Probable cause affidavit: SUBMITTED BY: WEAKS, DANIEL 0553 (AR10113435) DID UNLAWFULLY AND KNOWINGLY TAKE, OBTAIN OR USE OR ENDEAVOR TO TAKE, OBTAIN OR USE THE PROPERTY OF BEALL'S DEPARTMENT STORE, TO WIT: THE DEFENDANT DID CARRY AWAY SEVEN SETS OF EARRINGS FROM BEALL'S DEPARTMENT STORE, WITH INTENT TO TEMPORARILY OR PERMANENTLY DEPRIVE SAID MERCHANT OF THE POSSESSION, USE, BENEFIT, OR FULL RETAIL VALUE OF SAID PROPERTY, SAID PROPERTY BEING OF A VALUE OF $300.0 OR MORE, IN VIOLATION OF FLORIDA STATE STATUTE 812.015(8). ON 022010, I RESPONDED TO BEALL'S DEPARTMENT STORE IN INVERNESS, REFERENCE TO A SHOPLIFTER IN CUSTODY. UPON ARRIVAL, I MADE CONTACT WITH THE LOSS PREVENTION OFFICER/WITNESS. HE ADVISED AND DID PROVIDE A WRITTEN STATEMENT INDICATING THAT HE WITNESSED AN ADULT BLACK FEMALE (DEFENDANT MADALENA O'CONNELL), IN THE JEWELRY DEPARTMENT. HE OBSERVED THE DEFENDANT TAKE FOUR SETS OF EARRINGS FROM THE RACK AND CUP THEM IN HER HANDS. HE THEN OBSERVED THE DEFENDANT SELECT THREE MORE SETS OF EARRINGS, AND PLACE THEM IN HER SHOPPING CART. THE DEFENDANT THEN ENTERED INTO THE SHOE DEPARTMENT, AND WHILE IN THIS LOCATION, HE OBSERVED THE DEFENDANT PLACE ALL SEVEN SETS OF EARRINGS IN HER PURSE. HE OBSERVED THE DEFENDANT THEN EXIT THE STORE, PASSING ALL POINTS OF SALE, AND MAKE NO ATTEMPT TO PAY FOR THE CONCEALED MERCHANDISE. THE LOSS PREVENTION OFFICER THEN FOLLOWED THE DEFENDANT OUTSIDE OF THE STORE, CONFRONTED HER, AND BROUGHT HER BACK INTO THE LOSS PREVENTION OFFICE. DEPUTY MUTTER WAS ALSO ON SCENE AND CONDUCTED A SEARCH OF THE DEFENDANT. DEPUTY MUTTER ALSO ADVISED THE DEFENDANT OF HER MIRANDA RIGHTS VIA PRE- PRINTED AGENCY CARD. AT THAT TIME, THE DEFENDANT DID ADMIT TO TAKING THE ITEMS. SHE STATED THAT SHE WAS NOT EMPLOYED AND DID NOT HAVE MONEY FOR THE ITEMS. THE LOSS PREVENTION OFFICER PROVIDED A COMPUTER PHOTOGRAPH OF THE ITEMS IN QUESTION, AS WELL AS A REGISTER RECEIPT SHOWING THE TOTAL VALUE OF THE ITEMS TO BE $340.00. THESE ITEMS WILL BE TURNED INTO RECORDS FOR INCLUSION IN THIS REPORT. I ALSO COMPLETED A PROPERTY RECEIPT DOCUMENTING SEIZURE OF THE ITEMS, AND THE RETURN OF SAID ITEMS TO THE OWNERS/AGENTS, A COPY OF WHICH WAS PROVED TO THE LOSS PREVENTION OFFICER, AND A COPY WILL BE TURNED INTO RECORDS. I PROVIDED THE LOSS PREVENTION OFFICER WITH AN AGENCY CASE CARD BEARING MY NAME AND THIS CASE NUMBER FOR FUTURE REFERENCE. HE ADVISED THAT HE WAS NOT ABLE TO PROVIDE VIDEO OF THIS INCIDENT, BUT WOULD CONTACT THIS AGENCY WHEN AVAILABLE. I THEN PLACED THE DEFENDANT UNDER ARREST FOR FELONY RETAIL THEFT. SHE WAS HAND CUFFED (DOUBLE LOCKED) BEHIND HER BACK, AND PLACED IN THE REAR OF MY PATROL VEHICLE. THE DEFENDANT WAS THEN TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR BOOKING AND PROCESSING, WHERE HER BOND WAS SET AT $2,000.00 PER THE BOND SCHEDULE. *NOT-EXEMPT*
