SUBMITTED BY: REYNOLDS, CONNARY 1267 (AR14-9830) DID UNLAWFULLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION WITH THE INTENT TO USE, OR DID UNLAWFULLY USE, AN OBJECT INTENDED OR DESIGNED FOR USE IN STORING, CONCEALING OR INJECTING, INGESTING, INHALING OR OTHERWISE INTRODUCING INTO THE HUMAN BODY, A CONTROLLED SUBSTANCE, TO WIT: A GLASS PIPE WITH A WHITE POWDERY RESIDUE, AND CLEAR PLASTIC BAGGIES, IN VIOLATION OF FLORIDA STATE STATUTES 893.145 AND 893.147(1)(B) ON 040814 AT APPROXIMATELY 2008 HOURS WHILE ON ROUTINE PATROL IN THE AREA OF CRYSTAL RIVER, I OBSERVED A TAN IN COLOR, 1998 FORD F150 PICKUP TRUCK WHICH WAS TRAVELING SOUTH BOUND ON NORTH VIRGINIA ROAD. I OBSERVED THAT THIS VEHICLE HAD AN INOPERATIVE PASSENGERâS SIDE HEADLIGHT. THE VEHICLE CAME TO A COMPLETE STOP AT THE STOP SIGN OF THE INTERSECTION OF NORTH VIRGINIA ROAD AND WEST GULF TO LAKE HIGHWAY, AND THEN TURNED LEFT. AS THE VEHICLE DROVE BY MY LOCATION, I OBSERVED THAT THE DRIVER WAS MR MARK ANTHONY DICK, LATER IDENTIFIED AS THE DEFENDANT AND REGISTERED OWNER OF THE VEHICLE. THIS SUBJECT IS KNOWN TO ME, AND I AM AWARE THAT THE DEFENDANT HAS AN ACTIVE CITRUS COUNTY WARRANT FOR HIS ARREST IN REFERENCE TO DRUG CHARGES. I THEN TURNED MY MARKED PATROL VEHICLE LEFT ON WEST GULF TO LAKE HIGHWAY, AND BEGAN TO FOLLOW THIS VEHICLE FOR A SHORT TIME. I THEN ACTIVATED MY OVERHEAD EMERGENCY EQUIPMENT, AND CONDUCTED A TRAFFIC STOP ON THE TAN IN COLOR FORD PICKUP TRUCK, BEARING FLORIDA LICENSE PLATE NUMBER 781YZV. THE VEHICLE TURNED IN TO THE PARKING LOT OF CHRIST MEDICAL CENTER, WHICH IS LOCATED AT 7562 WEST GULF TO LAKE HIGHWAY. I APPROACHED THE VEHICLE AND MADE CONTACT WITH THE SOLE OCCUPANT OF THE VEHICLE DRIVER/DEFENDANT, MR MARK ANTHONY DICK. I ADVISED HIM OF THE REASON FOR MY TRAFFIC STOP, WHICH WAS THAT HIS PASSENGERâS SIDE HEADLIGHT WAS INOPERABLE, AS WELL AS MY KNOWLEDGE OF HIS ACTIVE CITRUS COUNTY WARRANT. I ASKED THE DEFENDANT FOR HIS DRIVER'S LICENSE, VEHICLE REGISTRATION AND PROOF OF INSURANCE, AND HE PROVIDED ME WITH ALL REQUESTED DOCUMENTATION. I THEN REQUESTED BACKUP, AND DEPUTY CRIDLAND AND DEPUTY HRYC ARRIVED ON SCENE SHORTLY AFTER. DEPUTY HRYC CONDUCTED AN EXTERIOR SNIFF OF THE VEHICLE, UTILIZING HIS CANINE PARTNER ZEUS. DEPUTY HRYC ADVISED THIS DEPUTY THAT HIS CANINE HAD ALERTED ON THE VEHICLE. ZEUS WAS THEN RESECURED. SEE DEPUTY HRYCâS CANINE SUPPLEMENT FOR FURTHER DETAILS. THE DEFENDANT WAS THEN ASKED TO EXIT THE VEHICLE, WHICH HE COMPLIED. THE DEFENDANT WAS PLACED IN HANDCUFFS, DOUBLE LOCKED BEHIND HIS BACK, AND SEARCHED INCIDENT TO ARREST FOR THE WARRANT. DURING A SEARCH OF THE DEFENDANTâS PERSON, IN HIS LEFT FRONT POCKET, DEPUTY HRYC LOCATED A GLASS PIPE, CONTAINING A WHITE POWDERY RESIDUE. BASED ON MY TRAINING AND EXPERIENCE, I RECOGNIZED THIS RESIDUAL SUBSTANCE TO BE METHAMPHETAMINE. A FIELD TEST WAS LATER CONDUCTED ON THE RESIDUE, UTILIZING AN AGENCY ISSUED FIELD TEST KIT, AND THE SUBSTANCE YIELDED A POSITIVE RESULT FOR THE PRESENCE OF METHAMPHETAMINE. ALSO DURING THE SEARCH OF THE DEFENDANTâS PERSON, A PRESCRIPTION PILL BOTTLE WAS LOCATED IN HIS LEFT FRONT POCKET. THIS BOTTLE WAS NOT PRESCRIBED TO THE DEFENDANT, BUT WAS PRESCRIBED TO âGERALDINE EDWARDSâ FOR TRAMADOL 500 MG. THE DEFENDANT COULD NOT PROVIDE A REASON OR PRESCRIPTION FOR TRAMADOL. HE DID NOT KNOW WHO THEY BELONGED TO. DEPUTY HRYC AND I THEN CONDUCTED A HAND SEARCH OF THE DEFENDANTâS VEHICLE. DURING THIS SEARCH, A LARGE PLASTIC BAGGIE WAS FOUND, WHICH CONTAINED NUMEROUS SMALLER PLASTIC BAGGIES INSIDE OF IT. I RECOGNIZED THAT THESE TYPES OF CONTAINERS AARE COMMONLY USED DURING DRUG TRANSACTIONS. ALSO LOCATED NEAR THE PLASTIC BAGGIES A DIGITAL SCALE, WHICH I ALSO RECOGNIZED TO BE COMMONLY USED DURING DRUG TRANSACTIONS. I ALSO LOCATED AN NRA FOLDING POCKET KNIFE, WHICH APPEARED TO HAVE THE SAME WHITE POWDERY RESIDUAL SUBSTANCE FOUND ON THE BLADE AS FOUND ON THE PIPE. THE DEFENDANT ADVISED THAT HE DOES HAVE A âCRYSTAL METHâ PROBLEM, BUT ADVISED THAT HE DOES NOT SELL METHAMPHETAMINE. A FURTHER SEARCH OF THE VEHICLE DID NOT RESULT IN ANY FURTHER DRUGS, PARAPHERNALIA OR CONTRABAND LOCATED. THE DEFENDANT WAS THEN SECURED IN THE REAR OF MY PATROL VEHICLE. I ADVISED HIM THAT HIS VEHICLE WOULD BE LEFT ON SCENE WITH DEPUTY HRYC, AND TOWED BY KNIGHTLY AUTO. DEPUTY HRYC COMPLETED A VEHICLE IMPOUND RECEIPT, WHICH WAS LATER FORWARDED TO RECORDS. THE DEFENDANT WAS ADVISED THAT HE WAS BEING PLACED UNDER ARREST FOR POSSESSION OF DRUG PARAPHERNALIA. THE DEFENDANT WAS THEN TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY. UPON ARRIVAL, HE WAS RELEASED TO DETENTION FACILITY STAFF FOR BOOKING AND PROCESSING. THE DEFENDANT WAS CHARGED WITH ONE COUNT OF POSSESSION OF DRUG PARAPHERNALIA, AND HIS BOND WAS SET AT $500.00, PER THE BOND SCHEDULE. THE DEFENDANT WAS ALSO ISSUED A CITRUS COUNTY SHERIFF'S OFFICE WRITTEN WARNING, NUMBER 378119B, FOR FAULTY EQUIPMENT. |
