| Comments: | Sex offenders have always lived in our communities; but it was not until passage of the community protection act of 1990 (which mandates sex offender registration) that law enforcement even knew where they were living. In many cases, law enforcement is not able to share that information with you. Citizen abuse of this information to threaten, intimidate or harass registered sex offenders will not be tolerated. Further, such abuse could potentially end law enforcement's ability to do community notifications. We believe the only person who wins if community notification ends is the sex offender, since sex offenders drive their power through secrecy. According to official documents, Misiak was convicted in Whatcom County Superior Court on March 6, 2001 by Jury Trial of Rape of a Child in the 1st degree and Child Molestation 1st Degree,3 counts. He was given a term of 180 months in prison. Misiak , age 43 sexually assaulted a 9 year old female who was a friend of his daughters and would frequently spend time at Misiak's home. Misiak would give his victims a backrubs during which time Misiak sexually assaulted them. Two of the victims were sexually assaulted from ages 6 to 9 and 4 to 7. Everything appears to have started with backrubs and the victims were forced to touch Misiak in his private areas. Misiak while in prison was screened for Sex offender treatment, however declined to participate as he denies committing the crimes. Misiak is on active supervision with the Everett Office of the Department of Corrections for 36 months. 425-356-2800. " Probation Conditions Shall not use or possess alcohol Shall not consume or possess controlled substances without a valid Rx. Shall not frequent places were minors congregate. Shall not be at parks, play grounds or schools. Shall not form relationships with families who have minor children. No contact with minors Shall have no items that may lure children Shall have not control over of position of trust over any minor under 13 years old. Shall have no contact with his victims. Shall not own, possess or have under his control any firearm. Attend sex offender treatment. Shall submit to breathalyzer and Urinalysis testing as requested. |
