| Probable cause affidavit: | SUBMITTED BY: SANTIAGO, JUAN 0437 (ar12-283) (12-46217) ON 030912 AT APPROXIMATELY 1800 HOURS, THIS DETECTIVE MET WITH MEMBERS FROM THE TACTICAL IMPACT UNIT (TIU) AND SPECIAL VICTIM'S UNIT (SVU) FOR THE PURPOSE OF CONDUCTING AN UNDER AGE PURCHASE OF ALCOHOL AND TOBACCO FROM BUSINESSES WITHIN CITRUS COUNTY. DURING the operation an under age informant teamed up with this DETECTIVE and DETECTIVE novy. on 030912 at APPROXIMATELY 1922 HOURS, we arrived at the sunoco located at 11520 north florida avenue in dunnellon. the JUVENILE informant was provided with money by DETECTIVE novy and he entered the sunoco and PURCHASED a six pack of 12 oz budweiser beer. after the purchase, he exited the SUNOCO and made contact with this DETECTIVE and DETECTIVE novy. he advised that he purchased the beeR from the only MALE clerk inside the business, who was tall and wearing a blue shirt behind the counter who was later identified as the DEFENDANT, mr. mark kincaid. this DETECTIVE then proceeded into the store and made contact with the DEFENDANT. i advised the DEFENDANT that he had just sold beer to a 16 year old, at which time, he advised that he was not in the right mind and usually asks for indentification but forgot to this time. the DEFENDANT was issued a MISDEMEANOR NOTICE TO APPEAR (NTA) citation NUMBER 17933 with a mandatory court date of 032912 at 1300 HOURS at the citrus county court house. the beer was PHOTOGRAPHed by DETECTIVE novy and returned to the owner and provided a property receipt. THE DEFENDANT WAS RELEASED ON HIS OWN RECOGNIZANCE (ROR) AND GIVEN AND EXPLAINED THE COPY OF THE NOTICE TO APPEAR (NTA) CITATION. |
