SUBMITTED BY: CLARK, CORRY 0711 (AR14-9172) DID DRIVE A MOTOR VEHICLE UPON A HIGHWAY IN THE STATE OF FLORIDA WITHOUT HAVING A VALID DRIVER'S LICENSE AUTHORIZING HIM TO DO SO, IN VIOLATION OF FLORIDA STATE STATUTE NUMBER 322.03(1); ON 022014 AT APPROXIMATELY 1930 HOURS, I RESPONDED TO THE INTERSECTION OF NORTH CARL G ROSE HIGHWAY AND EAST LOUISE LANE, AS BACKUP FOR CANINE DEPUTY INDORATO IN REFERENCE TO A TRAFFIC STOP. UPON ARRIVAL, DEPUTY INDORATO ADVISED THAT HE HAD BEEN TRAVELING NORTHBOUND ON NORTH CARL G ROSE HIGHWAY AND LAKE PARK DRIVE, WHEN HE HAD OBSERVED A BLACK IN COLOR, DODGE PICKUP TRUCK THAT PASSED HIM. HE STATED THAT THIS VEHICLE DID NOT HAVE ANY OPERATIONAL TAILLIGHTS. DEPUTY INDORATO ADVISED THAT HE THEN CONDUCTED A TRAFFIC STOP ON THIS VEHICLE AT THE INTERSECTION OF NORTH CARL G ROSE HIGHWAY AND EAST LOUISE LANE. DEPUTY INDORATO STATED THAT ONCE HE MADE CONTACT WITH THE DRIVER OF THE VEHICLE, LATER IDENTIFIED AS THE DEFENDANT, MR MARK ANDREW BARTOLUZZI, HE REALIZED THAT HE HAD PREVIOUSLY ENCOUNTERED THE DEFENDANT. DEPUTY INDORATO ADVISED THAT HE HAD ISSUED THE DEFENDANT A FLORIDA CRIMINAL TRAFFIC CITATION, CITATION NUMBER 4384GZP4, FOR DRIVING WITHOUT A VALID DRIVER'S LICENSE. DEPUTY INDORATO STATED THAT THIS CITATION WAS ISSUED ON 013114 AT 1900 HOURS, AND HAD A MANDATORY COURT APPEARANCE OF 022714 AT 1300 HOURS. DEPUTY INDORATO ADVISED ME THAT HE HAD ALREADY RUN THE DEFENDANTâS INFORMATION THROUGH TELETYPE AND D.A.V.I.D, BOTH OF WHICH VERIFIED THAT THE DEFENDANT HAD NOT OBTAINED A VALID FLORIDA. I THEN MADE CONTACT WITH THE DEFENDANT. I ASKED HIM TO EXIT HIS VEHICLE, TO WHICH HE AGREED. WE THEN PROCEEDED TO MY PATROL VEHICLE, WHERE I SECURED THE DEFENDANT IN HANDCUFFS, DOUBLE LOCKED HIM BEHIND HIS BACK. I READ THE DEFENDANT HIS MIRANDA RIGHTS VIA A PREPRINTED, AGENCY ISSUED CARD, AND ASKED HIM IF HE UNDERSTOOD HIS RIGHTS AND WHETHER HE WOULD CONTINUE TO SPEAK WITH ME. THE DEFENDANT ADVISED THAT HE DID UNDERSTAND HIS RIGHTS, AND WOULD SPEAK WITH ME AT THIS TIME. I ADVISED THE DEFENDANT THAT DEPUTY INDORATO HAD PREVIOUSLY PULLED HIM OVER AND ISSUED HIM A CITATION FOR DRIVING WITHOUT A VALID DRIVER'S LICENSE, TO WHICH THE DEFENDANT ADVISED THAT HE DID RECALL THIS INCIDENT. I ASKED THE DEFENDANT IF HE HAD SINCE OBTAINED A VALID DRIVER'S LICENSE, AND HE ADVISED THAT HE HAD NOT. I ASKED THE DEFENDANT IF HE HAD EVER HAD A VALID DRIVER'S LICENSE, AND HE ADVISED THAT IT HAD BEEN MANY YEARS SINCE HE HAS HAD A VALID DRIVER'S LICENSE. THE DEFENDANT PROVIDED ME WITH HIS MARYLAND IDENTIFICATION CARD. HE ADVISED THAT THIS WAS THE FIRST TIME THAT HE HAD DRIVEN ANY VEHICLE SINCE DEPUTY INDORATO HAD ISSUED HIM THE CRIMINAL CITATION ON 013114. THE DEFENDANT ADMITTED THAT HE KNEW THAT HE SHOULD NOT HAVE BEEN DRIVING. THE DEFENDANT WAS THEN ADVISED THAT HE WAS BEING PLACED UNDER ARREST, FOR DRIVING WITHOUT A VALID DRIVER'S LICENSE. THE DEFENDANT WAS THEN SECURED IN THE REAR OF MY PATROL VEHICLE, AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY. UPON ARRIVAL, HE WAS RELEASED TO DETENTION FACILITY STAFF FOR BOOKING AND PROCESSING. DEPUTY INDORATO ISSUED THE DEFENDANT A FLORIDA CRIMINAL TRAFFIC CITATION, BEARING CITATION NUMBER 437GQP7, FOR DRIVING WITH NO VALID DRIVER'S LICENSE, WITH A MANDATORY COURT APPEARANCE OF 031314 AT 1300 HOURS. DEPUTY INDORATO ALSO ISSUED THE DEFENDANT A CITRUS COUNTY SHERIFF'S OFFICE WRITTEN WARNING, BEARING WARNING NUMBER 374459B, FOR DRIVING WITHOUT OPERATIVE TAILLIGHTS. AT THE DEFENDANTâS REQUEST, HIS VEHICLE AND WALLET WERE TURNED OVER TO THE PASSENGER OF HIS VEHICLE. THE DEFENDANT WAS CHARGED WITH ONE COUNT OF DRIVING WITH NO VALID DRIVER'S LICENSE, WITH HIS BOND SET AT $150.00, PER THE BOND SCHEDULE. |
