SUBMITTED BY: LAKATIS, KENNETH 0585 (AR10117638) UNLAWFULLY AND KNOWINGLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: CANNABIS, COMMONLY REFERRED TO AS MARIJUANA, IN AN AMOUNT UNDER TWENTY GRAMS, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(B). ON 102810 AT APPROXIMATELY 2115 HOURS, DEPUTY BERGEN AND I WERE TRAVELING SOUTH ON ROCK CRUSHER ROAD. AS WE WERE NEARING THE INTERSECTION OF ROCK CRUSHER ROAD AND WEST VENABLE STREET, A GREY FOUR DOOR PONTIAC PASSED US IN A NO PASSING ZONE WHICH WAS CLEARLY MARKED WITH A DOUBLE YELLOW LINE. DEPUTY BERGEN AND I THEN ACTIVATED THE EMERGENCY LIGHTS ON OUR UNMARKED PATROL VEHICLE AND PULLED THE PONTIAC OVER. UPON THE VEHICLE STOPPING, DEPUTY BERGEN MADE CONTACT WITH THE DRIVER. WHILE DEPUTY BERGEN WAS SPEAKING WITH THE DRIVER, I MADE CONTACT WITH THE PASSENGER/DEFENDANT, MR MARSHALL HOTTINGER, AND ASKED HIM IF THERE WAS ANY "WEED" IN THE VEHICLE. HE STATED YES, REACHED DOWN ONTO THE FLOORBOARD AND HANDED ME TWO PLASTIC BAGS CONTAINING APPROXIMATELY 7 1/2 GRAMS IN TOTAL OF CANNABIS. AT THAT TIME HE WAS ASKED THE STEP FROM THE VEHICLE. HE WAS SECURED IN HANDCUFFS(DOUBLE LOCKED) BEHIND HIS BACK, ADVISED HE WAS UNDER ARREST FOR POSSESSION OF CANNABIS IN AN AMOUNT UNDER TWENTY GRAMS AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR FURTHER PROCESSING. UPON ARRIVAL, DEFENDANT HOTTINGER WAS PROCESSED, BOOKED AND HELD ON A BOND OF $500.00, IN ACCORDANCE WITH THE BOND SCHEDULE.
