAKEN A PAIR OF SCISSORS AND CUT THE CABLE TO THE TELEVISION. SHE ALSO ADVISED THAT THE DEFENDANT PUSHED HER INTO THE DOORWAY OF HER ROOM CAUSING HER TO HIT THE DOOR FRAME AND CUT HER ARM. ‘ I DID OBSERVE A SMALL LACERATION ON THE VICTIM'S LEFT FOREARM WHICH WAS BLEEDING. EMERGENCY MEDICAL SERVICES (EMS) WAS REFUSED. I THEN MADE CONTACT WITH THE DEFENDANT WHO WAS VERY UPSET. SHE STATED THAT AFTER I HAD LEFT THE FIRST TIME SHE HAD GONE INTO HER ROOMMATE'S BEDROOM AND CUT THE CABLE, BUT SHE STATED SHE NEVER TOUCHED HER IN ANY WAY, AND THAT AFTER CUTTING THE CABLE SHE WENT BACK TO THE KITCHEN TO PUT THE SCISSORS BACK AND THEN WENT TO HER ROOM. AT THAT TIME, BASED ON THE EVIDENCE I HAD, THE DEFENDANT WAS PLACED UNDER ARREST FOR SIMPLE BATTERY AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING. DEFENDANT'S BOND WAS SET AT $500.00 PER THE BOND SCHEDULE. NOTE: BOTH SUBJECTS ARE ON THE DEED TO THE HOUSE BUT LIVE AT SEPARATE ENDS OF THE HOUSE, HAVING THEIR OWN BEDROOMS. *NOT-EXEMPT*
