SUBMITTED BY: HORTON, TIMOTHY 0614 (AR11119068) knowing HER driver's license or driving privilege had been cancelled, suspended or revoked AS A HABITUAL TRAFFIC OFFENDER, drive a motor vehicle upon the highways of this state while such license or privilege was cancelled, in violation of Florida Statute 322.34(5) ON 013111 AT 0256 HOURS, WHILE CONDUCTING TRAFFIC ENFORCEMENT ON SOUTH SUNCOAST BOULEVARD AT THE INTERSECTION OF WEST CYPRESS BOULEVARD IN HOMOSASSA, I OBSERVED A 2000 WHITE PLYMOUTH VOYAGER VAN BEARING FLORIDA TAG ALS-172, WHICH WAS TRAVELING NORTHBOUND IN THE OUTSIDE TRAFFIC LANE OF SUNCOAST BOULEVARD, TRAVEL THROUGH THE RED TRAFFIC SIGNAL AT WEST CYPRESS BOULEVARD. THIS VEHICLE SUDDENLY CAME TO A COMPLETE STOP IN THE INTERSECTION. AFTER THE TRAFFIC SIGNAL TURNED GREEN, I INITIATED A TRAFFIC STOP ON THE VEHICLE JUST NORTH OF THE INTERSECTION. I MADE CONTACT WITH THE DRIVER/DEFENDANT, WHO WAS IDENTIFIED AS MS MARILYN L JONES. I ASKED HER FOR HER DRIVER LICENSE, THE VEHICLE REGISTRATION AND PROOF OF VEHICLE INSURANCE AND EXPLAINED THE REASON FOR THE TRAFFIC STOP. SHE TOLD ME SHE WAS UNABLE TO STOP IN TIME FOR THE RED LIGHT. SHE INFORMED ME THAT HER DRIVER LICENSE WAS EXPIRED, AT WHICH TIME SHE LOOKED AT ME AND STATED THAT HER DRIVER LICENSE WAS SUSPENDED. I RETURNED TO MY PATROL VEHICLE AND CONDUCTED A COMPUTER CHECK OF THE DEFENDANT'S DRIVER LICENSE. I DISCOVERED THAT HER LICENSE HAD BEEN REVOKED FOR 60 MONTHS AS AN HABITUAL TRAFFIC VIOLATOR AS OF 021510. I MADE CONTACT WITH THE DEFENDANT AGAIN, AT WHICH TIME SHE TOLD ME SHE WAS AWARE OF THE STATUS OF HER DRIVER LICENSE BEING SUSPENDED, THAT SHE WAS HABITUAL AND THAT SHE KNEW SHE SHOULD NOT DRIVE FOR FIVE YEARS. MS JONES WAS PLACED UNDER ARREST FOR ONE COUNT OF DRIVING WHILE LICENSE SUSPENDED/REVOKED (DWLS/R.) SHE WAS SECURED IN the REAR SEAT OF MY PATROL VEHICLE AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR FURTHER PROCESSING. UPON ARRIVAL AT THE DETENTION FACILITY, THE DEFENDANT WAS BOOKED AND HELD ON A BOND OF $2,000.00, IN ACCORDANCE WITH THE BOND SCHEDULE. WHILE AT THE DETENTION FACILITY, THE DEFENDANT WAS ISSUED FLORIDA UNIFORM TRAFFIC CITAtion number 9295-RYU7, FOR VIOLATION OF A TRAFFIC CONTROL DEVICE, RED LIGHT, WITH A TRAFFIC FINE OF $264.00 PAYABLE IN THIRTY DAYS AT THE CITRUS COUNTY COURTHOUSE. SHE WAS ALSO ISSUED FLORIDA UNIFORM TRAFFIC CITATION NUMBER 9296-RYU8, FOR DWLS/R HABITUAL, WITH MANDATORY APPEARANCE DATE ON 021711 AT 1300 HOURS AT THE CITRUS COUNTY COURTHOUSE. THE DEFENDANT WAS ISSUED FLORIDA UNIFORM TRAFFIC CITATION NUMBER 4990-GJX9, FOR EXPIRED DRIVER LICENSE LESS THAN FOUR MONTHS, WITH A FINE OF $113.00 PAYABLE IN THIRTY DAYS AT THE CITRUS COUNTY COURTHOUSE.
