Probable cause affidavit: | SUBMITTED BY: PHILLIPS, CASEY 0482 (AR14-13331) (14-177718) DID UNLAWFULLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: COCAINE, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(A). ON 123114 AT APPROXIMATELY 1915 HOURS, DEPUTY POLLARD ADVISED HE HAD OBSERVED A FULL SIZE BLACK NISSAN PICKUP TRUCK RUN THE STOP SIGN AT CARTER STREET AND NORTH CENTRAL AVENUE. THE TRUCK PULLED OUT FROM CENTRAL AVENUE EAST ON HIGHWAY 44. SERGEANT MARSHALL PULLED IN BEHIND IT AND INITIATED HIS OVERHEAD LIGHTS AT THE OUTBACK STEAK HOUSE. the VEHICLE SLOWED BUT PROCEEDED DOWN HIGHWAY 44. AT THE TIME THAT SERGEANT MARSHALL REACHED THE RACETRAC GAS STATION, HE INITIATED HIS SIREN. AT THAT TIME, THE PICKUP TRUCK WAS TRAVELING BETWEEN 5 AND 10 MILES PER HOUR (MPH) IN the OUTSIDE LANE. SERGEANT MARSHALL PUT HIS SPOTLIGHT IN THE BACK WINDOW OF THE BLACK PICKUP TRUCK and OBSERVED the DRIVER FIDGETING AROUND THE AREA OF THE CONSOLE. the TRUCK theN PULLED INTO the SUNTRUST BANK AT 2001 HIGHWAY 44 WEST. AT THE TIME THE VEHICLE STOPPED, SERGEANT MARSHALL EXITED AND ADVISED THE DRIVER TO SHOW HIM HIS HANDS DUE TO SERGEANT MARSHALL OBSERVING the DRIVER ATTEMPTING TO CONCEAL AN UNKNOWN ITEM, AT WHICH TIME the DRIVER COMPLIED. AT THE TIME OF MY ARRIVAL, SERGEANT MARSHALL HAD THE DRIVER OUT OF THE VEHICLE STANDING IN FRONT OF HIS PATROL VEHICLE. JUST AFTER THAT, K-9 DEPUTY RITLI ARRIVED ON SCENE AND DEPLOYED CANINE AJAX WHERE HE CONDUCTED A 360 DEGREE SNIFF OF THE FREE AIR SPACE AROUND THE BLACK NISSAN TITAN BEARING FLORIDA TAG MARKD, with AN ALERT. AFTER K-9 DEPUTY RITLI RESECURED CANINE AJAX, I WENT TO THE PASSENGER SIDE DOOR OF THE PICKUP. I BEGAN SEARCHING THE PASSENGER SIDE COMPARTMENT. AS I PICKED UP A PEPSI CAN OUT OF THE CENTER CONSOLE, I USED MY FLASHLIGHT AND I OBSERVED A clear PLASTIC SANDWICH BAGGIE INSIDE THE CAN. USING A POCKET KNIFE, I CUT the TOP OPEN AND REMOVED THE PLASTIC BAGGIE WITH A PAIR OF NEEDLE NOSE PLIERS SHOWING THE CLEAR PLASTIC BAGGIE CONTAINED A WHITE POWDERLY SUBSTANCE. A PRESUMPTIVE FIELD TEST SHOWED A POSITIVE REACTION FOR COCAINE. the SUBJECT WAS HANDCUFFED (DOUBLE LOCKED) BEHIND THE BACK. DEPUTY SCHAEFFER ARRIVED ON SCENE AND TRANSPORTED THE SUBJECT TO THE CITRUS COUNTY DETENTION FACILITY WHERE HE WAS TURNED OVER TO STAFF FOR BOOKING AND PROCESSING. AT THE TIME SERGEANT MARSHALL WAS PLACING THE DEFENDANT IN THE REAR OF DEPUTY SCHAFFER'S PATROL VEHICLE, THE DEFENDANT ADVISED HE WANTED TO MAKE NO statements. THIS DEPUTY CONTACTED TELETYPE REFERENCE A TOW TRUCK. TONY'S BODY SHOP ARRIVED ON SCENE. A TOW SHEET WAS FILLED OUT AND TURNED INTO RECORDS. THE COCAINE THAT FIELD TESTED POSITIVE WEIGHED APPROXIMATELY 1.1 GRAMS and WILL BE TURNED INTO EVIDENCE. the DEFENDANT'S BOND WAS SET $2,000.00 PER THE BOND SCHEDULE. |
