DID UNLAWFULLY HAVE IN HER ACTUAL OR CONSTRUCTIVE POSSESSION WITH THE INTENT TO USE, OR DID UNLAWFULLY USE, AN OBJECT INTENDED OR DESIGNED FOR USE IN STORING, CONCEALING OR INJECTING, INGESTING, INHALING OR OTHERWISE INTRODUCING INTO THE HUMAN BODY, A CONTROLLED SUBSTANCE, CRACK COCAINE, TO WIT: A GLASS CRACK PIPE, IN VIOLATION OF FLORIDA STATE STATUTES 893.145 AND 893.147(1)(B) ON 031209 AT APPROXIMATELY 0019 HOURS, MYSELF AND K-9 DEPUTY BRUNK WERE TRAVELING EASTBOUND ON BEVERLY HILLS BOULEVARD BEHIND A SILVER FORD VEHICLE. WHILE TRAVELING BEHIND THE VEHICLE MYSELF AND DEPUTY BRUNK OBSERVED THAT THE TAG LIGHT WAS INOPERABLE, FAILING TO ILLUMINATE THE TAG ATTACHED TO THE VEHICLE. AT THAT TIME I ACTIVATED MY OVERHEAD EMERGENCY LIGHTS AND INITIATED A TRAFFIC STOP IN THE AREA OF BEVERLY HILLS BOULEVARD, AND NORTH ADAMS STREET. I MADE CONTACT WITH THE DRIVER/DEFENDANT, MS MARIAN ADKINS, WHO WAS THE SOLE OCCUPANT IN THE VEHICLE. UPON MAKING CONTACT WITH THE DRIVER, SHE ADVISED SHE KNEW THE REASON I HAD STOPPED HER AND ADVISED IT WAS FOR HER TAG LIGHT BEING OUT. MS ADKINS ADVISED SHE KNEW THIS BECAUSE I HAD JUST RECENTLY STOPPED HER AND HAD GIVEN HER A WARNING APPROXIMATELY ONE WEEK AGO FOR SAME INFRACTION. AT THAT TIME I REQUESTED MS ADKINS DRIVER'S LICENSE AND REGISTRATION, BOTH OF WHICH SHE PROVIDED. UPON RETURNING TO MY VEHICLE, K-9 DEPUTY BRUNK MADE CONTACT WITH THE DEFENDANT AND ASKED IF THERE WAS ANY ILLEGAL CONTRABAND IN THE VEHICLE, TO WHICH SHE STATED, NO. K-9 DEPUTY BRUNK ADVISED THE DEFENDANT THAT HE WOULD BE CONDUCTING AN EXTERIOR K-9 SNIFF OF THE VEHICLE AND REQUESTED THE DEFENDANT STEP OUT OF THE VEHICLE. PRIOR TO K-9 DEPUTY BRUNK WALKING THE DOG AROUND THE DEFENDANT'S VEHICLE, SHE ADVISED she KNEW HER RIGHTS AND HE WAS NOT ALLOWED TO WALK THE DOG AROUND HER VEHICLE AND SHE DEMANDED WE DID NOT USE THE DOG TO SNIFF FOR ILLEGAL CONTRABAND. AT THAT TIME K-9 DEPUTY BRUNK WALKED K-9 JERRY LEE AROUND THE DEFENDANT'S VEHICLE AND A SHORT TIME LATER DEPUTY BRUNK ADVISED THAT K-9 JERRY LEE HAD ALERTED TO THE PRESENCE OF AN ILLEGAL NARCOTIC WITHIN THE VEHICLE. K-9 DEPUTY BRUNK ADVISED THE DEFENDANT THAT THE DOG HAD ALERTED TO HER VEHICLE AND HE BELIEVED THAT NARCOTICS COULD POSSIBLY BE IN HER VEHICLE. THE DEFENDANT ADVISED SHE WISHED TO BE HONEST AND STATED WE WOULD FIND A SMALL CRUMB OF CRACK IN HER PURSE LOCATED INSIDE HER VEHICLE. AT THAT TIME I RETRIEVED THE DEFENDANT'S PURSE FROM THE PASSENGER SIDE SEAT OF HER VEHICLE, and BROUGHT IT OUTSIDE. UPON LOOKING IN THE PURSE THE DEFENDANT ADVISED SHE COULD SHOW ME EXACTLY WHERE IN HER PURSE THE CRACK WAS LOCATED. AT THAT TIME SHE WALKED OVER TO ME, UNZIPPED A SMALL POCKET INSIDE THE PURSE, AND POINTED TO A CLEAR PLASTIC BAGGIE CONTAINING A WHITE SUBSTANCE WHICH WAS LATER FIELD TESTED, AND TESTED POSITIVE FOR COCAINE. ALSO FOUND WITHIN THE POCKET OF THE PURSE WAS A SMALL GLASS TUBULAR PIPE ALONG WITH A SMALL AMOUNT OF BRILLO WITHIN THE PIPE WHICH HAD COCAINE RESIDUE ON IT, WHICH IS KNOWN TO THIS DEPUTY THROUGH TRAINING AND EXPERIENCE TO BE A CRACK PIPE COMMONLY USED TO SMOKE CRACK COCAINE. AT THAT TIME I ADVISED THE DEFENDANT SHE WAS BEING PLACED UNDER ARREST. SHE WAS HANDCUFFED (DOUBLE LOCKED) BEHIND HER BACK. I THEN READ THE DEFENDANT HER MIRANDA WARNINGS VIA PREPRINTED CARD, AT WHICH TIME SHE ADVISED SHE WISHED TO SPEAK WITH ME. MS ADKINS ADVISED ME THAT SHE HAD JUST STARTED SMOKING CRACK APPROXIMATELY THREE MONTHS AGO BECAUSE SHE HAD BEEN LAID OFF FROM HER JOB. I THEN ASKED THE DEFENDANT WHERE SHE HAD PURCHASED THE CRACK, AT WHICH TIME SHE ADVISED SHE HAD GOTTEN IT APPROXIMATELY ONE HOUR AGO FROM A FRIEND WHO HAD GIVEN IT TO HER FOR FREE. THE DEFENDANT WAS THEN PLACED IN THE REAR OF MY PATROL VEHICLE AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY. UPON ARRIVAL AT THE DETENTION FACILITY THE DEFENDANT WAS ISSUED UNIFORM TRAFFIC CITATION 8619-FIQ FOR FAULTY EQUIPMENT/TAG LIGHT BEING INOPERABLE. DEFENDANT'S BOND SET AT $5,500.00 PER THE BOND SCHEDULE. ALL EVIDENCE WAS LATER TURNED OVER TO CITRUS COUNTY SHERIFF'S OFFICE EVIDENCE; THE TOTAL WEIGHT OF THE CRACK COCAINE WAS APPROXIMATELY 1.5 GRAMS. THE DEFENDANT'S VEHICLE WAS TOWED BY SCALLY'S TOWING. *NOT-EXEMPT*
