Probable cause affidavit: | SUBMITTED BY: SMITH, BRADLEY 0477 (AR08102381) PINNER, DAVID 0473 DID DRIVE OR WAS IN ACTUAL PHYSICAL CONTROL OF A VEHICLE WHILE UNDER THE INFLUENCE OF AN ALCOHOLIC BEVERAGE, MODEL GLUE OR ANY SUBSTANCE CONTROLLED UNDER CHAPTER 893 OR CHAPTER 877.111 TO THE EXTENT HER NORMAL FACULTIES WERE IMPAIRED, IN VIOLATION OF FLORIDA STATE STATUTE 316.193. ON 032708 AT 0040 HOURS, I RESPONDED TO THE AREA OF HIGHWAY 44 AND HIGHVIEW TERRACE, IN REFERENCE TO RESPONDING AS BACKUP FOR DEPUTY HILBERER. UPON ARRIVAL I MADE CONTACT WITH DEPUTY HILBERER WHO ADVISED THAT HE HAD STOPPED THE DEFENDANT'S VEHICLE BECAUSE HE WITNESSED THE VEHICLE TRAVEL OVER THE FOG LINE AND THEN THE CENTER LINE THREE TIMES. DEPUTY HILBERER ADVISED ME THAT WHILE TRANSPORTING A PRISONER TO THE CITRUS COUNTY DETENTION FACILITY, HE NOTICED A BLACK FOUR DOOR KIA DRIVING ERRATICALLY IN FRONT OF HIM. DEPUTY HILBERER ADVISED HE WAS TRAVELING WESTBOUND IN THE LEFT LANE AND THE BLACK VEHICLE WAS TRAVELING WESTBOUND IN THE RIGHT LANE. DEPUTY HILBERER ADVISED HE WATCHED THIS VEHICLE DRIVE OVER THE FOG LINES AND THEN DRIVE BACK INTO THE LANE, HOWEVER, IT OVER CORRECTED AND THE VEHICLE'S WHEELS CROSSED OVER THE CENTER LANE. DEPUTY HILBERER ADVISED THAT THE VEHICLE REPEATED THIS ACTION TWO MORE TIMES. DEPUTY HILBERER ALSO NOTICED A STEADY STREAM OF SPARKS EMITTING FROM THE REAR OF THE VEHICLE. AT THAT TIME DEPUTY HILBERER INITIATED A TRAFFIC STOP ON THE VEHICLE. THE VEHICLE STOPPED ON HIGHVIEW AVENUE AT THE INTERSECTION OF HIGHWAY 44. DUE TO THE FACT THAT DEPUTY HILBERER WAS TRANSPORTING A PRISONER, HE REQUESTED THAT THIS DEPUTY BE EN ROUTE TO HIS LOCATION TO TAKE OVER FOR HIS TRAFFIC STOP. I BEGAN TO APPROACH THE DEFENDANT'S VEHICLE IN AN ATTEMPT TO MAKE CONTACT WITH HER. UPON WALKING UP TO THE DEFENDANT'S VEHICLE I NOTICED A TAIL PIPE HANGING DOWN FROM BEHIND THE DEFENDANT'S MUFFLER. IT APPEARED THAT THE DEFENDANT HAD RUN OVER SOMETHING WHICH DAMAGED HER VEHICLE'S EXHAUST SYSTEM, KNOCKING THE MID PIPE OUT OF THE DEFENDANT'S MUFFLER. THIS PIPE DRAGGING THE GROUND WHILE THE VEHICLE WAS IN MOTION, WOULD CAUSE THE SPARKS THAT DEPUTY HILBERER SAID HE SAW. AT THAT TIME I MADE CONTACT WITH THE DEFENDANT WHO WAS SITTING IN HER VEHICLE. THE DEFENDANT'S DOOR WAS SHUT AND HER WINDOW WAS ROLLED UP. I KNOCKED ON THE DEFENDANT'S WINDOW AND SHE ROLLED IT DOWN. I IMMEDIATELY SMELLED THE ODOR OF AN ALCOHOLIC BEVERAGE EMITTING FROM THE VEHICLE. THE DEFENDANT BEGAN TO SPEAK ABOUT A RECENT BRAIN SURGERY WHICH SHE HAD RECEIVED. THE DEFENDANT SPOKE WITH A VERY SLURRED SPEECH. I ASKED THE DEFENDANT TO STEP OUT OF THE VEHICLE. I THEN DIRECTED HER TO THE FRONT OF MY PATROL VEHICLE WHERE THE SURFACE WAS FLAT AND THE AREA WAS WELL LIT. IT SHOULD BE NOTED THAT I COULD STILL SMELL THE ODOR OF AN ALCOHOLIC BEVERAGE EMITTING FROM THE DEFENDANT AT A DISTANCE OF APPROXIMATELY FIVE FEET, AND THE DEFENDANT ALSO SPOKE WITH VERY SLURRED SPEECH. THE DEFENDANT ALSO HAD RED BLOODSHOT GLASSY AND WATERY EYES. I BEGAN TO EXPLAIN TO THE DEFENDANT THAT I BELIEVED HER TO BE UNDER THE INFLUENCE OF ALCOHOLIC BEVERAGES AND REQUESTED SHE SUBMIT TO ROADSIDE SOBRIETY TASKS. AT THAT TIME THE DEFENDANT BEGAN TO DISCUSS HER SURGERY ONCE AGAIN AND THEN ALSO SPOKE ABOUT HER MUFFLER PROBLEM ON HER VEHICLE. I ONCE AGAIN ASKED THE DEFENDANT IF SHE WOULD SUBMIT TO ROADSIDE SOBRIETY TASKS. IT WAS VERY DIFFICULT TO KEEP THE DEFENDANT FOCUSED. I THEN ASKED THE DEFENDANT IF SHE HAD ANY ALCOHOLIC BEVERAGES THIS EVENING. THE DEFENDANT ADVISED SHE HAD HAD ONE ALCOHOLIC BEVERAGE WHILE AT "CLAW DADDY'S" IN CRYSTAL RIVER. THE DEFENDANT COULD NOT ADVISE WHAT SHE HAD HAD TO DRINK OR GIVE ME AN APPROXIMATE TIME SHE HAD DRANK SAID BEVERAGE. I ONCE AGAIN EXPLAINED TO THE DEFENDANT THAT I BELIEVED HER TO BE UNDER THE INFLUENCE OF ALCOHOLIC BEVERAGES WHILE IN CONTROL OF A MOTOR VEHICLE AND I REQUESTED HER TO SUBMIT TO ROADSIDE SOBRIETY TASKS. THE DEFENDANT THEN BECAME VERY ARGUMENTATIVE, AND SHE BEGAN TO INTERRUPT ME EVERY TIME I BEGAN TO SPEAK WITH HER. I ONCE AGAIN ASKED HER TO SUBMIT TO ROAD SOBRIETY TASKS, TO WHICH SHE STATED SHE WOULD NOT. THE DEFENDANT WAS PLACED UNDER ARREST, HANDCUFFED (DOUBLE LOCKED) BEHIND HER BACK AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY. PRIOR TO LEAVING THE SCENE, THE DEFENDANT'S VEHICLE WAS TOWED BY SCALLY'S TOWING. IT SHOULD BE NOTED THAT DURING MY ENTIRE CONVERSATION WITH THE DEFENDANT WHILE OUTSIDE HER VEHICLE, SHE HAD EXTREME DIFFICULTY IN MAINTAINING HER BALANCE AND DID LOSE HER BALANCE AND NEARLY FELL SEVERAL TIMES. WHILE AT THE CITRUS COUNTY DETENTION FACILITY THE DEFENDANT WAS READ HER MIRANDA WARNINGS VIA CARD. THE DEFENDANT WAS ALSO READ HER IMPLIED CONSENT BY DETENTION FACILITY STAFF REQUESTING HER TO SUBMIT TO THE APPROVED TEST OF HER BREATH FOR THE PURPOSE OF DETERMINING THE ALCOHOL CONTENT OF HER BLOOD. THE DEFENDANT STATED THAT SHE WOULD NOT PERFORM ANY OF THE SOBRIETY TASKS AND REFUSED ANY FURTHER TESTING. THE DEFENDANT WAS CHARGED WITH DRIVING UNDER THE INFLUENCE WITH A $500.00 BOND PER THE BOND SCHEDULE. THE DEFENDANT WAS ISSUED A FLORIDA DUI UNIFORM TRAFFIC CITATION, NUMBER 9408-XAI WITH A MANDATORY COURT APPEARANCE OF 041008 AT 1300 HOURS AT THE CITRUS COUNTY COURTHOUSE. *NOT-EXEMPT* |
