Probable cause affidavit: SUBMITTED BY: SMOLENSKY, STEVE 0142 (AR08106642) DID UNLAWFULLY AND KNOWINGLY OBTAIN, USE OR ENDEAVOR TO OBTAIN OR USE THE PROPERTY OF THE VICTIM, TO-WIT: BEALL'S DEPARTMENT STORE OF THE VALUE OF THREE HUNDRED DOLLARS ($300.00) OR MORE, BUT LESS THAN FIVE THOUSAND DOLLARS ($5,000.00), TO WIT: VARIOUS ITEMS OF CLOTHING AND JEWELRY VALUED AT $1200.00, WITH THE INTENT TO EITHER TEMPORARILY OR PERMANENTLY DEPRIVE THE VICTIM OF A RIGHT TO THE PROPERTY OR A BENEFIT THEREOF, OR DID APPROPRIATE THE SAID PROPERTY TO HER OWN USE OR THE USE OF ANY PERSON NOT ENTITLED THERETO, IN VIOLATION OF FLORIDA STATUTES 812.014. ON 121008 AT APPROXIMATELY 1740 HOURS, I WAS DISPATCHED TO BEALLS DEPARTMENT STORE LOCATED AT 2851 EAST GULF TO LAKE HIGHWAY IN INVERNESS IN REFERENCE TO A RETAIL THEFT. ON ARRIVAL I MADE CONTACT WITH LOSS PREVENTION OFFICER, MR RICHARD CABRAL, WHO ADVISED ON THIS DATE HE OBSERVED AN OLDER WHITE FEMALE ENTER THE STORE AND SELECT SEVERAL ITEMS. THE SUBJECT THEN WENT TO THE JEWELRY DEPARTMENT AND SELECTED APPROXIMATELY 10 ITEMS OF JEWELRY AND THEN WENT TO THE PURSE DEPARTMENT AND CONCEALED THE MERCHANDISE IN HER PURSE. THE SUBJECT THEN WENT TO THE MISSES DEPARTMENT AND SELECTED SEVERAL ITEMS OF CLOTHING AND WENT TO THE FITTING ROOM. AFTER THE SUBJECT LEFT THE FITTING ROOM, THE LOSS PREVENTION OFFICER WENT TO THE FITTING ROOM AND FOUND SIX EMPTY HANGERS. LOSS PREVENTION THEN RETURNED TO THE OFFICE AND CONTINUED TO OBSERVE THE FEMALE, AT WHICH TIME SHE SELECTED TWO MORE SHIRTS AND STUFFED THEM INTO HER PURSE. THE SUBJECT THEN SELECTED A FLEECE JACKET, TORE THE TAGS OFF, AND PUT IT ON. THE SUBJECT THEN SELECTED ONE MORE ITEM OF JEWELRY, CONCEALING IT, AS WELL AS MORE CLOTHING, UNDER THE FLEECE JACKET THAT SHE HAD TAKEN OFF AND PLACED IN THE CART. THE SUBJECT WENT TO THE CASH REGISTER TO PAY FOR OTHER TOYS SHE HAD PICKED UP IN THE STORE, AT WHICH TIME HER CREDIT CARD WAS DENIED. SHE ASKED STORE EMPLOYEES TO HOLD THE MERCHANDISE FOR HER UNTIL 121108 SO SHE COULD COME BACK AND PAY FOR IT WITH ANOTHER CARD. SUBJECT THEN LEFT THE STORE WITH THE MERCHANDISE CONCEALED IN HER PURSE. THE DEFENDANT BROWSED FOR A SHORT TIME AT THE CLOTHES RACKS AT THE FRONT OF THE STORE WHILE LOSS PREVENTION WAITED TO MAKE SURE SHE WAS NOT COMING BACK INTO THE STORE. THE DEFENDANT WALKED ACROSS THE PARKING LOT, AT WHICH TIME SHE WAS DETAINED BY LOSS PREVENTION OFFICERS AND RETURNED TO THE STORE. AT THAT TIME THIS AGENCY WAS NOTIFIED. I MADE CONTACT WITH THE DEFENDANT, MS MARIA IACOVIELLO, AND READ HER MIRANDA WARNING S VIA CARD AND QUESTIONED HER REFERENCE THIS INCIDENT. THE DEFENDANT ADMITTED TO TRYING TO DEPRIVE BEALLS OF THE VALUE OF THE MERCHANDISE WHICH ENDED UP BEING $1203.97. THE DEFENDANT ADVISED SHE HAD STOLEN THE ITEMS TO GIVE AS GIFTS FOR HER GRAND CHILDREN AND GREAT GRAND CHILDREN. THE DEFENDANT'S PURSE WAS OPENED. AT WHICH TIME APPROXIMATELY 29 ITEMS OF VARIOUS CLOTHING AND JEWELRY WERE REMOVED. THE COMPLAINANT/LOSS PREVENTION OFFICER ADVISED BEALLS DID WISH TO PROSECUTE REFERENCE THIS INCIDENT. THE COMPLAINANT ALSO TRESPASS WARNED THE DEFENDANT THIS DATE. THE TRESPASS WARNING WAS LOGGED WITH DISPATCH. THE COMPLAINANT COMPLETED A WRITTEN STATEMENT REFERENCE THIS INCIDENT (TO FOLLOW). A CASH REGISTER RECEIPT OF THE DESCRIPTION OF ALL ITEMS WAS ALSO PROVIDED (TO FOLLOW). A PICTURE WAS TAKEN OF THE MERCHANDISE TO BE SCANNED BY RECORDS (TO FOLLOW). DEFENDANT WAS ARRESTED AND TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY FOR PROCESSING. BOND SET AT $2,000.00 PER BOND SCHEDULE. *NOT-EXEMPT*
