Probable cause affidavit: | SUBMITTED BY: HOLLOWAY, W. TODD 0463 (AR07100535) DID UNLAWFULLY AND KNOWINGLY HAVE IN HIS ACTUAL OR CONSTRUCTIVE POSSESSION A CONTROLLED SUBSTANCE, TO WIT: LORTAB PILLS. PERCOCET PILLS AND SOMA PILLS, IN VIOLATION OF FLORIDA STATE STATUTE 893.13(6)(A) ON 112907, I RESPONDED TO THE AREA OF EAST BEDFORD ROAD IN REFERENCE TO POSSIBLE DRUG ACTIVITY. WHILE EN ROUTE, I PASSED THE DEFENDANT'S VEHICLE IN THE AREA OF ORANGE AVENUE AND BEDFORD ROAD AND THE DEFENDANT WAS DRIVING WITH HER HIGH BEAM LIGHTS ON. I TURNED AROUND AND FOLLOWED THE DEFENDANT TO FLORAL CITY FOODS LOCATED ON EAST ORANGE AVENUE AND OLD FLORAL CITY ROAD. I OBSERVED THE DEFENDANT EXIT HER VEHICLE, ENTER THE STORE AND RETURN A SHORT TIME LATER. THE DEFENDANT THEN PROCEEDED NORTH ON OLD FLORAL CITY ROAD. I FOLLOWED HER AND OBSERVED HER DRIVE LEFT OF CENTER TWICE AND THEN DRIVE OFF THE RIGHT SIDE OF THE ROAD. I ACTIVATED MY OVERHEAD LIGHTS AND CONDUCTED A TRAFFIC STOP AT THE CORNER OF OLD FLORAL CITY ROAD AND EAST KEATING PARK DRIVE. I APPROACHED THE DRIVER/DEFENDANT, MS MARY JO TURNER PENDLETON, AND OBTAINED HER DRIVER'S LICENSE, THE VEHICLE REGISTRATION AND ASKED HER IF SHE HAD ANYTHING TO DRINK THIS EVENING, TO WHICH SHE STATED YES. I ASKED HER TO PERFORM FIELD SOBRIETY TASKS, TO WHICH SHE COMPLIED. AFTER COMPLETING THE FIELD SOBRIETY TASKS, I ISSUED HER CITATION NUMBER 0422-ELY, FOR FAILURE TO MAINTAIN LANE. I RETURNED THE DEFENDANT'S DRIVER'S LICENSE AND THE VEHICLE REGISTRATION TO HER AND ASKED HER IF SHE HAD ANYTHING ILLEGAL IN THE VEHICLE, TO WHICH SHE STATED NO AND ASKED ME IF I WANTED TO SEARCH IT. I ADVISED THE DEFENDANT THAT I WOULD SEARCH. THE DEFENDANT THEN REACHED INTO THE VEHICLE AND REMOVED HER PURSE. I ASKED THE DEFENDANT IF I COULD LOOK INSIDE OF HER PURSE, TO WHICH SHE STATED YES. SHE STARTED TO REMOVE THE CONTENTS AND PLACE THEM ON THE TRUNK OF HER VEHICLE. AS SHE WAS DOING THIS, I OBSERVED SEVERAL WHITE PILLS AT THE BOTTOM OF HER PURSE. I ASKED HER WHAT THE PILLS WERE FOR, TO WHICH SHE STATED THEY WERE PAIN KILLERS FOR HER BACK. I ASKED HER IF SHE HAD A PRESCRIPTION FOR THE PILLS, TO WHICH SHE STATED NO. I ADVISED THE DEFENDANT OF HER MIRANDA WARNINGS AND CONFIRMED THAT THE PILLS WERE SCHEDULE TWO NARCOTICS. THE DEFENDANT WAS PLACED UNDER ARREST FOR POSSESSION OF CONTROLLED SUBSTANCE. DURING A FURTHER SEARCH OF THE DEFENDANT'S PURSE, I FOUND FIVE SOMA PILLS, SEVEN LORTAB PILLS, AND NINE PERCOCET PILLS. THE DEFENDANT WAS HANDCUFFED (double locked) behind her back, secured in the rear seat of my patrol vehicle and TRANSPORTED TO THE CITRUS COUNTY DETENTION FACILITY WHERE SHE WAS HELD ON $5,000.00 BOND, PER THE BOND SCHEDULE. THE DEFENDANT'S VEHICLE WAS SECURED AND LEFT AT THE SCENE, PER THE DEFENDANT'S REQUEST. *NOT-EXEMPT* |
